A+plan review has been conducted on the subject project by the Engineering
Division. I have prepared the following comments in regard to issues outlined
in the SDR 87-20 which remain to be addressed on the plans. These issues
have no direct bearing on the site grading, therefore, the site grading has
been approved according to the conditions in a letter from Brad Roast, City of
Tigard Building Official.
The following conditions must be addressed prior to any additional work on the
property:
1) The half-street improvements will be required to be constructed prior to
the occupancy of the site. The design of these improvements will require
the City's Engineering Division approval.
2) A pavement section detail is required for the parkng lot, pathway and
half-street improvements.
3) Tigard Water District approval of the water service and connection details.
4) The apartments are required to have a pathway connection to the pathwa)
along Fanno Creek.
5) Site lighting is required.
6) Roof drain connections are required.
7) The areas adjacent to the pathway must be graded and revegetated to
facilitate mowing and vehicle access.

SPECTRUM PROPERTIES
APPLICATION: Request by Spectrum Properties (Charles Harris, applicant) to
construct a 40 unit apartment complex un approximately 7. 7 acres xunod R•-12
(Medium Density Residential, 12 units per acre) . The parcel is located at
11001 through 44f*99 -SW Nurth Dakota Street (WCTM 1S1 34DA, Tax Lot 1001) .

DECISION: Notice is hereby jives that the Planning Director for the City of
Tigard has APPROVED the above described application subject to certAin
conditions. The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FACT
I . Background
The parcel was previously subject to Planning Commission review ori
July 5 and August 19, 1986. Requested was a zone change from R-12 to
R-12. PD (ZC 7-86); subdivision and planned development approval for 16
lots ranging from 5000 to 7,000 square feet and a common open c4rea
(S 12-86, PD 4-86); and sensitive lands review to allow installation
of a sewer line and street improvements within the 100 year floodplain
(SL 7-86) . The requests were approved subject: to conditions.
Approval was final on September 9, 1986. Because construction of the
approved plan was not begun within one year-, the approval expired on
September 9, 1987.
2. Vicinity Information
Properties to the north and east on the opposite side of Fanno Creek
are zoned I-P (Industrial Park) and are partially developed. The
Property immediately to the west is developed with duplexes and zoned
R-12. Windsor Place Subdivision (formerly Rosebud Subdivision) which
is zoned R-7 (PD) (Residential, 7 units/acre, Planned Development) is
located to the northwest. A small acreage homesit-e zoned R-12 is on
the south side of North Dakota Street.
3, Site Information and Proposal Description
The 7. 7 acre property is presently undeveloped. Approximately 5.',
acres lie within the 100 year floodplain of Fanno Creek. The Proposed
5 building, 40 unit apartment complex would be located on 2.2 acres in
the southwestern portion of the parcel above the 100 year floodplain.
Access to the parcel is from SW North Dakota Street, a minor Collector
street. A 20 foot wide bridge conveys traffic across Fanno Creek at
the east end of the applicant's property .

4. Aycncy and NPO Comments
The Engineering Division reviewed the proposal and made the following
comments
a. The City Master Drainage Plan recommends replacement of the North
Dakota Street bridge and major channel improvements nearby. The
City has applied for financial assistance to replace the bridge.
Since the elevation of the new bridge will be higher than the
existing bridge, it will riot be. practical to require half--street
improvements along the entire street frontage to Fanno Crook. The
eastern extent of the necessary street improvements should be
determined during review of the street design.
b. Unified Sewerage Agency' s Fanno Creek interceptor sewer traverses
the site from north to south. The interceptor is located within
the 100 year floodplain. The applicant proposes to connect the
project's sanitary sewerage system to the interceptor within Lho
floodplain. The applicant also proposes to perform storm drainage
work in the floodplain. Permits may be necessary for work in the
floodplain from the US Army C;►r•ps of Engineers and the Division of
State Lands .
C. The adjacent parcels west of the proposed development include a
tract (TL 3800) designated "for storm drain purposes" on Lhu plat
map. Drainage from this parcel to Fanno Creek must be
maintained. In addition, other parcels in this area may or may
riot be connected to sanitary sewers. An easement through the
applicant's parcel to the Fanno Creek interceptor may be necessary
to permit future servicing.
The Parks Department reviewed ,the proposal and made the following
comment:
a. The area to be dedicated to the City as open space should be
graded as necessary (as allowable by federal and state permit
requirements) to facilitate mowing and vehicle access.
Washington County Fire District No. 1 made the following comments:
a. Hydrants must be located so that no part of the proposed
structures is greater than 250 feet from a hydrant .
Tigard Water District made the following comii,ants:
a. A fire i,ydrant is necessary at the entrance to the development.
b. Water service lines should be looped and interconnected using
different meters. Meter arrangement and sire recommendicd is a
1 .5 inch meter for building 1; a 2 inch meter for buildings 7 and
3; and a 2 inch meter for, buildings 4 and 5.

The City of Tigard Building Division, General Telephone, PGE, and Lhe
Tigard School District reviewed the proposal and had no objections.
No comment was received from NPO V.
No other comments were received.
D. ANALYSIS AND CONCLUSION
1 . Density Computation,
Section 18.92 of the Community Development Code (CDC) specifies
methods for determining allowable residential density for a
development. The applicable CDC provisions for the subject site
require a determination of net development area by subtracting land
within the 100 year floodplain (5.5 a. ) and land provided for private
streets and right-of-way dedication (0.2 a. ) from the gruss site
acreage (7.7 a. ) and dividing the remainder by the minimum parcel sing
for the zone (3,050 square feet or .07 acre). That calculation
provides an allowable number of dwelling units on the developable
portion of the site of 29 units . In addition, the CDC allows for- a
residential density transfer from the non-.developable acreage within
the floodplain to the developable portion of the site. The number of
units allowed to be transferred 'is limited to 25 percent of the number
of units which could have been built on the fluodplain area if not for
the CDC's restrictions on development (0.25 x (5.5 acre x 12
units/acre) = 16.5 units) . This total is added to the allowable units
on the developable portion of Lhe parcel to provide the opportunity to
build 46 units on the site. The applicant' s proposal to construct 40
units on the site is within the allowable limit.
2. Parking
The required number of parking spaces for this development is
1 .5 spaces per unit including one covered space per unit, Ther site
development provides 28 uncovered parking spaces and 44 covered
spaces . The plan satisfies the parking requirements.
Chapter 18. 106 of the CDC specifies that parking areas containing more
than five required spaces shall provide one handicapped parking space)
for every 50 standard parking spaces . In accordance with applicable
state and federal standards, designated handicapped parking spaces
must be at least 12 feet wide arid 18 feet lung. The applicant must,
provide At least two appropriately sired handicapped parking spaces to
meet these requirements.
In addition, the development plan does not describe plans for parking
lot and pathway lighting as required. These items must be provided
for in a revised development plan.
3 . Access and Egress
Access/egress will occur from SW North Dakota Street via a 30 foot
wide driveway. The visual clearance area for the intersection is
adequate. A ten foot wide right-of-way dedication along with
half-street improvements on SW North Dakota Street: is incurpurated in
the site plan.

4. 1and sca in��nd_Screenirlg
The landscaping plan submitted is adequate to meet the 20 per-cont
landscaping coverage requirement specified in Section 18. 120 of Lho.
CDC. The plan combines a variety of trees and shrubs to screen the
buildings from Hach other and from SW North, Dakota Street. Four- m,A1111,
trees and various shrubs provide a buffer between the western
building arid the adjacent duplexes. Adequate numbers of stroot and
parking lot trees are provided. Several mature trees of varied
species exist in one small area of the developable portion of the
site. The development plan calls for removal of these trees.
5. Wetlands/Floodplains/Public and Private Open Space
The proposed placement of buildings is just outside of the 100 yLar
floodplain of Fanno Creek and away from wetlands and areas of seasonal
high water on the site. Construction activities will need to avoid
these areas. Necessary permits from federal and state agencios will
need to be acquired prior to construction.
Dedication of the majority of the parcel to the City as a g roor►way
along Fanno Creek is proposed. An eight foot wide asphalt
bicycle/pedestrian path would be constructed in the groo nway to
connect with an existing path from the northwest. The present
development plan does not include a path connecting the developmonL's
sidewalks and parking areas with this path. This should be done ,+S
part of site development.
Adequate open space is provided by the greenway, landscaped ,iroe,t;, and
a swimming pool. Private outdoor space is provided for oach unit by a
deck or balcony.
6. Other Approval Standards
The proposal conforms with CDC st,Andards fur, building height ,

setbacks, and relationship with the physical environmont . The
proposed use, multiple family dwellings, is a permitted use in the
R-12 zone.

by the Engineering Section.
4. Seven (7) sets of plan profile public improvement construction plans,
a site grading plan, and one (1) itemized construction cost estimate,
stamped by a registered professional civil engineer-, detailincl all
proposed public improvements shall be submitted to the Frigirloor•ing
Section.
5. Sanitary sewer, and storm sewer- plan profile details shall be provided
as part of the public improvement plan and building improvement plain.
6. Construction of proposed public improvements shall not commorico until
after the Engineering Section has issued approved public improvement
plans. The Section will require posting of a 100 percent performance
bond, the payment of a permit fee, arid a sign installation/streetlight
fee. Also, the execution of a construction compliance agreement shall
occur prior to, or concurrently with, the issuance of approved public
