In particular.-, I have noted that the Washington County Sanitarian has pre Aided you with notice of a public health hazard due to the sewaae and surface waste water on your property located at 8825 O'Mara Street. The proximity of this health hazard to the Tigard Senior Center is of great concern to the City. As you know, the sewage problem must be remedied as soon as possible in order to avoid any added health and safety risks. The only viable solution to this health hazard is to terminate your septic system and to connect your property to the public sewer sys::em. Based upon my review of various materials in the City's file, the cause of the sewage disturbance on your property is unclear. You have suggested that the City might be responsible for damaging your septic field due to the construction of the Senior Center. In that regard, you have suggested that there may be an easement- by-implication running beneath the City's property for your drain field. So called "easements by implication" are generally disapproved by courts, and plaintiffs claiming them have a very difficult burden of proof. In your case, based upon the evidence available to me at this time, it is my opinion that: you do not have a reasotlal,le claim for asserting an easement-by- replication for your drain field. Nonetheless, evpn though the City does not appear to be liable in any way for your sewage difficulties, we do appreciate the personal hardship this case presents to you. Eventually, all propeities within an urban area must connect to the public sewer. Septic systems are not permitted for obvious public health reasons. This case is different, however, because of your proximity to the Tigard Senior Center. The City must consiAer the safety of Senior Center residents and their reliance on the Meals on Wheels program. Therefore, the City i.s willing to extend the following offer to you in an effort to help solve your health hazard problem in the most effective and efficient manner possible. In consideration for your efforts to close your septic system and connect to the public sewei , the City will waive your "in lieu of assessment" charge of $3 , 000. You will be responsible for purchasing a Sewer Connection Permit from the City at d cost: of $1 , 135 and must arrange and pay for the necessary construction. Your Sewer Connection Permit must be purchased on or before December. 15, 1988 , unless otherwise agreed to by the City. I am also requesting that you review the enclosed "Release. " This Release discharges the City from any a►id all claims you ma;. have had against ':.he City with regard to your sewage health hazard at 8825 O'Mara Street. The. We have made every effort to help you resolve the delays and to keep every- thing within the scope of our contract. However, since these delays began we have lost five weeks of time, are now oehind our projected completion schedule and are experiencing increased jobsite costs. We must now document these delays and ask for compensation in both time and expense . On November 10, 1980 and under a separate contract, North- west Undergrouni began construction of the sewer on the west sides of our project. During their work they hauled equipment. and materials over our prepared subgrade for the parking areas on the east and south sides of the building and severely damaged the grade and compaction of these areas . They further disposed of their surplus excavation in the prepared parking area to the north of the building, completely destroying tha subgrade and covering it with over four feet of wet, loosa :,iud. The damage and obstructions left by this contract has and continues to delay all site work, includi ng completion of the storT.1 sewer, placing of exterior concrete, and laying of gravel and asphalt paving. We will look to the City of Tigard to restore all of these areas to final subgrade and compaction, and because of the uncertain time element due to weather, we request that this work be exempted from consideration for final completion and retainage . The installation of the project water service was delayed for three weeks pending the City' s appropriation of the connection fee and was delayed an additional two weeks there after by the Water Ci^tr.ict' s misplacement of the City' 3 check to effect the meter installation. This delay has resulted in additional jobsite overhead costs including temporary facilities and supervision. April 16, 1481, Page Two '.Phe installation of the permanent power to the project has been and continues to be delayed by the presence of sew- age discharge from the neighbors drain field. The power company refuses to install or connect the transformer.- under the present conditions. This changed site condition has de- layed the job four weeks to date, has prolonged our need for temporary site facilities , has increased the cost of temporary heat in the building and has created hardship and inefficiency to all finish trades on the project. Since these delays are still continuing we cannot totally evaluate the resulting time or expense. We will make our claim as soon as the total effect is known.
