and Title Insurance that specifically states the property width is 75'..0. Subsequently, Mr. Benich
raised the same property encroachment issue that you are currently contending. Enclosed please
rind a copy of Washington County Circuit Court Trial Judgment that settled this property-line
dispute between Mr. Benich and Mr. Fuller.

After this judgmer' Mr. Benich built x fence at a location where Mr. Fuller and Mr. Benich
mutally agreed that the property line existed. This fence has remained there undisputed for over
30 years until your letter dated December 2, 1995.

Clear Mr. and Schubert:
This letter is writ'en to clarify your concerns regarding code requirements as it pertains
to fencing and an accessory structure on your property and additionally, the City of
Tigard's stance on a property line dispute with the owner of land adjace,it to yours.
First, your property described as 1S136AA-00802 (map and tax lot number) was'
originally developed in Washington County. When the property was annexed into the
City of Tigard, it was designated as a R-4.5 zone. In the annexation process, the City
of Tigard does not require the property owner to adapt to the requirements of the newly
designated zone, but in the case where a difference it zone requirements occur, the City
of Tigard recognizes them as non-conforming. Adoption of the existing zoning i
requirements would only be necessary in case of replacement. Therefore, the accessory
structure now existing on your property is not required to conform to R-4.5 setback
dimensions. Fences in the City of Tigard are owed to be built ON the property line.
As far as the property line dispute with the owner of 1 S136AA-00900, this is a civil
matter, which should be resolved with the assistance of Washington County recorded
documents and independent surveys. of Tigird does not concern itself with

precedence in establishing the correct �ropertY lines. It appears that concerns you
mentioned regarding an encroachment issue was addressed in a document recorded on
