Lot 111 will be increased in size from 8173 square feet to 8660 square feet and Lot 110 will be decreaved in size from 6174 to 5687 square feet. DECISION: Notice is hereby given that the Planning Director's Designee for the City of Tigard has APPROVED the above application subject to conditions. The findings and conclusions on which the decision is based are notb-1 below. A. FINDING OF FACT 1. Back(•round The subject parcels were created through approval and recording of the plat for Ashford Oaks II (S 88-05, ZC 88-06, PD 88-C2) . No other land use applications for these parcels have been reviewed by the City. 2. Vicinity Information The subject parcels are surrounded by properties developed with single-family residences. Properties to the north are zoned R-4.5 (Residential, 4.5 units/acre) . Properties to the east, west, and south are also within Ashford Oaks subdivision and are zoned P•-7 and R-7(PD) . 3. Site Infotmation and Proposal Description The subject parcels are located at a 90 degree bend :.n SW Fen-on Drive. Lot 111 is developed with a single-family residence. Lot 111 is vacant. The applicant proposes to adjust the common lot line between these two parcels to the ncrthweat as shown on the attached map. The adjustment will. result in a transfer of approximately 487 square feet of land from Lot 110 to Lot 111. The purpose of the lot line adjustment is to eliminate a side yard setback ancroa:;hment that inadvertently occurred during construction of the house on r-ot 111. 4. Agency and NPO Comments The Building Division, Engineering Division, Tigard Water District, GTE, Portland General Electric, and Washington county Fire District No. 1 have reviewed the proposal and have no objections to lt. No other comments have been received. r���� B. ANALYSIS AND CONCLUSION S(w tion 18. !62. 060 (Lot Line Adjustments: Approval Standards) of the Community Development Code contains the standards of approval for a lot line adjustment, they are as follows: 1. An additional lot is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the approved zoning for that district. 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district. The current application meets both of these requirements. No new lot is being created and the lot being reduced in size, Lot 110, will remain greater in size than the 5000 square foot minimum lot size required in the R-7 zone. There are no structures on tW.s lot. The house on Lot 11.1 will be brought into compliance with the 5 foot sideyard setback applicable to these properties through approval and recording of the I proposed adjustment. 1 In addition to meeting the above standards, a lot line adjustment must also meet the minor land partition criteria of Section 18.162.040 (Partition Approval Criteria) . They are as follows: 1. The proposal conforms with the City's comprehensive plan; 2. The proposed partition complies with all. statutory and ordinance requirements and regulations; 3. Adequate public facilities are available to serve the proposal; 4. All proposed lots conform to the size and dimensional requ'.rements of this title; and 5. All proposed improvements meet City and applicable agency standards. The proposed lot line adjustment meets all of these criteria. It conforms with the City's Comprehensive Plan and complies with all Atatutory ordinance requirements and regulations. Adequate public facilities are available to serve both parcels; the lots conform to all applicable dimensional requirements of the Code; and no public improvements are proposed as part of this application. C. DECISION The Planning Director's Designee for the City of Tigard approves M 89-24 subject to the following conditions: UNLESS OTHERWISE NOTED ALL CONDITIONS SHAI., BE MET PRIOR TO RECORDING THE LOT LINE ADJUSTMENT WITH WASHINGTON COUNTY. 1.
