Dear Mr. Bondurant:
Upon review of the plans you submitted to mQ or. .June 24, both Brad Roast, City
Building Official., and myself decided a building permit would not be necessary
for the fence you propose to construct.
Section 18.100.090 of the Community Development Code regulates fences.
Specifically, subsection (b)(3) requires a building permit for a fence located
in a side or rear yard kFich is between six and eight feet in height unless
the approval authority allows such to mitigate adverse effects. Our
4, discussion revealed that owing to the topography in the corner side yard, the
fence will necessarily have to be six feet six inches in height along the (set
back) front yard ar,d rear yard sections. The grade on your property
necessitate3 a stip-al se construction and therefore does not warrant a
building permit. Suosection (b)(5) requires that fences r_onatructed in a
corner gide yard be set back no closer than two feet from the property line.
Should ;our fence be erected according to the submitted plans, then it will
satisfy all City regulations. Please do not hesitate to contact me should you
