Dear Jane:
On behalf of King Cite i investigated the size and location of an accessory structure
located ai the subject address. My findings are as followM:
1. The structure is 0' 0" in height and has an area of 8'.416" X 15'.166" for a total
area of 127.63 square feet.
2. The structure is located 4' 3" back from the fence, which I presume is the
property line. The setback from the main structure is 32"
3. 1 he structure has no mechanical, electrical or plumbing fixtures, the exceptiml
being an extension cord supplying power to a TV inside the unit.
4. The structure is being used as a playhouse for children of the property owner,
While thpre is present wood framed bunk beds, I would not class this as being
habitable space.
Unuo, *ne provisions of the Oregon One and Two family Dwelling Code Section 111.1
exception 1. ;2, which states " A permit is not required fnr noxi-habitable small accessory
structures not over 120 square feet or a height of 10' 0", me 3sured at the highest point.
The structure as designed ilicluding the porch and roof overhang exceeds the allowable
area by 7.63 square feet. 1 instructed the owner that he would have to reduce the area
by the 7.63 square feet.
The owner appeared willing to cooperate, therefore, I would suggest subject to
compiiance with your codes and ordinances, that you by Certified Mail advise the owner
to comply within; 3 reasonable length of time, which is normally 30 days from the date of
rot ':.;ation.
