having major difficulty aligning a 36" exit door to our newly
installed fire escape, as required by code.
A simple substitution of a 32" door appears to be our best
solution. If this meets your approval, we then request a variance
on this alteration.

This is a Fire and Life SAfety Plan Review and is based on the
1988 editions of the Uniform Fire code (UFC,) and those sections
of the Uniform Building Code (UBC) and Uniform Mechanical Code
(UMC) specifically referencing the fire department, and other
local ordinances and regulations„
Plans submitted to City of Tigard on the above captioned
project and forwarded to this office are approved subject to
City of Tigard Building Department requirements and the

plans bearing the stamps of the building department
issuing the construction permit and this office, must

SUBJECT : Janis Youth Program, 11490 SW Greenburg Rd.
DATE: February 27, 1987
The issue surrounding the Janis Youth Program pertains to zoning and land use, yet the
building code has been brought into the issue by the opponents as regulations of land
use. There are several points I would like to clarify with regards to the building
"codes":
1. The rationale in assigning an "SR"occupancy
2. The proximity of the building to the west,side property line
Item 1---A letter(attached) to Mr. John Drennan(an opponent), explains why an "SR"
(Special Residential) occupancy was assigned to this building use.
The statement in the building code"Group SR occupancies do not include
residential care facilities, nursing homes or other state licensed care
facility" is not applicable, as the intent of this sentence is to prohibit
medical care facilities as "SR" occupancies. I have contacted the State
Building Codes Division and several local building depprtments, who have
all concurred on this point. Mr. Drennan's previous statements that
the assigned occupancy is improper are incorrect.
Item 2---It appears the building is only 1-2 feet from the west, side property line,
which would require the west wall to be constructed as a firewall, if no
other option is employed. The building department became aware of this
problem in December, 1986, but has held off taking action until the city !
council has made a decision on the zoning issues. The Janis Youth Program
would have two other options in lieu of a firewall.:
1. Consolidation of lots
2. Adjustment of lot line to provide minimum yard widths--a minimum
3 foot yard width if the building is to remain a single family
dwelling, a minimum 5 foot yard width if the "SR" occupancy is allowed.

In recent conversations with Janis staff, you have requested Emilie frisbee
clarification regarding the specific usage being tnaue of our Post President
facility located at 11490 S.W. Greenburg Road. Below is a olive Barton
sutn»ary of the information necessary to address your inquiries. Norman Bengel
Nuii)er of Youth in Care: We are currently contracted to provide Koren Lytle Blaho
emergency shelter or up to 60 days for a population of seven Merle Bradford
male adolescents aged 12-17. As an emergency placement facility, Thomas Higgins
the actual number of contract beds often varies over time even
within a single fiscal year. This has apparently created some Donn Madden
confusion for city staff who have talked with Janis staff at Dr.Thomas Nahato
various times and been provided a bed capacity which reflected Rev Rodney Page
the contract level at that specific time. For instance, during RobertAidgiey
FY-86 when we were purchasing and moving into the Greenburg
facility, our contract was at different times for five, six, and Patricia Ailey
seven youths. In our initial. contact with the City of Tigard we William Robertson.Jr.
indicated an intention to house more than five youths since we
had been told that this was the break-off point for more
restrictive code requirements. The Greenburg facility was, in
fact, purchased in order to expand existing shelter space AUnited Way
available to Washington Count from five to seven beds. Our of Oregon
long-range projections suggest a potential need of eight to ten Agency
beds at scxne point in the future with possible short-term
utilization over brief periods of a maxurnnn of 14 beds. We
contiinJe to plan on working with you and the City Planning Office
to ensure the facility meets all licensing and code requirenents
for this level of uti-lization.
'Type of -vouths in care: The faci 1 ity is under contract with
State of Oregon (moi 3ren's Services Division to provide shelter
and evaluation for boys who have been removed from their families
and who are awaiting either a return home or an alternative,
long-term, out-of-hone placement. It is the only such facility
in Washington County and we work closely with the local. branch
office of QSD in providing service to Washington County youths.

'I'he primary reason for pl acernent in the Fihe 1 ter is a crisis in the home or
otl►er current l iving situation which precipitates the need for removal of the
child by CSU. The children are un4,?r a high level of stress and may be labeled
nxxierate I emotional I disturbed, 1,-:edeI inquent/del inquent, learning disabled,
status offender, etc. Over half of (nir children come from family settings
where they have been victims of physical or sexual abuse. The labels are often
an inadequate picture of the real child who simply represents a need for the
safety, security, and structure not available in an abusive home environment
but which we can provide in a 24-hour supervised setting. We do not serve
children with a history of arson, who are currently addicted to alcohol or
drugs, or who have a record of serious person--to-person crimes. We also do nut
serve children with severe physical or mental disabilities which incapacitate
thein to the degree they cannot function successfully in an open cominunity
setting.
Type of Supervision: Our facility is an unlocked, voluntary-placement facility
with the security being provided by 24-hour awake staff coverage. While in
residence the boys are involved in a structured behavior-Management progra►n and
participate in both individual and group counseling. Privileges are determined
through use of a status system basea on their behavior with very little
unsupervised time available even for boys detrx)nstrating the highest level of
self-tionagetnent. Staff members are careful I screened and are professional I
educated and/or trained for work with our youths.
Zonis for Residential Facilities: Janis operates seven other residential care
facilities ranging in size fro►n -14 bed capacity. All of these facilities are
zoned bld except for one in east Multnomah Winty which has an SR2 status. It
is clear that the SR3 zone for the Ureenburg facility is correct and is
consistent with the treatment of similar facilities in otlier jurisdictions.

Dear Mr. Drennan:
This letter has been written at your request, to explain the basis for the city building
department classifying a building(located of 11490 SW Greenburg Rd.) an an SR occupancy.
it must first be made clear that the city municipal code and/or zoning regulations are NOT
used to determine the occupancy of a structure with respect to the building code, nor does
the building code dictate the zoning regulations within the city.
It is the responsibility of the building department to provide reasonable safeguards for
fire and life safety for occupants of buildings within the city. It is also the respon-
sibility of the building department to classify the building under an occupancy wi ch it
most nearly resembles based on proposed fire and life hazard(note,this only pertains to
fire and life safety regulations,not zoning).
Based on the information received from representatives of the Janis Youth Program during
an inspection of the site in May of 1986, it was determined that the proposed use most
nearly resembled an SR occupancy, based on the following:
1. The proposed use was that of a youth type shelter, housing on a temporary basis
youths over the age of six who do not have any mental or physical handicaps.
2.. Clast,ifying the use as an I(inatitutional) occupancy did not seem applicable,
as institutional type occupancies house occupants who are mentally or physically
handicapped, physically restrained(i.e. jails,prisons) or those who do not
possess sufficient fa,.ulties or abilities to take positive action in An
emergency situation.
3. The proposed use could have fallen into an 0-1 occupancy, somewhere between an
apartment and hotel, which would have required little or no additional fire or
)if.! safety ptorection. Because of the age of the structure it was determined
that the 3tr•i_,ture warranted additional protection for the occupants and
structure itself.
10h4rcfore, it was determined the proposed use beat fit into an OR occupancy. The issue
in ,uestion appears to be the use of tilt! structure with respect to city municipal zoning
regulations, whic'i is the responsibility of the city planning department to interpret and

It has ^ome to the attention of the Planning Division that Janis Youth
Programs, Znc. is prepar' a residence at the above location for a youth
shelter care facility. Permits have been obtained for sanitary sewer
connections ani plumbing improvements based upon the use of the house as a
single family recidenti.al structure. The Building Inspector was assured that
the house would be iccupied by no more than fivk- unrelated individuals.
As I indicated you during a pre—application meeting on April 21, 1986, the
proposed facility is a "group care residential' use according to the Community
Development Code and that although it is a permitted use in the R-1.2 zone, a
Site Development Review approval had to be obtained. Your organization
submitted an application for this approval on May 9, 1986. The application
narrative stated that six youths would be cared for on a temporary basis and
one or two staff members would be on the premises at all. times. This
application was withdrawn on June 5, 1986.
On August 5, 1986 I discussed the matter with Gary Shurtz of the Youth
Services Division office in Hillsboro. He indicated that the State contract
with Janis Youth Programs, Inc. was for the care of up to eight individuals
and an average occupancy of seven youths on the Greenburg Road property.
These individuals would only reside on a temporary basis, typically not longer
than 60 to 90 days.
The Planning Director has determined that regardless of the number of
Individuals, the "group care residential" definition in the Code applies to
your proposed shelter facility which requires State licensing. Since the
ongoing remodeling will convert a single family residence to a "group care
rgl,lential" facility, a Site Development Review approval is required. Also,
the Uniform Building Code and Washington County Unified Sewerage Agency have
different standards and requirement for this type cf 5uilding occupancy.

Dear Ms. Ramsey:
Since your company has shown interest in converting a residential building
(R-3) to a special resldLatial (SR-3) use, located at 11490 SW Greenburg
Road, you should be aware of some fire and building code requirements.
On April 3, 1984 an inspection was conducted at the site co determine any
code deficiencies for a use similar to yours. (Please refer to the attached
letter from the Tualatin Rural Fire District to Sandvig Lodging Home.)
Since your proposed use is almost identical to the Sandvi- Lodging Home, those
code requirements shall apply.
All of the items shall be completed and inspected by this department prior
to occupying the building.

Dear Mr. Sandvig:
Tris letter is to confine the items discussed during cur conference on
April 3, 1984 regarding the conversion of a single-family dwelling
(R-3) to a lodging home (SR 3) .
Persons in attendance: Marie Morterud, Brad Roast, Mr. Sandvig
and a representative from the Health Department.
Prior to occupancy the following items shall be compl ;ed with:
1) Provide an Electrically supervised fire alarm and detection
system.. Audible alarm devices shall be capable of being heard
throughout the building. UBC 1313
2) All rooms utilized for sleeping purposes and the exit systems
( stairway and rear exit door) shall be provided with electrically
supervised automatic particles-of-combustion detectors conforming
to the requirements of NFPA 72-A, 1979 Edition. UBC 1313
3) All combustion detection and fire alarm systems shall be
electrically interconnected and have an automatic auxiliary power
supply which will maintain operation energy for a period of at
least eight hours. UBC 1313
41 Provide handrails and guardrails in the main stairwell area.
Guardrails and intermediate guardrails are required for the
upstairs outside deck. IJBC 3306(,)), (k)
5) State electrical inspection requirements, shall be completed.
6) All holes in the basement: ceiling penetrating through to the
first floor shall be patched or sealed. (Recommend stuffing with
rockwool ) UBC 2516( f)
7) The existing linen chute poses an extreme fire and life safety
hazard 3s it does not meet code requirements of one-hour fire--
resistive construction. The linen chute shall be provided with
fire-stopping at each floor level and the openings sealed, ( fire-
stops may be of gypsum board) UBC 2516(f) , 1706

RECOMMENDATIONS:
1) Basement area should be kept from being overloaded with
combustible storage.
2) Provide an exit stairway off of the upstairs deck. An exit
stairway is required if ten (10) or more persons occupy the
second floor.

This letter is to confirm the items discussed during aur
conference on 03-10--83 regarding conversion of a
single family dwelling (R-3) to a (SR-2).
Persons in attendance: Brad Roast, Bob Irwin and Gene Birchill.
Prior tv occupancy the following items shall be complied
with:
Install solid core door ( self—closing and latching ) and wire
glass (with steel stops ) in the openings between the living
room and the main stairway/corridor.
Install smoke detectors in the main stairway and all main
sleeping area!:. "These may be single station type. They
should be tested weekly to assure that they function
properly.
Install permanent handrails and guardrails in main stairwell
area.
Complete second exit stairway from second floor.
Do not use wood sto-es It would be preferable that they be
rPmnved.
Have a State Electrical Inspector make an inspection and
make recommendations to bring electrical Equipment up to an
acceptable level of safety. Provide a copy of this inspec—
tor ' s notice to this office.

flouring ).
Within 90—days after occupancy the following items shall be

Install an alarm system that complies with 72--A throughout
the building
Complete all items that the State Electrical Inspector has

Self-Preservation Level
I
As used in DHR Licensing Rules, "Level" means the functional skill level of
the child pertaining to his/her demonstrated ability to respond positively for
self-preservation in emergency situations, as follows:
(a) "Level I-1" means a child who does not depart unassisted from a huildinq
when warned by a signal device because he/she is non-ambulatory or
requires physical a stance from others. This includes children under
the age of 6 years. � �
(b) "Level I-2" means an ambulatory child who does not depart from a buildinq
within a reasonable period of time when warned by a signal device.
(c) "Level I-3" means an ambulatory child who can depart from a building
within a reasonable period of time whenyy�arned by a signal device, but
