CITY OF TIGARD Tigard, OR 97223 OREGON / • EWER CONNECTION PERMIT -- 11320 SW GAARDE ST. • I am responding to your request for information about the sewer connection permit for 11320 SW Gaarde St. In September, 1992, Dennis Wittenberg applied for a permit to TP I move a house and place it on a lot in Tigard. The City requires applicants to obtain a � building permit (to place the house on a foundation) and a sewer connection permit (to connect to the sanitary sewer). a Mr. Wittenberg obtained his permits in November, 1992, and. the 5o.sdadoo was approved in January, 1993. In April, 1994, he contacted me about the sewer permit. He stated that he owned the house next door (11370 SW Gaarde) and that he wanted to connect it to sewer also. He said that he needed to connect the neighboring house first because he had to abandon the septic system as a condition of approval for his minor land I i partition. Since people were already living in the house at 11370 SW Gaarde and the house at 11320 SW Gaarde was still vacant, he asked if he could transfer his sewer permit from 11320-SW Gzarde to 11370 SW Gaarde. He assured me that he would be in later that week to pick up a new sewer permit for 11320 SW Gaarde and have it connected. Based on this information and his assurance, I agreed to transfer the permit which allowed him to immediately connect the neighboring house to sewer. It was connected and inspected on 4/20/94. Mr. Wittenberg never came back to the City to get a new sewer permit for 11320 SW Gaarde. Follow-up phone calls to nim have been futile. At first, he stated he would "be in soon" to pick up the permit; aild most recently, he stated that "the rew homeowner would be in to ;et it". The conditions of placing the house on a city lot still apply -- it must be on a fowidation, connected to sewer, and inspected before it can get a certificate of occupancy. Unfortunately, Mr. Wittenberg has not fulfilled all of these conditions and has subsequently sold the property to you. If I can provide more information to you, please let me know. The properties located to the northeast are zoned R-3.5 (Residential, 3.5 units per acre) . The lots to the west and the one lot immediately to the south of this site are unincorporated and under the iurisdiction of Washington County. This area is substantially developed with single-family residences. The Tigard Assembly of God Church is located across Gaarde Street to the east of the site. The lot located immediately to the east remains vacant. 2 . Site Information and Prop al Description o This approximately 0.50 acre site is presently developed with a single family residence which fronts on SW 114th Avenue. Deciduous and evergreen trees a`. various stages of maturity are also present. The applicant requests minor land partition approval to divide this 0.50 acre parcel into two parcels of approximately 9, 170 and 12, 180 square feet in size. Neighborhood Planning Organization #3 (NPO) has reviewed this proposal and notes that there will be an impact upon the " neighborhood's sewer, sidewalk and upon SW Gaarde Street. { Additionally, it is requested that the driveway be "brought around to 114th. " Tigard School District 23J, Tualatin Valley Fire and Rescue District, Portland General Electric, Metro Area Communications, and General Telephone and Electric have reviewed this proposal and have offered no objection to it. I No other comments have been received. i i SECTION III - FINDINGS AND CONCLUSIONS - Minor Land Partition Section 18. 162 .040 contains the following general approval criteria for a Minor Land Partition: 1. The proposal conforms with the City's Comprehensive Plan; 2 . The proposed partition complies with all statutory and ordinance requirements and regulations; , 3. Adequate public facilities are available to serve the proposal; i STAFF REPORT MLP 92-0008 WITTENBERG OWNER/APPLICANT Page 4 I e MJ 4. All proposed lots conform to the size and dimensional requirements of this title; and 5. All proposed improvements meet City and applicable agency standards (Ord. 89-06; Ord. 83-52) . The subject site conforms with the City's comprehensive plan in that applicant's site plan shows an intent to use both lots as locations for single family residences, and therefore this application is consistent with the Low Density Residesnt-ial comprehensive plan designation. This proposed partition complies with all statutory and ordinance requirements and regulations as demonstrated both by the analysis presented within this administrat ive decision and by this application and review process. Adequate public facilities are available to r serve the proposal . t Section 18.50.050 (R-4 . 5 Zoning District) contains the applicable size and dimensional requirements. This partition would create lots which greatly exceed the 7,500 square foot minimum size requirement for lots in the R-4.5 zone. There is a 50 foot average minimum lot width requirement in this zone. � s Both of the proposed lots surpass this lot width requirement. The setback requirements for structures in the R-4.5 zone are: front yard - 20 feet; side yard - 5 feet; rear yard - 15 feet; side yard facing adjacent street - 15 feet; and 20 feet from the front of the garage -to the property line from which access is obtained. As shown on the proposed preliminary partition plat, the existing and proposed residences comply will all setback requirements except for one. It is shown that the rear yard setback of the existing house is only 10 feet. Therefore, the applicant shall submit a revised preliminary plat which demonstrates that the north-south property line between the parcels has been shifted at least five feet eastward so as to increase the rear yard setback of this house from 10 feet to at least 15 feet. r Section 18 .88. 040IC1 (Solar Access) states that all newly created lots within the City of Tigard shall promote the use of renewable energy sources by providing for improved access to sunlight for residential dwellings. The front property line of the proposed lot is aligned with the existing east-west orientation of SW Gaarde Street and therefore complies with the requirement that the front property line be oriented within 30 degrees of a true east-west axis. The north-south lot k',4 dimension of the proposed lot will be greater than the required 90 foot minimum. Therefore this solar access code base requirement has been satisfied. The existing lot faces SW 114th Avenue which in oriented in a north-south orientation. This existing lot is not required to meet the solar access requirements for lot creation since this lot predated the solar access portion of the Development Code. STAFF REPORT MLP 92-0008 WITTENBERG OWNER/APPLICANT Pagc 5 :R I 4 . 7 i, Section 18. 162,050 states that each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. The preliminary partition plat demonstrates that both lots will exceed this requirement. Sections 18.164.030 (Streets) , 18. 164.094 (Sanitary Sewer) , and 18. 164.100 (Storm Drains) have been addressed and are satisfied as specified below: i 1. STREETS: The site is located at the southeast corner of the intersection of SW Gaarde Street and SW 114th Avenue. Southwest Gaarde Street is under the jurisdiction of Washington County and is classified as a County major collector. Washington County has recommended the following conditions: 1. Property owner shall sign and record a waiver not to remonstrate against the formation of a local ° improvement district (LID) or other mechanism to improve the base facility of SW Gaarde Street to P Y County standards between SW Walnut Street and Pacific Highway. 2. Property owner shall dedicate additional right-of- way to 37 feet from centerline along the frontage of SW Gaarde Street. 3. Property owner shall establish a one-foot non-access reserve strip along the site's frontage of SW Gaarde " Street except at an approved access location. d 4 . Subm,.*. plans, obtain Washington County Engineering i Division approval, and obtain a facility permit for construction of the following improvements: t: A. Southwest 114th Avenue is under the jurisdiction of the City of Tigard and is classif ied as a local street and has the following minimum improvement standards (all distances are measured from centerline) : 25 feet of right-of-way, 17 feet of pavement, curbs and sidewalks. R f 'I Section 18. 164.030(A) ( 1) (c) (v) of the Community Development Code allows the Director to a:cept a future improvement guarantee in lieu of street improvements if the improvement is associated with an approved land partition on property zoned residential and the proposed land partition does not create any new streets. This application meets these criteria. ■ Based upon the above information the applicant should be required to comply with conditions of Washington County as proposed, except for condition 4, and in addition sign a non-remonstrance agreement with the City of Tigard for ■ both SW 114th Avenue and SW Gaarde Street. 2. Sanitary Sewer: �I There is an 8 inch public sanitary sewer line located approximately 200 feet to the east of the propert,, Th;... line runs from the south to the north along 1" 112th Avenue. Once the line is in the vicinity of SW Gaarde Street, it meanders further_ to the east before heading north again (it should also be noted the line increase in size to 10 inches) . The master sanitary srawer plan calls for this area to be served by a 10 inch line running along SW Gaarde Street. This line would connect with the existing line that is approximately 400 feet to the east of this property. An alternative is to extend the line that runs along SW 112th Avenue. This would require the applicant to obtain � an easement from a private land owner so the line could be extended. The Engineering Department would be willing to work with the applicant in obtaining the required easement. If the alternative route is chosen, it would not preclude development to the west. In addition, this would not be in conflict with the master plan and would be an acceptable alternative. Therefore, the applicant should be required to extend the public sanitary sewer line to the west property line of the site. Although there are two alterliatives, as detailed above, it would appear that: the best alternative is to extend the line from SW 112th Avenue. Both residences shall be required to connect to the sanitary v sewer system. The septic system serving the existing house will need to pumped out and properly removed. 3. Storm Sewer: The site slopes towards the southeast. There are no public storm lines located within SW Gaarde Street or 114th Avenue. After a field visit and looking at the STAFF REPORT MLP 92-0008 WITTENBERG OWNER/APPLICANT Page 7 . .. ....... w topography map, it appears there is a natural open "drainage ditch" that cuts across the southeastern corner of the property. The applicant shall be required to direct the storm water to this drainage system. As an alternative, if access cannot be gained, the applicant shall install a drainage system that meets the requirements of the Building Department. y The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 9.1-47) surface water management regulations requiring the construction of on-site water quality facilities or fees in-lieu of their construction. Requiring surface water quality facilities on small sites could result in numerous facilities that may become a maintenance burden to the City. Furthermore, the applicant ras not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for a water quality facility. Regional facilities, funded by fees in-lieu of construction of these facilities, would provide the required treatment with improved reliability and less maintenance. Therefore, the applicant should be required to pay the fee in-lieu of constructing an on-site facility. SECTION IV - DECISION k.
