shall well and faithfully do and perform the things agreed by City of Tigard to be done and performed
according to the terms of the said contract, and shall pay all lawful claims of ,ub-contractors, materialmen,
laborers, persons, firms or other suppliers of implements ormachinery furnished, used or consumed in the carrying
forward, performing or completing of said contract, we agreeing and assenting that this undertaking shall be for the
benefit of any sub-contractor, mrterialmen, 12borer, person, firm, or corporation having a just claim, as well as for
the obligee herein; then this obligation miail be void; otherwise the same shall remain in full force and effect;it being:
expressly understood and agreed that the liability of the surety for any and all claims hereunder shall in no event
exceed the penal amount of this obligation as herein stated.
No suit or action shall he commenced hereunder by any claimant or obligee:
a) Unless claimant, other than one having a direct contract with the Principal, shall have given written notice
to any two of the following: The Principal, the Owner,or the Surety above named, within ninety(90)days
after such claimant did or performed the last of the work or labor,or furnished the last of the materials for
which said claim is made,stating with substantial accuracy the amount claimed and the name of the party
to whom the materials were furnisiied, or for whom the work or labor was done or performed. Such notice
shall he served by mailing the same by registered mail or certified mail, postage prepaid, in an envelope
addressed to the ',.'rincipal, Owner or Surety, at any place where an office is regularly maintained for the
transaction of business, or served in any manner in which legal process may be served in the state in which
the aforesaid project is located, save that such service need not be made by a public offiver.
b) After the expiration of one (I)year following the date on which Principal ceased work on said Contract,
it being understood, however, that if any limitation embodied in this bond is prohibited by any law con-
trolling the construction hereof such limitation shall be deemed to be amended so as to he equal to the

INFORMATION SUMMARY
Dick Kadel is developing pr-cperty on W Greenbury Road, just north of Ash
Creek, into an Auto Service Center. Lick received a conditional approval
through the Site Development Review process . Two conditions of approval were
the dedication of addition right-of-way on SW Greenburg Road and granting of a
permanent Sanitary Sewer easement. Attached are the proper executed documents
for your acceptance.

KNOW ALL MEN BY THESE PRESENTS THAT _RICHARD A. "DEI.
hereinafter called the Grantors, in consideration for the sum of -0-
dollars ($ -0 ) from the City of
Tigard, hereinafter called Grantee, grant. and convey unto the City of Tigard a
perpetual easement for constructing, reconstructing, operating, maintaining,
inspecting and repairing of an underground sewer line and appurtenances,
together with the right to remove, as necessary, vegetation, foliage, trees
and other obstructions on the following described parcel of land, situated in
the City of Tigard, Washington County, State of Oregon:
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,
title or interest except those expressly stated in this easement, nor
otherwise prevent Grantors from the full use and dominiou thereover; provided,
however, that such use shall not Interfere with the uses and purposes of the
intent of the easement.
IN CONSIDERATION of the premises, Granter: agrees that if said Grantee, its
successors or assigns should cause said easement to be vacated, the rights of
the Grantee in the above-described easement will be forfeited and shall
immediately revert to the Grantors, their successors and assigns in the case
of such event.
TO HAVE. AND TO HOLD the above-described and granted premises unto said
Grantee, its successors and assigns forever.

that it does rot authorize any injury to property or invasion of rights or any infringement of Federal. State, or local laws or
regulations
j. That this permit does not obviate the requirement to obtain state or local assent required by law for the activity authoriz-

k. That this permit may be either modified, suspended or revoked in whole or in part pursuant to the policies and pro-
cedures of 33 CFR 325.7.
I. That in issuing this permit,the Government has relied on the information and data which the permittee has provided in
connection with his permit application. If, subsequent to the issuance of this permit, such information And data prove to be
materially false, materially incomplete or inaccurate,thin permit may be modified, suspended or revoked, in whole or in part,
and/or the Government may,in addition,institute appropriate legal proceedings.
m. That any modification,suspension,or revocation of this permit shall not be the basis for any claim for damages against
the United States.
n. That the permittee shall notify the District Engineer at what time the Activity authorized herein wili be commenced,As
far in advance of the time of commencement as the District Engineer may specify,and of any suspension of work,if for a period
of more than one week,resumption of work and its completion.

t. That this permit may not be transferred to a third party without prior written notice to the District Engineer,either by
the transferee's written agreement to Lomply with all terms and conditioris of this permit or by the transferree subscribing to
this permit in the space provided below and thereby agreeing to comply with all terms and conditions of this permit. In addi•
tion,if the permittee transfers the interests authorized herein by conveyance of realty,the deed shall reference this permit and
the terms and conditions specified herein and this permit shall be recorded along with the deed with the Register of Deeds or
other appropriate official.
u. That if the permittee during prosecution of the work authorized herein, encounters a previously unidentified ar-
cbeological or other cultural resource within the area subject to Deportment of the Army jurisdiction that might be eligible for
listing in the National Register of Historic Places,he shall immediately notify the district engineer.

a. All construction debris shall be disposed of on land in such a manner
that it cannot enter the waterway,
b. Care shall be taken to prevent any petroleum produ-ts, chemicals, or
other deleterious materials from entering the water.
c. All areas along the bank, disturbed or newly created by the construction
activity, shall be seeded, sodded, revegetated, or given some other equivalent
type of protection against subsequent erosion.
d. Mork in the waterway shall be done Sao as to minimize turbidity increases
In the water that tend to degrade water quality and damage aquatic life.
e. Shrubs and trees of benefit to wildlife shall be planted along the creek.
f. When the District Engineer has been notified by a fishery agency that a
filling activity is adversely affecting fish or wildlife resources or the
harvest thereof, and when the District Engineer subsequently directs remedial
measures, the permittee will comply with such directions as may be received
to suspend or modify the activity, to the extent required to mitigate or
eliminate the adverse effect.

STRUCTURES IN OR AFFECTING NAVIGABLE WATERS OF THE UNITED STATES:
a. That this permit does not authorize the interference with any existing or proposed Federal project and that the permittee
shell not be entitled to compensation for damage or injury to the st,-ucturee or work authorized herein which may be caused by
or result from existing o-future operations undertaken by the United States in the public interest.
b. That no attempt shall be made by the permittee W prevent the full and free use by the public of all navigable water$at or
adjacent to the activity authorized by this permit.
c. That if the disrlay of lights and signals on any structure or work authorized herein is not otherwise provided for by law,
ouch lights and signals as may he prescribed by the United States Coast Guard shall be installed and maintained by and at the
expenee of the permittee.
d. That the permittee,upon receipt of a notice of revocation of this permit or upon its expiration before completion of the
authorized structure or work,shall,without expense to the United States and in such time and manner as the Secretary of the
Army or his authorized represdntative may direct,restore the waterway to its former conditions, If the permittoe fails to Com-
ply with the direction of the Secretary of the Army or his authorized representative,the Secretary or his designee may restore
the waterway W its former condition,by contract or otherwise,and recover the cost thereof from the permittee.
e. Structures for Small Boats:That permittee hereby recognizes the possibility that the structure permitted herein may be
subject to damage by wave wash from passing vessels,The issuance of this permit does not relieve the permittee from taking all
proper steps to insure the integrity of the structure permitted heroin and the safety of boats moored thereto from damage by
wave wash and the permittee shall not hold the United States liable for any such damage.
MAINTENANCE DREDGING:
a. That when the work authorized herein includes periodic maintenance dredging,it may be performed under this permit
for _ years from the date of issuance of this permit(ten years unless othsrwist indicated):
b That the permittee will advise the District Engineer in writing at least two weeks before he intends to undertake any
maintenance dredging

The above-entitled matters came before the Hearings
Officer at the regularly scheduled meeting of December 19 , 1985 ,
at the Durham Waste Treatment Plant, in Tigard, Oregon; and
The applicant requests a conditional use permit , a
sensitive lands permit and a variance to allow an automotive
body repair building to be constructed which will be partially
within the 100 year flood plain of Ash Creek, and a variance to
reduce the front yard setback requirement from 35 feet to 27 feet
for two corners of the new building to encroach upon the 35 foot
front yard area , property located at 10915 SW Greenburg Road,
property more :specifically described as Tax Lot 1000 , Map 1S1-35BC ,
City of Tigard, County of Washington , State Of Oregon ; and
The Hearings Officer conducted a public hearing on
December 19 , 1985, at wh-ch time testimony, evidence and the
Planning Department Staff Report were received; and
The Hearings Officer adopts the findings of fact and
conclusions contained in the Staff Report, a copy of which is
attached hereto, marked "Exhibit A" and incorporated by reference
herein;

NOW THEPL'FORE IT IS HEREBY ORDERED that CU 6-85 ,
SL 10-85, and V12-85 be and hereby are ,approved subject to the
following conditions :
/
1. Unless otherwise noted, allconditions shall be
met prior to issuance of grading or building permits.
2. Standard half-street improvements including
sidewalks, curbs, streetlights, driveway aprons , storm drainage,
and utilities shall be installed along the S .W. Greenburg Road
frontage. Said improvements along S .W. Greenburg Road shall be
built to major collector street standards and conform to the
alignment of existing improvements.
3. Seven (7) sets of plan-profile public improvement
construction plans and one (1) itemized construction cost
estimate, stamped by a Registered Professional. Civil Engineer ,
detailing all proposed public improvements including utility
relocations and traffic lane remar.}sings shall be submitted to
the Engineering Section for approval .
4. Existing sanitary sewer plan-profile details and
easement boundary shall be provided as part of the public
improvement and building plans.
5. Construction of proposed public improvements shall.
not commence until after the Engineering Division has issued
approved public improvement plans. The Division will require
posting of a 100% Performance Bond, the payment of a permit fee
and a sign installation/streetlight fee. Also, the execution of

a street opening permit or construction compliance agreement
shall occur prior to, or concurrently with the issuance of
approved public improvements plans. See the enclosed handout
yivinq more specific information regarding /fee schedules , bonding ,
and agreements.
6. Additional right-of-way shall be dedicated to the
public 'long the S.W. Greenburg Road frontage to increase the
right-of-Hay to 35 feet from centerline. The description for said
dedication shall be tied to the existing right-of-way centerline
as established by Washington County Surveyor. The dedication
document shall be on City forms and approved by the Enuineering
Section. Dedication forms and instruction are enclosed.
7. After the construction and fill , the area below
the 160. 5 foot elevation---shall-be- dedicated to the City of
Greenway. A montunented boundary survey showing all new title
lines prepared by a registered Professional Land Surveyor shall
be submitted.
B. An as built drawing of all grading shall be
submitted upon completion of work within the flood plain.
9. The necessary permits shall be obtained from the
US Army Corps nf Engineers and Division of State Lands.
10. No grading or fill work shall occur within the
100 year flood plain between October 1st and April 30th unless
approved by the City Engineer.

1.1. A revised landscaping plan shall be submitted for
Planning Director approved prior to the issuance of building
permits which is consistent with Chapter 18. 100 of the Community
Development Code.

At your request, a soils investigation was conducted for a proposed
concrete tilt-up building located at 10915 S. W. Greenburg Road in Tigard,
Oregon. The inVeStigation was conducted at approximately 8:00 a.m. on
Deceltber 20, 1985.
Using a backhoe, three test pits were dug at the locations indicated on
the attached sketch.
The test pits out of the creek flood plain indicated approximately eiqht
feet of old, loose, unconsolidated fill on 2+ feet of black organic soils.
The test pit in the creek flood plain indicated 2+ feet of top soils and
organic materials.
It is reccmre-mled that all structural loads be placed on clean stable
soils below the black organic soils or on 3/4"-1 1/2" crushed rack canpacted
to 95% maximum density starting below the organic layer. . Floor slabs may be
placed on the existing fill utilizing a 6" layer of crushed rock under the
Mab.
Water table was noted at 7 feet below the surface of the existing fill.
Footings placed according to the abcre may be designed with a soil
bearing pressure of 2000 pounds per square foot.
It is reccmnended that a soils engineer inspect subgrade conditions prior
to concrete or rock placcurnt to verify conditions and confirm the suitability
of the actual conditions to support the loads indicated.
Engineering or consolidation testing were neither reques-ed nor
performed.

A 7,980 square foot commercial building presently occupies the north
c(�ntral sec=tion of the property . Access is provided via one driveway on
hreeribury Road . The 100 year flood plain f'or Ash Creek, which
identified at 160.5 feet in elevation covers the southern portion of the
parcel. .
Tho applicant intends to construct a 17,525 square foot: auto body shop
on the southern half of the property and enlarge the existing parking
arid loading area. The rear, segment of the new building will be within
the 100 year flood plain.
Finally, a varianc=e is requested to allow two corners of the new
building to encroach upon the 35 foot front yard area. The front yard
set=back will be reduced to 27 feet from the building corner to the
G reenburq Road right—of wFy .
5. Aqency and NPO Comments
The Engineering Division has the following comments .
a. The proposed work with the Ash Creek flood plain could affect the
Greenbu nj Road bridge, which is the responsibility of Washington
County . The proposed work on Ash Creek should be reviewed and
approved by the Counts
h A sanitary sewer linty is Tucated near Ash Creek and verification
should be provided to ensure that the proposed work will not
adversely affect the line.
C , In order to property modify the area adjacent to the creek
channel, permission may he necessary from the property owner to
the south.
d. A hydrologic study (before development 6 after development) by a
registered civil engineer, including X—Sections and an analysis of
the backwater curve at low and high flows, shall b� submitted to
the City' s Engineer for review and approval prior to issuance of
any permits .
e. A geo-technical report by a soils engineer, relative to t:h,�
proposed channel, and building encroachment into the drainageway,
shall be submitted to the City Engineer and Building official for
review and approval prior to issuance of any permits.
f . Approval by the Division of State Lands and Corps. of Engineers
may be required.
g. Greenbury Road is a major collector street which requires a
right of--way width of 35 feet 'From centerline. Also, since the
street is not improved to City standards, half street improvements
will be necessary along the property frontage.
