September 6, 1968 , our clients have received no confirmation
that the subject infractions have been iully resolved. I
would acknowledge that our clients have noticed some efforts
to connect to the storm drain, but our clients and this
office ha,,►e not received confirmation of full con1liance
with the City's prior notice of infraction. Would you
please let me know whether a uniform Summons and Complaint
will or has been issued.

Dear Mr. Savaria:
This correspondence is to advise yc,u that this office
has been retained by Mr. and Mrs. Prince and Mr. and Mrs.
Schmitz to pursue claims arising by reason of the above-
referenced construction projects.
I am in receipt of numerous photographs which establish
that your conduct has damaged our clisnts ' property.
Further, your February 15, 1988, concedes that your conduct
has damaged our clients' property.
Further, it is our clients' understanding that there
would be no occupancy permit issued for either of the above-
referenced residence until the drainage issue was addressed
by hooking up tQthg o�m-�ewg�system,_
Accordingly, a copy of this correspondence is being
provided to Brad Roast, the Building Official for the City
of Tigard.. We are in receipt of a copy of Mr. Roast's June
17 , 1988 letter to you. It is our position that the
"resolution" set forth therein is insufficient.
Again, it is our position that there was an agreement
that you would hook-up the existing properties to the storm-
sewer system and that there would be no occupancy permit
issued until the hook-up had occurred.
Accordingly, I have calendared this file for. July 20,
1988 to determine the status thereof.

Dear Sir,
You are currently constructing 12 Homes ' , located in the
area of 10950 S.W. Fairhaven Way, in Tigard, which is
where I own my home.
This past week, I woke up to find my property, - flooded.
After investigating this unusual condition, I observed
the water coming from your property, via, the rain drain
system, and what appears to be a small creek. Under closer
observation, it seems to have been intentionally diverted to
my property, and also damages have occurred at my neighbors
home - Bob and Joyce Prince.
The damages that I have obtained by this diversion, has not
only limited use of my property, but is also causing damages
to my landscaping.
I trust that you will take the necessary immediate actions, to
correct not only this extreme inconvenience, but also any damages j
obtained to my property.
I look forward to hearing from you on or before December 16, ;
1987, so as riot to incur any further damages.
