DECISION: Notice is hereby given that the Community Development Director's desiynee has APPROVED the above--described application subject to certain conditions. The findings and conclusions on which the decision is based are as noted below. A. FINDING OF FACT 1 . Background The subject parcel was created throu3h a minor land partii.ion reviewed and approved by the Planning Divi�.ion .in July 1989, (MLP 88-05) . No previous land use applications regard inq this parcel have been reviewed by the Plar,ring Divi-lon. The subject parcel is adjacent to phases 1 and II of the Park 217 development which is also owned by the applicants . Development of Park 217 was approved by the Planning Commission in 1978 as a planned development. The Planning Commission approved a list of permitted uses for the development that varies from the uses allowed in the C--G zone. The allowed uses in Park 217 include warehousing and wholesale distribution--uses that are not otherwise permitted in the C- G zone. The parcel currently proposed for developmerit is not subject to the expanded permitted use list for, Park 217. 2. Vicinity Information Properties surrounding the subject parcel are also zoned C—G (General Commercial) . Smith Home Furnishings is located past of the site, across SW Garden Place. Sears repair service shop is located north and uphill of the site. Russ Chevrolet's dealership is located uphill and to the west: of the site. The dealership's storage yard is south and further downhill from the site. Further south and east is the remainder- of Park 217. 3 . Site Information and Proposal Description The 0.7 acre site is vacant, flat, and grass covered. Seven Norway Maple street trees are located along the site' s frontage on SW Garden Place. Adjacent properties slope steeply upward on the north and west sides of the site and slope downward to the south of the site. . NOTICE OF DECISION — SUR 89--02 (SPIEKER -- HOSFORD NO. 89) — PAGE 1 The applicants propose constructing a 9,057 square foot single story, flex-space commercial building on the site. Twenty--seven parking speces including one designated handicapped space would be provided in lots on the north and south sides of the building. Loading doors would be located on both the north and south sides of the building. A two-space bicycle ribbon rack would be located adjacent to the southern parking lot. The proposed building would be connected to existing sewer and water lines within SW Garden Place. Storm water would be collected by storm drains within the parking lot draining to an existing storm sewer in SW Garden Place. Two existing Norway maple street trees will be removed to allow for development of the accesses to the parking areas. These trees will be replanted along the northern edge of the site. Chore pintas will be planted along the south and northwestern boundaries of the site. A variety of shrubs, ground !:overs, and lawn will complete the site landscaping. Approximately 35 percent of the site will be landscaped. 4. Agency and NPO Comments The Engineering Division has reviewed the proposal and has offered the following comments: 1 . The applicant has submitted a site grading and utility plan showing a preliminary design of proposed on...-site improvements . L. The site accesses to SW Garden Place. SW Garden Place was constructed to local street standards (50 foot right-of..wa,y with curbs and a 34 foot paved width) although local streets in commercial areas typically require a 60 foot right--of-way and a 44 foot paved width, 3. In the Notice :if Decision for the partition that created the subject lot (MLP 88-05), the Engineering Division recommended that a sidewalk be required as a condition of any future development of the site. A sidewalk, therefore, will be required to be constructed as a condition of approval of the current proposal . 4. Two 25 foot wide driveways are proposed to provide access to SW Garden Place from two proposed parking lots. The Community Development Code requires that access driveways be a minimum of 24 feet in width. 5. Storm drainage and sanitary sewer, service is from existing lines in SW Garden Place. Capacities of both are adoquate for handling additional flows resulting from the proposed development. The Tigard Water- District review:ad the proposal and commented that ars 8•-inch water, main will need to be extended along the site' s frontage. A fire hydrant may also be necessary depending upon how the buil(4 ' ,,1 is to be constructed. NOTICE OF DECISION -- SDR 89-02 (SPIEKFR - NOSFORD NO. 80) - PAGE 2 The Building Division, NPO #5, Washington County Fire District #1, PGE, and Northwest Natural Gas have reviewed the proposal and have offered no comments or objections. No other comments were received. B. ANALYSIS AND CONCLUSION The proposal for the commercial flex space building conforms with C--G zoning district requirement setbacks, building height (45 feet maximum height), landscaped area (minimum of 15 percent of site required, 35 percent proposed), and site coverage (maximum coverage of 85 percent allowed, 65 percent proposed) . No particular use is proposed for the building, but there are many uses permitted in the C..--G zone that are likely uses of the building. The site plan also complies with applicable Community Development Code standards for access, vision clearance at; access drive intersections with SW Garden Place, bicycle parking, designated handicapped parking, and landscaping arid street trees. The 27 parking spaces provided should be sufficient to satisfy park irig requirements for potential uses of the building. 'The City of Tigard will assure that any user of the building will comply with use and parking standards through the review and issuance of business tax certificates and building permits for tenant modift,:ations. It is again noted that, use of the building will be limited to uses permitted in the C—G zone and not the expanded use list permitted in the Park 217 development.
