The conditions of the above obligation are such that,
IJHFREAS, the above bounden principal has made application to the City of TIgard, Oregon,
for a street modification permit for work which will necessitate the cutting into or
under a sidewalk, street, curb, pavement, thoroughfare, or other public place in the
City of Tigard, for the purpose of making a utility connection; and,
WHEREAS, the said bounden principal is desirous that this bond continue to cover all
liability herein provided for as to any and all such permits issued during the period
of one year from the date of this bond, whathere under the application heretofore made
or under any subsequent application;
NOW THEREFORE, if the said principal shall make any and all repairs to any sidewalk,
street, curb, pavement, thoroughfare or other public palce which has been cut into or
under by them for the purpose of making a utility connection, within the time
specified by the City Maintenance Foreman, and will maintain the same for the period of
two years from the date of original restoration, in accordance with the City of Tigard,
and shall pay all laborers, mechanics and subcontractors and material men , and all
persons who shall supply sai : principal or any subcontractor with provisions and
supplies for the earring on of such restoration, all just debts, dues and demands
incurred in th- performance of such work, and shall comply with all the requirements
of the laws of the State of Oregon, and the ordinances of the City of Tigard, and the
amendments thereto, with reference to work upon public improvements, then, and in all

NORTHWEST, A WASHINGTON CORPORATION, ITS SUCCESSORS AND ASSIGNS THE RIGHT T(J
PLACE, ERECT AND MAINTAIN POLES, WIRES AND OTHER APPLIANCES AND CONDUC-
TORS AND TO LAY UNDERGROUND WIRES FOR THE TRANSMISSION OF ELECTRICITY FOR
COMMUNICATION PURPOSES IN, UPON, UNDER AND OVER THE STREETS, ALLEYS,

The ten year franchise for the communication facilities and services
provided by the General Telephone Company of the Northwest, described in Chc
title of this ordinance is now before the City Council for renewal . The
Council believes that the franchise should be renewed under the terms anti
conditions set forth in Exhibit A, attached hereto, and by this reference
made a part hereof.
NOW, THEREFORE, THE CITY OF TIGARD CITY COUNCIL ORDAINS AS FOLLOWS:
Section 1. The terms and conditions of the attached franchise agreement,
Exhibit A, are hereby approved and adopted as part of this
ordinance as if specifically set forth.
Section 2. The Mayor is authorized and directed to sign the attached
agreement on behalf of the Council.
Section 3. Because of the need to have stable telephone communication and
the need to have a stable revenue flow to the City from
j franchise fees, an emergency is declared and this ordinance

Traffic Analysis
I . INTRODUCTION
Information for the following report was obtained from Larry
Gottschalk, architecture/planning; Oregon State Highway Division
staff and field review done July 9 thru 12, 1985.
Ia. OBJECTIVE OF TRAFFIC ANALYSIS: The objective of this
investigation is to examine the impact of a proposed 25,000 sq.ft.
retail furniture activity.
Ib. LOCATION: This development is located along Pacific
Highway within the City of Tigard, near the intersection of Gaarde
Street and Pacific Highway.
Ic. SETTING: This project will be developed on the northwest
corner of the intersection of Gaarde Street and Pacific Highway.
Currently there is a one way frontage road (west bound) between the
the site and Pacific Highway.
Pacific Highway is a 5 lane State facility, with a daily
traffic volume of over 25,000 vehicles.
Gaarde Street is a 2 lane facility with limited improvements.
The local traffic circulation of this area is influenced by
the frontage road that runs between Gaarde Street and Bull Mt.
Road. Several businesses use the frontage road, including the
Canterbury Square. This frontage is restricted to entry only on
the east end forcing existing traffic out to [lull Mt. Road. The
intersection of the frontage road at Bull Mt. Road is relatively
close to the Pacific Highway intersection. Currently there are
vehicle queuing problems between these two Bull Mt. Road
intersections.
A circulation modification is currently being considered by
the State and City of Tigard. This plan is to extend Canterbury
Lane across Pacific Highway creating a new access for the
businesses on the north side of Pacific Highway. This would
reduce the need for the frontage road, and it could be eliminated
on the east end.
Id. PROPOSED DEVELOPMENT: This site is proposed to contain a
35,000 sf. retail furniture store. It is anticipated that it will
generate 245 trips per day.
Site access is being proposed at two locations, a Gaarde
Street access across from the existing Elmer' s Restaurant access,
and the second access point into the Canterbury Square parking
lot.
II. FINDINGS:
IIa. SITE GENERATED TRAFFIC: Table A is a summary of the
projected traffic generation from this site. Appendix B contains
the detailed calculation sheets.

IIb. TRAFFIC DISTRIBUTION: Traffic distribution is based on
vehicle trio tables from Metro(see appendix C) .
IIc. TRAFFIC PROJECTION: The projected traffic (Design
Traffic Flow) used in this study includes the existing, site
generated and 2.5% growth on Pacific Highway.
IId. ACCESS ANALYSIS: The proposed access on SW Gaarde
Street will have adequate capacity for this proposed land use.
The proposed location is the best access opportunity along
Gaarde Sheet. A location further to the north would create a
left turn conf'iict with traffic to Elmer' s Restaurant.
IIf. AREA WIDE IMPACT ANALYSIS: The area wide analysis
included Bull Mt. at Frontage Road; Bull Mt. Road at Pacific
Highway; SW 112th Ave. at Frontage Road; Canterbury at Pacific
Highway; Gaarde Street at Pacific Hwy; and McDonald St at Pacific
Highway.
Table B is a summary of the finding of the capacity analysis.

1. Adjusted traffic as a result of a full intersection at
Canterbury and Pacific Highway.
2 Assumed that a traffic signal was installed.
The only intersection that falls below a Level of Service "D"
is Gaarde Street at Pacific Highway. A review of the accidents
history at this location indicates a high number of turning and
angle type accidents, seven of which occurred in 1984. This is a
significant level of traffic accidents* and would warrant a
traffic signal .
IIg. CIRCULATION CHANGES: Presently there is no easterly
outlet for traffic leaving Canterbury Square with the exception
of going thru the Bull Mt. Road/Pacific Highway Intersection.
This will change with the opening of a the Furniture Store' s
parking lot. Estimates of additional traffic on to Gaarde Street
could be has high a 40 vehicle/hour during the peak PM period.
This would aggravate the already stressed Gaarde Street/Pacific
Highway Intersection.
I1I. CONCLUSIONS
This development in itself does not have a significant impact
on the surrounding transportation system. In fact, few land uses
would have less impact than the one being proposed.
There are problematic intersections within the general area of
the site. These include the Gaarde Street intersection and the
Bull Mt. Road /Frontage Road intersection.
The future circulation should be reviewed in more detail to
determine the role of both Canterbury Lane and Gaarde Street.
Signalization of one of these streets should be based on this
information, existing conditions, and the improvement on traffic
safety obtained.

Dear Mr. Hagman:
On August 23, 1985, we excavated the entrance to the existing
culvert on the westerly property line of the future Self Service
Furniture site at Gaarde Street and Highway 99W. We found a 24"
asphalt coated corrugated metal pipe with the entrance plugged
with debris. The invert is 263.84 ft. , City of Tigard bench
mark "Ph-3. " Based on inlet control the 24" CMP has a capacity
of 30 cfs. With construction of the catch basin as illustrated
on the plans for development of the site, the culvert will have
a capacity of 33 cfs before overtopping the downstream bank.
We estimate a tributary area of 40„22 cfs. Using the SCS method
of estimating runoff with a saturated soils condition and urban
development of the tributary area, we estimate the peak flaw to
be 25 cfs for a 25 year storm. Using the rational method with a
runoff coefficient of 0.45 for the tributary area, we estimate a
peak flow of 32..57 cfs.
Therefore, we hereby certify that the existing downstream storm
sewer system has and will have adequate capacity f,-,r a 25 year
storm, provided the downstream system is kept clean and in good
condition.

No previous land use proposals related to this property have been
reviewed by the City .
2, Vicinity Enformation
The properties north of Gaarde Street and to the south along
Pacific Highway are developced and zoned C--G. The parcel to the
west is zoned R-12 (PD) (Residential , 1.2 units/acre, planned
development) and developed with apartments. A one-way frontage
road which directs traffic south from Gaarde StrPet: to Canterbury
Square abuts the property on the east.
3. Site Information and Proposal Description
The nroper�ty is undeveloped. rhe applicant is proposing to
const, uct a 35,600 square foot furniture store with a parking area
situated between the building and Pacific Highway . A two--way
driveway access is proposed on Gaarde Street directly across from
a driveway on the north side. The parking area is to be connected
with the Canterbury Square parking lot.
4 • Agency and NPO Comments
The Engineering Division has the fallowing comments ;
a. The proposed stormwater system willdrain onto private
property and therefore the ability of the downstream system
to accept addition runoff should be confirmed.
b. The State Highway Division should have an opportunity to
comment upon the design of street; improvements along the
property frontage.
C. Half—street improvement's and additional right-of.-way
dedication to major collector standards should be provided
alnng the Gaarde Street frontage.

The Building I:nspe( ti.on Division has no objection to the proposal. .
The Tualatin Rural Fire Protection District indicates that the
fire hydrants should be l.r,c:ated within 250 feet of all portions of
the building. No building shall be constructed which needs a fire
flow of more than 3,000 GPM unless automatic sprinklers or fire
walls are installed.
The State Highway Division has no objection to the request but it.
is noted that some through traffic will occur between Canterbury
Sqaure acid Gaa.rde Street via this project,
B. ANALYSIS AND CONCLUSION
The proposed site plan for the furniture store is consistent with
Community Development Code requirements For lot coverage, building
setbacks, and access. Several. minor amcndment.3 must. be made in order to
achieve total compliance with City standards .
1. Park i.rig
The plan meats the parki.nq requirement of 35 spaces. The two
handicapped parking spaces are 9 by 18 feet. These spaces should
be widened to 1.2 feet.
Secure bicycle parking spaces are needed at a ratio of one for
every 15 required vehicle parking spaces. Two bicycle rack spaces
should be provided for this building.
2. Vision Clearance
The Code requires that a 30 foot triangular area on both sides of
a driveway entrance must be kept clear of visual obstructions.
The vine maples near the Gaarde Street entrance should be moved or
eliminated.
3 . Landscaping
When commercial development abuts a residential use, a sight
obscuring fence or evergreen hedge is required. The landscaping
plan should be amended to provide an appropriate buffer.
4. Light:i.ng
Outdoor security lighting is proposed along the west side of the
building. Care should be takon so the lighting is directed away
from the apartments .

The Planning Director approves SDR 10 -85 subject to the following

plans (Plans shall illistrate full road/right--of-way on Gaarde
from Pacific Highway to a point 1.00 ft. westerly of applicant' s
property and also, trip frontage road from Gaarde to the
applicant' s south property line) and one (l.) itemized construction
cost estimate, stamPec1 by a Registered Professional civil
Engineer, detailing all. proposed public improvements shall, bo
submitted to the Engineering Section for approval.
A . Storm sewer plan- profile details (incl. from the site, westerly
and nor•thprly to Gaarde Street) shall be provided as part of the
public: improvement plans; easements to be recorded if such Rr•p
necessary .
5. Construction of proposed public improvements shall. not commence
until after, the Engineering Section has issued approved public
improvement plans . The Section wi.l.l. require posting of a 100%
Performance Bond, the payment of a pnr•mit fee and a streetlight
fee. Also, the execution of a street opening permit. (or
construction compliance agreement) shall occur prior to, or
concurrently with the issuance of approved public improvement

REGARDING FEE SCHEDULES1 BONDING AND AGREEMENTS
6. Additional right-of-way shall be dedicated to the Public along the
SW Gaarde Street frontage to increase the right--oF-way to 30 feet
from centerline. The description for said dedication shall be
tied to the existing right--of-way centerline as established by
Washingk.on County . The dedication document shall be on City farms
and approved by the Engineering Lection, DEDICATION FORMS AND
INSTRUCTIONS ARE ENCLOSED.
7. Joint use and maintenance agreements shall be. executed and
recorded on City standard forms for all common driveways. Said
agreements shall be. referenced on and become part of a1.1.
applicable parcel Deeds . Said agreement shall be approved by the

8. A revised site plan shall be submitted for Planning Director
approval which includes the following:
a. Handicapped parking spaces that are 12 by 18 feet.
b. Two bicycle rack spaces. The location and design of the
bicycle parking shall. also be approved by the Director.
9. A revised landscaping plan shall be submitted for Planning
Director approval which includes t:hn fallowing:

Last week I talked to your arch tect about an informal, informational meeting
the City of Tigard is setting up with the State Highway Department and others
concerning traffic improvements proposed for the Highway 99 and Centerbury
block. He indicated that you or a representative would be interested in
attending.
This is to advise you that the meeting has been set for 9 AM, Friday,
September 6th at Tigard City Hall, 12755 SW Ash.
Others attending will be three representatives of the State Highway Division;
Mr. Kolve, owner of the Canterbury Shopping Center; R.A. Wright, Acting City
Engineer; John Cook, Mayor of Tigard, and myself.
I understand that you are in possession of an air photo of the arest under
discussion. It would be appreciated if you or your representative could bring
a copy of the photo to the meeting. Mr Failmezger of the Highway DI-ision
