Dear Mr. Swish:
This letter is in response to your inquiry regarding Late 51 and 58 in Genesis
No. 3 Subdivision. I understand that the western 20 feet of Lot 58 has been
purchased and added to Lot 5/. The 5 toot wide public utility easements
remain on each side of the original boundary between the two lots. A house is
now being co,istructed on Lot °,7 which encroaches upon the er.sement by one foot.
The City has no direct interest in the utility easements. The easement may be
vacated or a written waiver must be obtained from all utility companies that
have a right to urge the easenent. If the an easement vacation is desired, the
City Engineering Uivicicii shcu.ld be contacted to initiate the process.
The land transaction you described is a lot line adjustment which has required
the City review since November, the two resulting parcels are technically
illegal because the lot line adjustment did not receive City approval. In
order to legalize the adjustment, the information shown on the enclosed
portion of the community Development Cede, must be submitted to the Planning
Director for approval and then recorded with Washington County.

APPLICATION- Request by Eugepa Rimkeit for Partitioning approval, to divide a
1.53 acre parcel into three parcels of approximately 0.5 acre each on property
zoned R-4.5 (Revidentiale 4.5 units/acre) located at 13615 S.V. 121st Avenue,
Tigard (Wash. Co. Tax Kap 281 3CR, Tax Lot 4900) .
DECISION: Notice is he 7eby given that the Planning Director for the City of
Tigard has APPROVED tie above described application subject to certain
conditions. The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FACT
1. Background
The property was recently annexed (Zk;A 11-84) to the City and
rezoned from Washington County RUA to R-4.5 (Residential. 4.5
units/acre).
2. Vicinity Information
The property is surrounded by properties that are under County
jurisdiction except for several parcels located on the east side
of 121st Avenue which are also within the City. Single family
residences are situated to the south and east of 121st Avenue.
The Tigard Comprehensive Plan designates 121st Avenue as a major
collector which includes bicycle lanes. Presently. ::his section
of 1.21st Avenue is under Washington County jurisdiction.
3. Site Information and Proposal Description
The 1.53 acre property contains one residence. The applicant
proposes to divide the property into three parcels of one half
acre each with the existing house situated on the middle lot. The
property is over 300 feet from an existing sewer line end as a
result, septic systems ar+± intended to serve the two new houses.
4. Agency and NPO Comments
T1ne Engineering Division has the Following comments:
fl. 121st Avenue is designated as a major collector. The street
presently has a 40-foot wide right-of-way and a collector
street requires a 60 foot right -of-way.. Additional
right of-way should be dedicated to provide a half width of
30 feet.

b. Half-street Improvements to major collector standards,
including a bicycle lane, should be constructed along the
property frontage. since the Improvement would be in excess
of what is required for a local street, the applicant would
be eligible for a systems development credit.
C. A street opening permit will be required from Washington
County.
d Because of the major collector status of 121st Avenue,
direct driveway access should be restricted as mu,,-.,h as
practical.
The Building Inspection Division notes that the septic drainfiel.d
for the house should be contained within the corresponding lot.
Written comments have not been received from NPO 13, the Turlatln
Rural Fire Protection District, or Washington County.
B. ANALYSIS AND CONCLUSIOL
The proposed partitioning is consistent with the requirements of an
R-4.5 cone and it, appears to be compatible with the character of the
residential uses nearby. The use of septic systems is permissible
because of the distance to the sewer line.
The right-of-way dedication and street improvement noted by the
Engineering Division are necessary to eventually establish a street
capable of accommodating future traffic volumes. Also, two of the three
driveways should share: a common access to 121st Avenue.
C. DECISION
The PlanninG Director ap"roves MLP 3-84 subject to the following
conditions.
1 . 'JNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO
RECORDING THE PARTITIONING MAP.
2. Standard half-street Improvement to major- collector st.an,tards
Including sidewalks, curbs. street light,, and driveway aprons
shall be provided along the 121st Avanue frontage prior to

until after the Engineering Division has. Issued approved p►rblic
Improvement plans (the Division will require posting of a 100%
performance bond), the payment of a permit fee and a sign
installation/streetlight deposit. Also, the execution of a street
opening permit or construction compliance agreement shall occur
prior to, or concurrently with the issuance of approved public
Improvement plans..
5. Two of the three driveways shall share a common access '.o 121st
Avenue. Joint use and maintenance agreements shall be recorded
for all common driveways and copies of the recorded document(s)
shall be submitted to the Planning Director.
6. Additional right-of-way shall be dedicated to the City along the
121st Avenue frontage to Increase the right-of--way to 30 feet from
centerline. The legal descriptions shall Im approved by the
Engineering Division and then recorded with WastAngton County.
7. The partition sgrvey shall be tied to a City of Tigard "Primary"
or "Secondary" control station If one exists within 1000 feet of
the partition end the bearings orien►ed thereon.
S. Tigard grid coordinates for all established boundary points on the
partition shall be. submitted to tie City within 15 days of
recording.
9. After review and approval by the Planning Director and City
RnEineer, the Minor Land Partition shall be recorded with
Washington County and a reproducible copy of the "record of
survey" shall be submitted to the Engineering Division within 15
days of recording.
10. The drainfield for the septic system serving; the Nrxisting
residence shall be located completely within the central parcel.
11 . This approval is valid if exercised within one year of the final
decislrn date noted below.
