It is our understanding that a hydrant will be located by the Tigard Water District on the 74th Street side of the property and that in a letter dated 2 r1_5r the Tigard Water District agreed to install a hydrant between the tracks on Bonita Road at such a time as it becomes feasible for them to do so. These agreements with the Tigard Water District shall not be considered as a requirement of compliance by the National Safety Company. -2- This agreement between the Tualatin Rural Fire Protection District and the (rational Safety Company officers shall be reviewed by the Tualatin Rural Fire Protection District's attorney to ensure that the necessary built-in commitments to fulfill both parties ' obli- gations shall be included in the agreement. Upon completion o.E the main extension along S. W. Gaarde Street this summer, the district will have a direct transmission (high pressure) line between Waluga reservoir in Lake Oswego and our 10-MG reservoir located at 125th and Bull Mountain Road. As I understand it, the work was done by National under their contract with the Unified Sewerage Agency because U.S.A. included in your easement the agree- ment that they would have the connection to the interceptor made and the snr- vice pipe brought up to within ten feet of the surface of the ground as it existed at that t.iw e. This was a more difficult connection to make than the ordinary one because the interceptor had to be in a steel casi ,lq passing under the railroad tracks and was at a considerable depth. The con,:ractor had to cut a hole in the casino and one in the interceptor sewer, 'Install th,- sewer service pipe, place concrete around it, Extend it up to within ten feet of the ground and plug the end. This was the extent of National Construction Company work under their contract with II. S.A. and was inspected by Mark Braun, inspector for STRAAM Engineers , Inc . , under our agreement with U. S.A. to in- spect the work done under the U.S.A. contract with National Construction Com- pany. The excavation at the end of the pipe installed by National was '.eft open for your convenience and .you were advised by Mark Braun of the need for safeguard- ing it: because of the proximity to the travelled way. Main Street Tigard, Oregon 97223 Re: Tigard Area Chamber of Commerce letter "Fire Hydrant Locations" Dear Mr. Barker: This letter is being written after receipt of a copy of a letter that was given to you by the Tigard Area Chamber of Commerce regarding location of fire hydrants. In the meeting with yourself and the Tigard Area Chamber of Commerce on January 10th, 1 went over in more detail the reasons why we wanted Tigard City Ordinance #72-76 to remain as is. This Ordinance is similar to ordinances in the cities of King City, Sher- wood, Tualatin, Wilsonville, and Durham Although the eyact wording of each of the ot1.-r city ordinances reads slightly different, the general description of the hydrant spacing is the same. Washington County Ordi- nance #118 was adopted, adopting the Uniform Fire Code, with some requirements for either hydrants or on-site water and was put into effect. The 500 ft. spacing in the Washington County ordinance was all that could be obtained at the time. This has generally not been much of a problem because most of the commercial development has incurred inside the cities in Tualatin Fire District. There is one area between Sherwood and Tualatin where some commercial development has gone on and there have been considerable problems here because there's no public water available at all . NUmcrous on-site and private water systems have been started in this area and much time has been spent trying to get. the City of Tualatin and Washington County Planning Department together to solve this problem. However, at this time, this conflict is still in effect. Other than this area , all of the commercial and industrial development in the Tualatin Fire District has come under the requirement of hydrant spacing as laid out in the city ordinances. This has been a good tool for Tualatin Fire District to obtain good water main extensions and fire hydrant locations around commercial buildings by either private water systems or extending the public water systems, either on public right-of-way or un private property. -2- The National Fire Codes , as adopted by Tualatin Fire District, under NFPA #24, Chapter 4 , Hydrants, Para. 4201 in part states : "There shall be sufficient hydrants to concentrate the required flow about any impor- tant building with no hose line exceeding 500 ft. in length. " Most buildings, unless they are very small , in order to apply the required fire flow (fire flow is the amount of water needed to put out a fire in a building based on the type of construction, size, occuponv, and fuel load in the building) takes more than one fire hydrant. B,,• using this city ordinance requiring the fire hydrant location with the man- power and equipment that Tualatin Fire District has we are able to extend our hose lines from the hydrant to the building and further extend the line inside of the building and apply the fire flow. This city ordinance is deviated from but when deviations are allowed , it's because trade-offs are made for additional fire protection inside the building. Obviously, somebody builds a fire-resistive building or provides fire protection inside the building in a sprinkler system, the burden put on the fire department and the time involved in setting up to apply the fire flow in the event of a fire, is less. In these circumstances , the minimum standards established in the city ordinance are sometimes deviated from. However, when buildings that are built without fire-resistance built into them, then the burden of providing fire protection upon the fire department is greatest and this hydrant ordinance makes it an efficient way for the fire department to quickly apply the fire flow requirement into the building. The city ordinance as now written, is written to give the city and TRFPD maximum authority for placing the hydrants near the buildings. To change the ordinance to be less restrictive and then have the fire district require stricter requirements than necessary would only put the burden on the fire district each time hydrants are needed to be more than 500 ft. from the building would create, in my opinion , a more unfair situation. The amount of commercial and industrial new construction that is going on in this district has put a considerable burden on the Fire Prevention Divisi )n of Tualatin Fire District to make sure that gocd fire-safe buildings are heing built. Changing the ordinance to 500 ft. would only create additiinal burdens for us to ,justify each time a building without good built-in fire protection is built, to show the developer why hydrants would have to be placed stricter than the city ordinance. In no way is this City Ordinance intended to be unduly restrictive on any developer or create undue hardship or cost. In this time of tax revolt, etc. , Tualatin Fire District would like to see even more standards adopted as time goes on to provide more and more burden of fire protection to be built into the buildings, rather than the community be saddles with continuing costs of fire equipment and cost of manning this fire equipment. This Ordinance is only part of the overall program. Enclosed is a copy of the City of Beaverton' s Ordinance requiring fire hydrant placement. As you can see, it reads similar to the Tigard City Ordinanre requiring hydrants to be within 250 ft. of any part of a commercial building. In speaking with the Fire Marshal of Beaverton, he has used this city ordinance as a similar tool to provide on-site fire protection in the building or near '.he building. l -3- If you have any questions , feel free to call me and I would also be free before your Tigard City Council at any time to answer any questions and support the existing City Ordinance. Fire ratings, which are based on the calculation of risk to ;Iructur.•es, do not acknowledge any fire hydrant location standard which is more restrictive than the 500-foot standard. In other words, 500 feet is considered optimum; those who insure against fire loss recognize no difference in risk between 250 and 500 feet. 3 . Outside the incorporated city limits, builders are required to install hydrants at distances of .500 feet. It appears to bu;.lders, therefore, that Tigard ordinances are unduly restrictive. This creates an atmosphere of ill feeling toward the city. 4. Washington County Fire District No. 1 acknowledges 500 feet as its minimum standard. Here again, builders who have dealt wit',) that jurisdiction tend to see the City of Tigard's requirement as being unreasonable . 5 . TRF'PD Fire Marshal Joe Greulich agrees that 250 feet is a strict standard and he sincerely believes that this standard should be retained. Yet he acknowledges that. the standard is often relaxed---that variances are granted with some frequency---with no increased risk to life and property. We submit that this goes against the grain of :standard development procedures. In Tigard, for instance, you es'c.ablish minimum stand i.r.d- for development . You then rely upon provisions in your subdivision, design review and other ordinances to impose additional conditions and restrictions which serve the public welfare . In the case of the fire hydrant ordinance, however, fir . Greulich supports an optimum standard, forcing a number of developers to seek variances and exceptions because the standard is obviously too rigid for their particular situations. b . In any case, the City of Tigard and the TRFPD retain the right tc impose more stringent conditions upon any development which presents an unusual hazard to adjoining property or which places an excessive burden on fire service facilities. The city staff and fire marshal would, in no way, be prevented from using their authority to protect the public from definable threats. 7 . I` is not entirely true that.- "developers will pay" for the provision of additional hydrants. As always, developers ' costs are passed on to consumers . Development and regulatory expenses are absorbed eventually by home buyers, tenants, businesses and the patrons of. businesses. 8. Additional construction and installation requirements result in increased demands for finite energy and materia). resources. The trend should be away ;` -gym any unnecessary drain on resources. It .is our understanding that each TRFPD engine carries two 600-foot hose beds, which should be sufficient to fight a fi -e from one or more water sources which are a _maximum_ of 500 feet away. The TRFPD must, in fact, be able to accommodate the more lenient 500-foot standard because this is the standard in effect in the unincorporated areas . Almost any firefighting factor is more crucial than the difference between 250 and 500 .feet : fire flow, the conditions and the overall quality of each piece of engine equipment, and the availability of sufficient manpower. In summary, we emphasize: the chamber of commerce does not seek a relaxation of those standards which are sewing to protect the public welfare. Obviously, we would support no proposal which would increase risk to life and property. We maintain that a 250-foot standard is not safer than a 500-foot standar— In our opinion, it has not :been demonstrated that a more lenient requirement would in any way diminish the quality of protection afforded Tigard citizens. Your Par. #2 with regard to the Fire Hydrant, plan does not meet the requirements of Tigard Rural Fire Protection District lettar of April 26th, 1978 which requires a hydrant within 250' of any part of the proposed building and accessible. Your Par. #3. - Before any building permit can be issued, City of Tigard will require evidence of statement by the Tigard Water District that arrangements have been made with them to furnish potable water and fire protection water to the si.t3. This has not been done to date by you or National Safety Company. Your Par. #5 - Before a permit will be issued the illegal tap at the sewer main is to be exposed and capped to prevent any infil- tration into the main sewer line. Bonita Road, TigF.rd. Plan Check Report on the National. Safety Built inp: Sate and Plans dated October 27, 1978. On October 19, plans given to City employed structural Engineer, Otto Van Walstijn; his report received on October 25th, which stated certain deficiencies in the plans. On October 31, Vic ThomaF and Joe Wilson came into the office. They informed me they were representinf.; John Skourtes for the National Safety project on. Bonita Road. I gave them each a copy of the Plan Check report and went over the plan deficiencies. Vic. Thomas has since supplied certain structural corrections which is now in the hands of the City's Structural Englneer Plan Cjtiecker. The Structural Engineer, Vic. Thomas, has now shown his footing design to he based on 2,000 1bs. per sq. ft. , for. which the C.tty will still require a soils test to verify the stability and value of the f'.11 area where the building is to be placed, as to whether the existing soils will <<ipport the 2,000 lbs. per sq, ft. Item 4b2 of the Plan Check has not beem complied with. The City has not received any new drawings showing Item lit request- or the second half of Item #3. Item 63 has not beem com;. li.ed with regardless of what Skourtes' letter of Nov. 4th says. Item #4 has not been complied with. Skourtes has made an illegal. connection to the Southwood Park Intercoupler sever without a permit. Now, in addition to all of the above, Skourtes has been served with three (3) citations, and is scheduled to appear in Municipal Court Tuesday, November 7, 1978, at 7:00 P.M. Page 2 - To the Elected Officials One is for grading and filling without a permit; one for starting construction without a permit, and one for conneLt.ing to the sewer main lateral as provided by U.S.A. without a permit. The fire marshall has attempted to force the apolicant to adopt to standards that are legally untenable.. 'rhe authority that has the taxing power to provide the services sets the standard (gee point #1 above) . Remember alltrain engines today have two way radio communications. 5) Fire District personnel fighting fire wi"1 not be able to find 30 seconds to spare wherein they can trench between the ties to pull at least one of the hoses under the track. 6) No two trains cross this site simult;aneouly becp.use a mile North of this location S.P. and R.N. tracks merge into one single track. Therefore the railroads schedule accordingly. 7) Light traveled tracks (branch lines) . Four ;;rains daily two on each Wr track and switching engines. 8) Fire intensity will be such that pumper truck water supply will be inadequate. As you will note all of the aL)ve occurring simultaneously are at best improbable. No appeal board can rule on the "can demonstrate clause" because no mortal sole including fire marshall is qualified to compute gambling odds . The Tigard Municipal Code (18 . 64 .030) establishes the minimum requirements for access/egress for a commercial site at 30 feet with a hard surface pavement over 80% of the required access width. This equates to a paved 24 foot access drive with 3 foot shoulders. Approximately 65 feet from the site entrance the lot is 27 feet wide and cannot physically accommodate the required 3 foot shoulders . This deficiency should not create a problem as long as the remaining access drives meets the specified code requirements. When the required access width is incorporated into the plans , parking spaces 7 & 8 will be directly affected and need to be repositioned. By placino parking spaces 7 , 8 ,9 & 10 perpendicular to the western property line additional maneuvering areas for the trucks utilizinq the down ramp can be gained . This new parking placement also creates a triangular landscape area directly to the north of the new location which will reduce the blanket effect of the asphalt on the site. As indicated in my letter of July 26 , 1978 there are no existing permanent distribution mains adjacent to your property to which you can connect. The existing 6-inch main to which you would like to connect, located between 72nd Avenue and the easterly right-of-way of the Southern Pacific Railroad, does not extend across any part of your property. Further, although Tigard temporarily uses this 6-inch main, it is owned by Metzger Water District and, at any time, could revert to their control. The only exist- ing distribution main to which you could connect is the 12-inch main located at the intersection of S. W. 74th and Bonita Road. In staying consistent with established procedures as defined in the rules and regulations of the district, it is believed fair and reasonable that you pay the cost to extend a 6-inch main (the minimum size) across the entire frontage of your property on Bonita Road. Further, that you bear the cost to extend a main to connect to the exist- ing 12-inch main located at 74th and Bonita Road, including a crossing of one set of railroad tracks. (See points "x" and "y" on the attached map) . Such installation would pro- vide you with a supply of water for the proposed warehouse. The above notwithstanding and because of the diffi- culties in providing water service in this location, including the extreme depth of main between the tracks on Bonita Road, the Board of Commissioners will require that the main be installed, at an equivalent cost to you, southerly along S. W. 74th Avenue. Thus, a 12-inch main (8-inch chargeable to you) would be constructed along 74th Avenue at your identically same coat to install the 6-inch main on Bonita Road. An 8-inch main can be installed for $15 per lineal 400t. Therefore, with your capital invest- ment of $3,670 and the water district's contribution of $1,225 (difference in cost between 8-inch and 12-inch main) , 245 lineal feet of 12-inch pipeline will be installed along 74th Avenue.
