A problem discharge means any upset, slug discharge, spill or accident which results (or may result) In a dis- charge into the Agency's treatment system of a prohibited sub i*tance;or of a reguiated substance in excess of permit limits and which may: (a)cause interference or pass through at the treatment plant;or(b)contrihute to a violation of any requirement of the Agency's NPDES permit; or;c)cause violation of any State or Federal water quality standard. During normal business hours, notifications may be made by calling the .Source Control Division at 693-4541. Emergency notifications may be made after hours/weekends/holidays by calling the duty office► at 784 6229. 2.E. If sampling perforn'ed by the Permittee Indicates permit violation(s), the Permittee shall notify the Aga-lcy within 24 hours of becoming aware of the violation. The Permittee shall also repeat the sampling and analysis and submit the results of the repeat analysis to the Agency within 30 days after becoming aware of the violation per 40 CFR Part 403.12(g). The Permittee must continue the notification and resamplir,g requirement until compliance is achieved. t 2.i". The Permittee shall Immediately report any slgniflcant changas(permanent or temporary) to the premises or operations that cause substantial changes in production, volume or character of the wastewater discharge,or deviates fr(m the terms and conditions of this permit, per the requirements In 40 CFR Paris 403.120) and 403.6(c)(7). Unless emergency conditions prevail,the Agency requires that changes be reported prior to being Implemented. 2.G. Not►fl;adon from the Permittee Is required to the Agency,the EPA RCRA Director, and the Oregon State Na7?;nous Waste Director within 90:;aye of the effective date of a published RCRA ruling,of a discharge(or changed discharge) of either a listed or characteristic hazardous waste to the sanitary sewer, per the require- ments in 40 CFR Part 403.12(p), The Agency requests notIllration even if the results of the hazardous material sampling are submitted on self-monitoring reports (Periodic Compliance Reports). 2.H. An "Upset", and an affirmative defense for such, shall not be allowed under rircumstances where none compliance has been caused by operational error, Improp,dy desl,lned or Inadequate treatment faculties, lack of preventative maintenance, or careless or Improper cperatlon. In case of an upset or upon reduction. loss or failure of Its treatment facility,the permittee shall control production and/or alt discharges to the extent necessary to maintain compliance with applicable pretreatment standards until treatment is restored or an alternative method of treatment Is provided. This requirement also applies in situations where the primary source of power for the treatment facility Is reduced, lost or fails, 2.1. Bypass: the intentional diversion of one or more wastestreams or processes trom any portion of the permit- tee's treatment facility is prohibited per the Agency's Industrial Sewer Use Rules and Regulations R&O 92-60. Any Permittee subject to reporting requirements In 40 CFR Part 403.12 shall retain and presorve all recol,'s, books, documents, memoranda, reports, correspondence and any and all summar'.:;s thereof, relating to monitor- Ing, sampling and chemical analyses made by or on behalf of an the Permittee In connection with Its discharge. Such records shall be subject to review by the Agency, and shall Include for all samples: 1) The date, exact place, time, and meths:s of sampling or measurements, and sampling preservation techniques; 2) Who performed the sampling or measurerr►onts; 3) The date(s) the analyses were performed; 4) Who performed the analyses, 5) The analytical technly►ies or methods used;and 6) The results of such analyses. 3.8. The Permittee _hall retain for a -Inimurn o three years all such records defined In Section 3.A. above, and shall make such records available for Inspection and copying by the Agency,the DEO Director and the FPA Reglooal Administrator. This perlod may be extended by the request of the Agency at any time. All records that pertain to matters that are the suL;ect of special orders or any other enforcement or litigation activities brought by the Agency shhli be retained and preserved by the permitee until all enforcement activities have concluded and all prlrlods of Ilmltation with respect to any and all appeals have expired. 3C. Permit Modification The Agency ressrves the right to amend any Wastewater Discharge Permit Issued hereunder for good caus:� Including, but not limited to the following: 1) To incorporate any new or revised local, State or Federal pretreatment standards or requtroments; 2) Alterations or additions to the Permittee's operations, processes, discharge volume or characteristic riot considered in drafting the original permit; 3) A change in any condition at the Permiftee's facility or the POTW requiring a temporary or permanent reduction or elimination of the authorized discharge; 4) Information Indicating that the permitted discharge poses a threat to the POrW's collection or treatment systems, personnel or receiving waters; 5) Violation of any terms or conditions of the permit; 6) Misrepresentation or failure to disclose fully all relevant facts in the permit application or any required reporting; 7) Revision of, or a grant of variance from applicable categorical standards per 40 CFR Part 403.13, 403.6(e)and 403.1.5; 8) To correct typographical or other errors In the permit; 9) To reflect transfer of the facility ownership andlor operation to a new owneNoperator; :0) Upon request of the permitted Industrial User, provided the request does not violate any requirements, standards, laws, rules or regulations.- 11) egulations:11) To incorporate arl new or revised constituent limit resulting from the Agency's reevaluation of its local limits. 4.8. Dilution Prohibition The pormittee shall not Increase the use of potable or Fro(.o96 water In any way for the purpose of diluting a discharge as a partial or complete substitute for adequate treatment to achieve compliance with the standards set forth In this discharge permit or any Agency ordinances, or In lieu of proper disposal of nny material as solid waste. l he Agency may impose mass limitations on dischargers which In I;s Judgement appear to be using dilution to meet applicable pretreatment standards or requirements of this section,or In cages where the Impos!- tion of mass limitations is otherwise deerned appropiate by the Agency. All samples shall be taken at the monitoring points specified In this permit, and unless otherwise specified, before the permitted discharge joins or is diluted by any other wastestreams, body of water of substance. All equipment used for sampling and analyses must be routinely calibrated, Inspected and maintained to ensure Its accuracy. Monitoring points shall not be changed without notification to, and approval from the Agency. 4.n. Inspection and Entry The Agency may inspect the facilities of any Permittee to determine compliance with the requirements of the Agency rules and regulations. The Permittee shall allow the Agency or its representatives to enter upon the premises c'the Permittee at all reasonable hours and without prior notification by the Agency, for the purposes of Inspection, sampling, and records examination and copying. The Agency shall have the right to set upon the PermitteE's property such devices as are necescary to conduct sampling, Inspection,compliance monitoring and/ or metering operations. 4.E. Certificatior Statement All reports and testing results submitted by any Permittee shall be accompanied by the signed certification statement defined In 40 CFR Part 4C3.6(a)(2)(li). 4.F. Proper Disposa►of Slu,lges/Spent Chemicals The disposal of pietreatrne,it sludge, and spent chemicals shall be done In accordance with Sbotion 405 of the Clean Water Act (CWA) and Subtitles C & D of the Resource Conservptlon & Recovery Act (RCRA), and any Mstate hazardous waste requirements. 4.G. Falsifying Information/Tampering With Monitoring Equipment Knowingly making any false statement on any report or other document required by this permit,or knowingly rendering any monitoring method or device inaccurate, may result In punishment under criminal laws of the Agency, as well as being subject to civil penalties and relief. 4.H. Emergency Suspension of Services/Revocation of Permit The Agency may suspend the wastewater permit of a Permittee,whenever necessary In order to stop an actual or threatened discharge which reasonably appears to present or cause an imminent or substantial endangerment to the health or welfare,of persons, interferes with the operation of the Agency's was!ewater system, or which fpresent or may present an endangerment to the environment. In addition to further penalties and remedies In any Ordinances or R&O, the Agenuy may terminate the wastewa- ter permit of any Permittee for violations of any Ordinance, R&O, or discharge pp•mlt condition. The Planning Division concludes that Pak-Best's proposo,l for use of a temporary office structure complies with these standr.rus because the temporary structu-u ie to be wholly located on the site of Pak-Beat's soon to be operating manufacturing operations; the manufacturing building is nearly completed and necessary site improvements are already in place; the new parking lot and access driveways will provide sufficient parking for a use occipying the temporary trailer and manufacturing aerations as well as safe access without unnecessary congestion; nu adverse impacts upon adjacent uses are foreseen from use of the temporary structure; and the applicants have made arrangements for temporary sewer, water, and other .itility hookups for the temporary structure. In addition, the proposed office use of the structure is a permitted use in the I-L zone when combined with the manufacturing operations to be conducted in the main building. Recently, staff received revised site plans for this development for final staff review and it was noticed that these plans were substantially different than what was originally submitted and, as a result, a new review is required. Vicinity Information Properties immediately to the east, mouth, and west are also zoned I-L (Light Industrial) . Property immediately to the north In zoned and developed I-H (heavy Industrial) . 3. Site Information and Proposal In the early 1980s a fire remulted in the destruction of the Dickenson building, a manufacturer of jamn and intlien. All that remains on the site is a concrete @lab and wendp. The applicant proposes to romove the cexint.l.nq concrete slab foundation and construct a 47,350 square foot wnrohminn building. Agency and NPO Comments NFO #5, Northwest Natural Gas and the General Telephone Co. have reviewed the proposal and have no objections to it. The City Engineering Division has reviewed the proposal and has :he following comments: a. The site fronts Bonita Road immediately east of the southern Pacific Railroad. The vertical profile of Bonita Road across the railroad tracks is substandard according to current design criteria. The railroad crossing to much higher than Bonita Road on either side of the tracks. The proposed westerly access onto Bonita Road io located approxi.nately 120 feet east of the railroad crossing. Due to the elevated railroad crossing, adequate site distance is not availatle for vehicles exiting the site to the east or for vehicles traveling east, to see vehicles also traveling east which have slowed or stopped to enter this access. d. The right-of-way of Bonita Road is shown to be 30 feet from the centerline. This is adequate for the major collector street. The easterly access is proposed as a joint access. Engineering staff has no opposition to this access. e. The applicant has proposed to drain the site to the existing ditch and storm drainage pipes along the railroad embankment. Since the existing site is mostly paved, the increase in storm drainage runoff should he minimal. STAFF REPORT - SDR 89-11 - TENNANT INVESTGRS - PAGF 2 The previously submitted drainage study for the prior application indicated this increase to be 14 percent. The study also indicated the existing ditch and downstream drainage structures are inadequate for the entire drainage basin. Due to the small incremental amount of increase, we recommend no f.urLher improvements to the existing system. Inotead, we recommend improving the ditch to drain to the downstream structures and the applicant record a waiver of remonstrance for future improvementn to the storm drainage system. f. Sanitary saws. service is available at the southwest corner of the property. No other comments were received. B. AXALYSIS AND ODMC'LUSION The proposed development is consistent with Community Development. Code requirements for bulidi.ng setbacks, building height, access and egress, site landscaping coverage, parking, and allowable uses in the I-l. zone. Additional diacuss'.on is warranted pertaining to street tree requirements, irrigation plans, landscape screening, bicycle parking and signage. a. Street Trees and Irrigation Chapter 18.100 of the CodG requires the planting of street trees for all development which have a frontage on a publ}.c street of 100 feet or more. The submitted landscaping plan makes no provision for street treea along SW Bonita Road, but instead proposes to use evergreen trees of varied heights as a buffer between the nite's parking areae and the public street. staff notes that street trees will. be required in addition to any parking screening or buffering. A revised landscaping plan shall be submitted for Planning Division review which also shows how the landscaping will be Irrigated. b. Bicycle Parking This use requires that at least 47 vehiclo parkinq spaces be provided and therefore, the Code requires that at least three bicycle parking spaces wiil be required on the site. These ohould be Indicated on a revised site plan and ;:he desirin shrx3ld also be submitted. C. Signage No submittal for sign review have been submitted in conjunction with this application. Hall Tigard, Oregon 97223 RE: Bonita Warehouse Project Dear Brad: Regarding the demolition that has occurred to date on the site, I have reviewed our drawings and it appears that the sanitary sewer system was hooked tip to a septic tank and drain field. For the moment I am assuming that this means thatthere was no connection to a sanitary sewer in the street. I propose that the contractor begin exploratory excavations to verify that there was a septic tank system and to remove it where it would interfere with the proposed construction. If you prefer, we could begin excavating a trench parallel to the property line to sea if we intersect the sanitary sewer service line. We would want to dig that ditch in the location where our proposed storm sewer line would go so as to not waste the owners money unnecessarily. There may be an oil storage '-ank on the site, although it has not shown up on the survey. If one exists, we would like to remove it and backfill the hole prior to the issuance of a building permit. We would also like to demo the pond and remove the fence and backfill that hole. There is a large amount of site preparation necessary in order to make this site suitable for. construction. We propose to prepare the area for a new building pad by cleaning up the site, removing blackberry bushes, etc. , pulverizing the concrete of the existing slab and foundation wall. systems and regrading the area as required. We propose to reuse the concrete rubble by distr.ibutinr it in areas under the floor slab that are to receive two feet or more of fill material . The rubble will be broken to apprc;ximitely 6 to 8 inches in size and spread in the lower level of the new pad area. The soils would then be distributed in layers and compacted. The existing site is 71% paved and the proposed site will be 85% paved surfaces . Drainage of surrounding sites , Fought Steal. on the North and Federal Express on the Ease, appears to be into existing underground systems . These systems are not recorded in the City of Tigard Building Department files. Two catch basins located near the east property line collect parking lot drainage from portions of the property to the east and approximately 23% of. the Project site. The existing site, along the South edge, does not drain completely, and will be resurfaced as required to provide full surface drainage. The Rite area is 108 , 179 sf, 2. 48 aseres. Existing and proposed drainage surface slopes vary and are taken to average about 1. 50%. The time of concentration for this site is estimated to be 7 . 5 minutes based on an average velocity of 2. 5fps , a length of travel of 375 feet, and an initial collection time of 5 minutes for paved areas. Using the Eastern Washington County RAINFALL INTENSITY CHART, the intensity for this time of concentration is estimr,ted to be 2. 80 inches per. hour. Because site detention causes other problems for the Tualatin River lower basin, we do not propose to retain a larger amount of runoff on site. DETENTION The proposed surface drainage system consists nf five new catch basins. Of these, two are center basins and three are side basins. With the water depth limited to 6 inchos above the catch basin rim, these basins will store a total of approximately 6000 cubic feet of runoff. This figure is based on a 1% surface slope and the equivalent of 3 . 5 center drain basins. The proposed 6000 cf storage will. cause maintenance problems on site however, they will reduce flooding problems on the adjacent railroad property, where there is an existing drainage problem. The on site storage will provide storage for nearly 20 times the runoff increase calculated P'Dove. Dear Mr. ler,nant: This report disc, sses the results of compression tests made on core sarrdles taken from the building walls and the results of a stress analysis made to assess the strength of the wall panels Also results of a stress analysis of thebuilding in -ts present condition are presented. Core _Sample Tests Four l inch diameter core samples were taken from the tilt-up wall panels and two were taken from the cast-in-place foundation wall below the floor. Cores were taken from the foundation wall because the effect of heat from the fire would be negligible and would provide a comparison betweenconcrete exposed to the fire and concrete of sim- ilar mix that was not exposed to the fire. The four cores taken from the tilt-up panels showed evidence of a heat effected zone approximately 1" to 1}" deep. This was evidenced by a color change from the normal concrete gray to a light brown. Three cores had compressive strengths above 2500 psi and one had a compressive strength of 2025 psi . The sample were tested by loading them in compression in direction perpendicular to the plane of the wall . Therefore, the influence of the heat effected zone would be incuided in the overall strength of the sample. The sample taken from the foundation wall had compressive stren- gths of 3965 psi and 4130 psi . This is considerably higher than the tests of the tilt-up samples. It is quite probable that the mix design for the concrete in the two walls was the same so one might expect the same or similar compressive strengths. However, there are two factors besides the heat that may be a cause for a difference in strength. One is that the amount of water in the concrete of the foundation wall was less than for the tilt-up wall . This is probable because dryer concrete is easier to place in forms than in a flat slab. Mr. Joe Tennant June 22, 1984 Page 2 The dryer mix would produce a higher strength concrete. Secondly, the curing environment for the foundation wall would produce higher strength also. A definite cause-effect relationship between heat and loss of strength cannot be made from this evidence. However, the difference between 2500 psi and 4000 psi is considereable and does tend to imp- licate the heat fromthe fire as a strength reducing factor. Stress Aria lysi s representative wall panel )nd pilaster-column was analyzed for ability to support lateral load from wind and vertical load from the roof. Analysis criteria included concrete strength of 2500 psi , reinforcing steel yield strength of 40,000ps1 , wind load of 15 psi, roof weight of i5 psf and roof snow load of 2.5 psf. The customary techniques for the analysis of this type of struc- tural element are very rudimentary requiring simplifying assumptions that may render the results and/or conclusions subject to different interpretations by different engineers. More precise analyses can be made but are beyond the scope of this investigation. Two parallel anal ses were made. One assuming no reduction in wall thickness (case 1� and another essuming 1" of the inside face of the wall and pilaster-column did !iot contribute to the strength (case 2) because of fire damage. One of the more common wall panels, one having a large window opening located in the upper half of the panel , was selected for anal- ysis. This type of panel was analyzed for wind load as a two way bending element supported by f;he roof and floor at top and bottom and by T-beam columns at the two sides. The T-beam column element was taken as a composite of the pilaster-column and a portion of wall on either, side. Calculations show the T-beam colLImn element to have adequate strength in bending for wind load;ng (positive of negative pressure) even when 1" of concrete on the inside 1'ar�e (case 2) is discounted. Wall panel calculations show that they are stressed in bending beyond allowable maximums in transmitting wind loads to the stiffer and stronner elements - roof, floor and T-beam columns. With full wall thickness considered effective (case 1) the :falls are approx- imately 30% overstressed; with 1" of the inside f_ce discounted (case 2) the walls are approximately 110% overstressed. A dimin- ution of the thickness of the wall by only 1" has a pronounced effect on the bending strength of the wall . Mr. Joe Tennant June 22, 1984 Page 3 Present Status I 1 At the present time the wall pdnels dre braced against wind load with what appear to be adjustable steel pipe braces commonly used for temporary bracing of walls in tilt-up construction. There is one brace at each pilaster-column. Based on approximate calculations it is doubtful that these braces are adequate for an 80 mph wind as required by the building code for permanent structures. The manufacturer of the brace should contacted for a more definite a.apraisal of the bracing capacity. The panels themselves, not being continuously supported at the roof line, are not adequate to span between brace points. We recommend that the building continue to have restricted access. Only authori2ed persons with full awareness of the conditions and know- ledge of how to safely be in such an environment should be permitted on the premises.
