This is a Fire and Life Safety Plan Review and is based on the 1988 editions of the Fire
and Life Safety Code (UBC), Mechanical Fire and Life Safety Code (UMC), Uniform Fire
Code (UFC), and other local ordinances and regulations.
Plans are approved as submitted.
1. Approved Plans on Job Site: One set of approved plans bearing the stamps of
the building department issuing the construction permit and this office mast be
maintained on the project site throughout all phases of construction and must
be made available to building and fire inspectors for reference during required

1985. editions of the Fire and Life Safety Code (UAC), Mechanical
Fire and Life Safety Code (UMC). Uniform Fire Code (UFC) , and
other local ordinances and regulations.

4. Firestopping: Tn all wood framed walls and partitions,
firestopping consisting of 2-inch nominally-sized iumber
or other approved materials must be installed at all
floor and ceiling levels. Penetrations in this
prescribed firestopping to accommodate wiring, plumbing,
and other similar utility runs must be, packed with
noncombustible materials in an approved manner so as to
prevent the passage of flame. UBC Sec. 2516
5. Insulation Flame Spread: The insulation, including
breather papers and vapor barriers which are not in
contact with the upper surface of the ceiling and under
surface of the floor, as the case may be, must have a
flame spread rating of not to exceed 25 and a smoke
development. classification of not greater than 450 as
measured on the Steiner Tunnel Test scale referred to
as UBC Standard No. 42-1. UBC Sec. 1713
6. Landings at. Doors: There must he a floor or landing on
each side of all doors. The floor or landing must not
be more than one-inch lower than the threshold of the
doorway unless serving access for the physically
handicapped. UBC Sec. 3304(h)
7. Mechanical Plans Required: Plans referred to and
examined by this office contained no plans for heating
or air conditioning systems. Unless electric baseboard
heat is employed, complete i,oechar_ical system plans for.•
the HVAC equipment ar.d duct work must be submitted to
and approved by thi- Afice prior to installation. UBC
Sec. 302
8. Mechanical Equipment Approval: All. heat producing and
electrical equipment and appliances installed in
conjunction with the construction or occupancy of this
project must be approved by Underwriters Laboratories,
Inc. or other nationally recognized testing agency and
installed in accordance with the testing agency's
specifications. UMC Sec. 502
9. Approved Plans on Job Site: One set of approvec plans
bearing the stamps of the building department issuing
the construction permit and this office must be
maintained an the project site throughout all phases of
construction, and must be made available to building and
fire inspectors for reference during required

A fire and life safety plan review was conducted on the above-
captioned project for compliance with the 1985 editions of the
Uniform Building Code (UBC) , Uniform Mechanical Code (UMC), and
Uniform Fire Code (UFC) as amended by Tualatin Rural Fire Protec-
tion District's Ordinance 86-5.
Plans for the above captioned project are approved for construction
subject to the following items:
1 . Exit Door Hardware: All doors shown on the drawings must
be openable from the inside for immediate exit at all times
without the use of a key, special knowledge, or effort.

2. Exterior Exit Door: Hardware for the exterior doors and key-
operated deadlocks may be permitted where there is a sign
posted on or over the door reeding, "THIS DOOR MUST REMAIN
UNLOCKED DURING BUSINESS HOUR`;" in letters not less than
one inch in height on a contrasting background.

3. Insulation Flame Spread: The insulation, including breather
papers and vapor barriers which are not in contact with the
upper surface of the ceiling and under surface of the flow ,
as the case may be, must have a flame spread rating of not
to exceed 25 and a smoke development classification of not
greater than 450 as measured on the Steiner Tunnel Test
scale referred to as UBC Standard No. 42-1.

k. Mechanical Plans Required: Plans referred to and examined by
this ^ffice contained no plans Lor heating or air condition-
ing systems. Unless electric baseboard heat is employed,
complete mechanical system plans for the HVAC equipment and
duct work must be submitted to and approved by this office
prior to installation.

5. Mechanical Equipment Approval: All heat proeucing and
electrical equipment and appliances installed in conjunc-
tion with the construction or occupancy of this project
must be approved by Underwriters Laboratories, Inc, or
other nationally recognized testing agency and installed
in accordance with the testing agency's specifications.

6. Approved Plans on Job Site: One set of approved plans bear-
ing the stamps of the Tigard Building Department and this
office must be maintained on the project site throughout all
phases of construction and must be made available to build-
ing and fire inspectors for reference during required con-
struction inspections.

7. Inspections Required: Inspection and approval of construc-
tion by a representative of this office is required: (a)
prior to the cover of any new framing elements following the
Installation of all utility runs which will be concealed
within wall and partition cavities; (b) upon completion of
construction and prior to occupancy of the tenant space.

8. Certificate of Occupancy Required: Prior to the use and
occupancy of the project (space , a certificate of occu-
pancy or other written instrument of approval must be
obtained from the City of Tigard Building Department.

APPLICATION: Request by Richard G. and Bette Lee Pike for approval to divide
a 45,489 square foot parcel of land into two parcels containing 15,009 sq. ft.
and 30,480 sq. ft. on property zoned I-L (Light Industrial) . Location: 1235
SW Ronita Road (WCTM 2S1 12AB Tax Lots 1000, 1002, and 1100) .
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described applications subjEct to certain
conditions The findings and conclusions on which the Director based his
decision -are .as noted below.
A. FINDING OF FACT
I . Background
Fhe subject properties involved in this request are actually one
legally recognized parcel. Two illegal partitions have occurred
in the past, the first created tax lot 1100 in 1980 and the
second resulted in tax lot 1002 in 1984. Both of these Lots were
recorded at the Washington County Cartography Division without
over having gorse through a formal minor land pa.rtli-,on process
with the City. Since this property was annexed to Tigard in
1969, the present lot configurations constitute zoning violations
and illegal. lot- .
In IS84 the prcperty owners were made ;aware of the City' s
-•egulations for minor land partitions and responded by a letter
dated May 11, 1984 that they had inadvertently bypassed these
s•equirnments in dividing their property. At: ;.he same gime, thev
sent in an application form to legalize their actions . The
application subR.:Lted was found to be incomplete and wa, never
processed . No follow up actions occur•sed from either U-o
applicant or the City.
the applicant notified the Planning staff by a letter- dated
December 4, 1986 that he was ready to proceed with his minor band
par•Lition request. Correspondence has subsequently occurred
betwein staff and applicant leadinq to the request at hand.
2. Vicinity Info-mation
I-L zoning occurs on all surrounding properties to the parcel
being partitioned. Developmerif in the area is consistent with
this zone with seve.rai manufacturing, distribution and/or, light
industrial businesses occurring nearby . Heavier industrial uses
are located to the north of thin area along SW 72nd arid the
City' s only I-H (Heavy Industrial) zoning district in within l50
feet rr the parcel' s ssorthern property line.

3. Site Information and Proposal Description
Therc are presently two structures on the property. On the
southwest corner (corresponding to tax lot 1100) is a 1188 square
foot building used as an interior design business. A larger

buildinc.i s located on the southwest portion of the parcel and
extends north and then west for nearly the length of the northern
rroperty boundary. This building appears to have been
constructed for office use in combination with a storage area
which takes up most of the building' s floor, area.
The applicant is proposing to legally partition the property in a
similar- configuration to the illegally created tax lets that were
recorded in 1980 and 1984. In this instance, however, only one
new tax lot is being :rented instead of two. Also, the proposed
property line, if 7Appr-jved, would run from north to south at the
sama position as the eastern property lines of tax . lot4 1002 and
1100. As proposed, the new property line would pass completely
through the warehouse section o the property' s lartjr building
thereby dividing ownership of the building and causing it to sit
on two legally created lots.
4. Agency and NPO Comments
The Engineering Division has reviewed the proposal and makes the
following comments:

not appear to be well developed. we will look at more
closely upon applicant's submittal of detailed plans.
(3) It appears that the partition con-ist-s of three lots not
just two.
Thc. Building Division has reviewed the proposal and makes t'le
following comments:
-'he "newly" created prof.erty line between the two lots
passes through an existing building which parallels the
north property line. This created an illegal building
(, P. buildings cannot be located across property lines) .
The fact that there will be two separate owners complicates
the matter, more. An alternative lot line layout should be
employed.

The Tigard Water District has reviewed the proposal and makes the
following comments:
The issue, as presented, is very confusing. From the
county maps it appears that the land has already been
subdivided into 3 individual tax lots. Ther,�forie, it
appears that the request should be to combine tax lots t002
and 1100 and not, as described above, to subdiv,ue.
However, the Water District has no objections. It would
appear that tax lot 1002 has become landlocked and such
combining of tax lots 1002 and 1100 would be logical.
No other comments were received regarding this proposal.
0. !ANALYSIS AND CONCLUSION
Previous actions of the oroperty owners (applicant.,) have created a
situation which they now wish to correct. Becausr prior land divisions
were illegal and improper-, the existing tax lot: include a land locked
parcel and a property line that intersects a building. At this point;
the best corrective means to resolve the sii. iation would be to
partition the property to separate the interior design business (tax
lot 1100) and keep the remaining property intact. Instead, the
applicants wish to essentially combine tax lots 1002 and 1100 and that
mear,g retaining a property line that passes completely through the
warehou y portion of the legal prope^ty' s larger building. To
partition in such a manner the applir.ants carry the burden of
satisfying all building separation requirements End standards of the
Uniform building Code (UBC) .
To clarify the liability and responsibility for the divided structure
applicants will need to formulate a legal agreement which delineates
commor wall ownership. Also, depending on the use and types of
materials to be stored in the warehouse, protective fire wall measures
(minimum, 1 hour) will need to b,:. enacted. UBC standards will,
determine what these measures will be. Final approval of this
partition depends on satisfying such requirements.
The applicants are also requesting abatement: of half—street
improvements on the portion of SW Boniti Road which abuts tax lot 1100
for 75 feet. Since the Local Improvement District has already financed
street improvements no relief is needc,d here. However, consistent with
development actions in the area (and with City (,ouncil' s decisions),
sidewalks and curb cuts will need to be. constructed as part of the
approval process .
C. DECISION
The Planning Director approves ML 87-02 subject to the following
conditions :
1 . UNLESS OTHERWISE: NOTED, ALL CONDITIONS SHALL_ BE MET PRIOR TO
RECORDING THF PARTITION WITlt WASHINGTON COUNTY.
2 . The app, icant shall provide for roof rain drainage and par•k,.r�;
lot runoff to the public st:or•mwater system.

3. Street improvements including concrete sidewalk driveway
apron(s), curb(s) [and CR road base and AC pavement as may be
necessary] and utilities, including storm sewer, shall be
installed along the SW Bonita Road and SW 72nd Avenue frontage.
Said improvements shall be designed acrd constructed to major
collector street standards and shall conform to the alignment of
existing improvements and, where non-exist, to an alignment
approved by the City Engineering Section.
4. Storm sewer system d Alails shall be provide' as part of the
Public Improvement P +n. Calculations and topographic service
area map shall be provided as a supplement to the Public
Improvement plans, if requested by the City Engineering Section,
to demonstrate evidence of development serviceability. The
location and capacity of existing, proposed (or future) lines
shall be addressed.
5. Five (5) sets of plan--profile public improvement construction
plans and one (1) itemized r--., ruction cost estimate, stamped by
a Registered Professional Civil Engineer, detailing all proposed
public improvements shall be submitted to the engineering Section
for approval .
6. Construction of proposed public improvements shall not commence
until anter the Engineering Section has issued approved public
improvement plans . The scctior, will regt!ire posting of a 100%
Performance Bond and the payment of a permit fee. Also, the
execution of a street opening permit shall occur prior to, or
concurrently with, the issuance of approved public improvement
plans . SEE THE ENCLOSED HANDOUT GIVING MORE SPECIFIC INFORMATION
REGARDING FEE SCHEDULES, BONDING AND AGREEMENTS.
7. A legal, common wall agreement to be. signed by both property
owners shall be submitted to the City for review and approval
prior, to recording the par,;ition.
A . Building plans for a fire wFll along the property line within the
building to be intersected shall be submitted to the Building
Division for review and approval of all applicable Uniform
Building Code Standards and regulations.
9. This approval is valid if exercised within one year of the final
decision date noted below.
