WITNESSETH
WHEREAS, the first party is the owner in fee simple of the following
described real property in the City of Tigard, County of Washington, State of
Oregon, to wit:

and said two parcels of real estate adjoin each other; and
WHEREAS, the parties desire to grant to each other an easement and right

FOURTH: This agreement should bl,nd and inure to the benefit of, as the
circumstances may require, not only the immediate parties hereto, but also to
their respective heirs, executors, a.lministrators and successors in interest
as well.
FIFTH: WE17 Phe maintenance shall be a shared responsibility of the parties
and each of tl.e parties shall share the cost of maintaining the easement. The
obligation to share maintenance costs shall begin when the driveway in
completed.
SIXTH: E0151!EZRM1} Each of the parties shall maintain liability insurance
which, at a minimum, meet the standard in the industry for the particular
types of uses for which the properties are used. The insurance policies shall
name the owner of the adjoining parcel as an additional insured in connection
with the use of the easement.
SEVENTH: In construing the foregoing agreement, the plural shall mean and
include Lhe singular whenever the context so requires.

approximately 80,000 and 78,750 square feet to be known as the Nelson Business

DECISION: Notice is hereby given that the Planning Dirc-ctor's designee for
the City of Tigard has APPROVED the above request Eiubject to certain
conditions. The findings and conclusions on which the decision is based are
noted below:
A. FINDING OF FACT
1. Background
No land use or development applications regarding these parcels
have been reviewed by the City of Tigard.
2. Vicinity Information
The 8.24 acre site is located on the north side of SW Bonita
Road, abutting Interstate Highway 5. Two industrial buildings
formerly occupied by Ted Nelson Steel Company are located
immediately west of the subject site on a 7.63 acre darcel which
i.s zoned both t-H (Heavy Industrial) and I-L (Light Indust.rial) .
Redevelopment of this parcel is noted on the site area plan as a
future phase of the Nelson Business Center. Redevelopment_ of
this property is not subject to the current review.
Properties to the north of the subject site include the
manufacturing operations of Willi.amu Air Control and Gerber
Legendary Blades. These properties are zoned I-H (Heavy

3. Site Information and Proposal Description
The site is presently vacant and has undergone substantial site
clearing and grading in the past few months. The site lies
approximately 30 to 40 feet below the elevation of the Bonita
Road overpass and approximately 20 feet lower than I-5.
The applicant requests Site Development Review approval of a
plan to construct two flex-space industrial buildings on the
site. The buildings would be oriented parallel to SW Bonita
Road. Proposed Building C would be located on the north portion
of the site. Building C would include 80,000 square feet of
flex-apace industrial warehouse area. Building D would be
located on the southern portion of the site and would include
78,750 square feet. Both buildings would be served by a number
or loading docks and at-grade overhead doors opening to a central
driveway/loading area. Automobile p ,.-king for 213 automobiles
wju:ld be provided along the perimeter of the site. The
development would be served by a 40-foot wide driveway to be
located opposite the intersection of SW Sequoia Parkway with
Bonita Rodd. In addition, a driveway connection would be
provi.red to the former Ted Nelson Steel Company site to the west
to provide access to SW 72nd Avenue.
Site development would require removal of '7 fir and widow trees
along the southern edge of this site. A number- of other existing
fir trees along the southern, edge of the property and within the
public right-of-way just south of th(, parcel would be retained.
In addition, two oak trees on the site's eastern onundary with
the Interstate 5 right-of-way would be retaiv.. i. Site
landscaping would include a variety of deciduous trees to be
located throughout the site, planting of several Douglas fir
treeN along the southern edge of the s. te adjacent to existing
trees, and planting of a variety of shri.as and ground covers
throughout the site.
4. Agency and NIO Comments
The Engineering Department has reviewed the proposal and har
offered the following comments:
a. The applicant has submitted a site .nd pr"i,.r,i,iary utility
plan showing the proposed buildings.
b. Thio site abuts SW Bon .a Road, a major collector street.
This street is improved with full width pavement and curbs,
bat no sidewalk. The existing 60 foot wide right-of-way is
adequate for a major collector street.
C. Access it tr, be provided by a 40-foot wide driveway from SW
Bonita Roa,i that meets the requirements of subsection

18.108.080.A of the Code. A driveway connection to the
adjacent parcel. to the went has also been provided. A joint
use rnd maintenance agreement for the driveway will be
required guaranteeing access through this parcel.
d. Sanitary sewer service is available from a 21. inch Unified
Sewerage Agency line that passes through the site.
e. Ball Creek passes through this site within an existing 90
inch culvert. Proposec. storm drains are connected to the
culvert.
The Tualatin Valley Fire and Rescue District has reviewed the
proposal and has commented that the proposed development must be
served by no less than two accesses as per Uniform Fire Code
Section 10.207. In addition, fire hydrants must be installed as
per Uniform Fire Code. Placement of hydrants must be coordtna'.ed
with the Fire District and Tigard Water District.
The Oregon State Highway Division has reviewed the proposal and
has commented that potential I-5/217/Kruse Way intetcnange
improvements may be dramatically impacted by the propc9ed
develt-,-nent. Preliminary alternatives A end B of the Interchange
Impeovement Project would require right-of-way to be obtained
from this site. The final env+.ronmentsl impact statement for the
proposed interchange project is due in late 1990 with
construction tentatively slated for 1.993. The City of Tigard has
responded to the Highway Division that the City is not in a
pok•ition to require right-of-way dedication or require
modifications to i submitted developnint plan based upon
potential right-of-way needs that are .iot identified in in
adopted roadway improvement plan.
The City of. Tigard Buil.ding Division, "igard Water District,
Columbia Cable Television, and Neighborhood Planning Organization
NPO #5 have reviewed the proposal and offc.-PO no comments or
objections.
No other comments have been received.
ll. ANALYSIS AND CONCLUSION
The proposal. for development of the two flex-Brace industrial
buildings conforms with Community DeNrelopment Co,e f-L (Light
Industrial) zoning district requirements for minimum setbacks from
property boundaries, building height (45 feet maximum allowed; 28
feet maximum building height proposed), site coverage (85 percent
maximum coverage allowed; 85 percent coverage proposed); and site
landscaping (15 percent minimum landscaping; 1.5 percent landscaping
proposed) . The buildings are designed to accommodate uses permitted
in the I-L zoning district.

The proposal complies w�;ti Community Development Code requirements for
parking area trees, street trees and other site landscaping
requirements. The plans also are consistent with Code standards
related to vision clearance at driveway/road intersections, minimum
access and aisleway widths and availability of necessary public
services (water, sewer, and storm newer) .
1he site plan provides an adequate number of parking spacers to satisfy
tt.e Ccde parking requirements for uses likely to locate in the
proposed flex space buildings (213 spaces provided, or 1 epace per 750
square feet of proposed building area; the Code requires that
warehouse uses be provided with at least 1 parking spaces per 1,000
square feet) . The site plan does not, however, designate handicapped
parking spaces or bicycle parking facilities. The site plan will need
to be revised prior to building permit issuance to provide for a
minimum of 5 appropriately located and sized designated handicapped
parking spaces, as well as 7 bicycle parking spaces within a bicycle
rack.
Ttie site plan satisfies minimum access standards through the provision
of the two proposed access driveways. Code Section 18.108.080.A
requires that industrial use parking areas in excess of 100 parking
spaces be provided with either two 24-foot minimum wide access drives
or one 40-foot wide access d•-ive. One 40-foot vide access driveway to
3W Bonita Road is shown on the plan. Another 49-foot wide access
driveway connection is provided to the former Ted Nelson Steel
Company site. The applicant will need to slow that an easement has
been recorded across the former Ted Nelson Company site to SW 72nd
Avenue, so an to guarantee 72nd Avenue access for the proposed
development.
C. DECISION
The Director's designee approves Site Development Review SDR 90-0014
subject to the following conditions:
