Dear Ben:
The purpose of this letter is to request your assistance in correct-
ing a major defect and omission in the construction of our townhouse
which was completed in 1978.
During moderate rain the downspout in our interior atrium (approxi-
mately 216" by 1010') overflows at the ground level. Investigation
revealed an obstruction in the underground drainage line and unusually
damp so;-'A in the crawl space adjacent to the common foundation wall
separat .nv, uur unit from our neighbor, Mr. and Mrs. Bob Rushford.
The Rushfords have experienced a musty odor and damp carpeting in
their guest be,lroom. Investigation revealed water seeping through a
crack in the common foundation wall , forming ^ puddle of water in
their crawl space which is lower than ours.
Hoping to find the source of this moisture, Bob Rushford and I removed
and reinstalled the sheet metal roof flashing, using a large quantity
of :roofing mastic. We then uncovered the downspout drainage line in
our atrium and found that this work had never been completed. This
downspout terminates in a 3" or 4" piece of unperforated plastic pipe
approximately 10'-0" long and buried approximately 18" below grade.
'This condition is entirely unacceptable because:
1) It does not conform to the Uniform Building Code as adoped
by the City of Tigard.
2) It does not conform to the Oregon Specialty Plumbing Code
as adopted by the City of Tigard.
3) It is not in accordance with the State of Oregon Veteran
Affairs; "Materials and Specifications" form completed by the
Tu.ilatin Development Company, and il*.proved by them and the
writer. 'Phis document states that downspouts are to be con-
nected to storm sewers.

4) If this moisture problem is not corrected, undoubtedly
dry rot wi.li develop resulting in massive structural fail-
tire in both units.
I have discussed this problem with Mr. Ed Wa.den, 9uitding Ofti-Aal,
and Mr. Don-_d Howick, Chief Plans Examiner for t;ie City of 'Tigard,
and they agree with the contents of this let-:er.
Since our unit is insured by the Home Owners Warranty Corporation, we
request that you contact them in accordance with the to:-ms of our policy,
and any others who may have responsibility for correcting this serious
Problem.
