Re: Fill placed-at 12415 SW Beef Bend Road's
This letter regards concerns with the fill permitted and placed at the above referenced
property by the property owner, Dwight Minthorne. The City is unable at this time to
compel Mr. Minthorne to remove the fill which was placed on his privatc properly under
a valid permit from the City of Tigard. I will speak to the issues raised in Clifford
Hamby's letter dated October 22, 1998.
Efficacy of the grading permit:
Pursuant to our Intergovernmental Agreement (IGA), Tigard enforces building
regulatory provisions on private property This includes provisions contained within
Appendix Chapter 33 of the V-94 Uniform wilding Code, which regulates grading on
private property. Section 3313 of this chapter provides that compaction and other
provisions regarding fills may be waived for minor fills not intended to support
structures. Accordingly, Tigard may allow "yard" fills to be placed without requiring
compaction and the extent of grading plans associated with major grading projects.
Section 3309.8 indicates the requirements for grading plans for "regular" grading. They
are: the general vicinity of the proposed site, the limiting dimensions and depth of cut
and fill and the location of any buildings or structures where work is to be performed,
and the location of any buildings or structures within 15 feet of the proposed grading.
Contours are not required as they would be for "engineered" grading We received
plans consistent with these requirements. Further, we require that no drainage way be
obstructed and that an instrument be recorded on the property title to ensure that future
owners are aware of the fill and that no permits for structures are issued without
addressing the fill issue. Often, property owners do not want to record such an
instrument and will choose to place the fill as compacted fill. Mr. Minthorne chose to
record the instrument. Staff informs me that no drainage way has been obstructed and
that the fill conforms with ';ie approved plan. In our judgment, the subject fill qualifies
for the waiver of compaction requirements and can be classified as regular grading in
the code, subject to our conditions. 1-herefore, as described above, the work conforms
to the provisions of the code and therefore the provisions of our IGA

Location of fill:
Your letter indicates that the fill is parl.ially located within the existing right-of-way. We
did not permit the placement of fill in the existing right-of-way. Staff informs me they
observed property pins and have determined that no fill is located in the existing right-
of-way. If the County can demonst;ate that fill has been placed in the existing right-of-
way, the City will take necessary ;action to compel Mr. Minthorne to remove the fill and
restore the existing right-of-way to its original condition.
Your letter also indicates that fill has been placed within the proposed right-of-way.
Until such time as the proposed right-of-way is acquired by the County, the City must
consider that area as private property. We are unaware of any provision which would
encumber that portion of Mr. Minthorne's property. However, if the County can provide
documentation that Mr. Minthorne is prohibited from placing fill material in the proposed
right-of-way, the City will take necessary action to compel Mr. Minthorne to remove the
fill and restore the proposed right-of-way to its original condition.

Washington County will soon begin to mope ahead with the right-of-way acquisition and construction
for the SW 13cef Bend Road improvement project City records indicate that the above referenced
property had a site permit Issued(6/01/98) for 2000 cubic yards of fill material.
It is our understanding that the till material was placed on site without submittal c.fa grading plan or a
soils geological technical report and that the material was not compacted A Field inspection by
Washington County Indicates that a portion of the fill material was placed wtthm the existing/proposed
right of way for SW Beef Bend Road without County approval.
It is our position that the issuance of the perntttls►and placement of the till material does not conform
to The Inter-Govenunental Agreement(IGA)between Washington County and the City of Iigard. that
authorized the transfer of'zoning and Inspection responsibilities to the City of Tigard.
We would respectively request that the City of Tigard remove, or cause to have the owner remove,, all
fill materials placed within the existing/proposed tight of way of SW Beef Bend Road. We would also
ask that the additional request(7"21/98) for a permit for 3000 additional cubic yards of fill material is
not released until this issue is resolved. Che County would expect that a grading plan would be
prepared addressing additional fill material, site drainage areas & road right of way that may he
impacted in accordance with County standards and the IGA as agreed to by the City of'Tigard
