WHEREAS Robert L. Goodrich and Claire B. Goodrich, % Goodrich)
husband and wife, are the owners of the real property de-leribod in
Exhibit "A" and commonly called 11885 S. W. Bull Mountai „ Roadt and
Walter C . Baker and Irene R. Baker, ( Bakes) husband and w1fe, are the
owners of real property d:,scribed in Exhibit "B" and co;;-loniy caller?
11925 S. W. Bull Mountain Road, both In Washington Coun1 % , Oregon.
WHEREAS Baker has paid as consideration of the sum l' NINE
HUNDRED AND N0/100 DOLLARS ($900.00) to the Goodrichs ' contractor for
the specific purpose of increasing the Goodrich private ;:ewer line
from a four inch (411) diameter to a six inch (611) diamett-vo and paid
SIX HUNDRED AND N0/100 DOLLARS x$600.00) to Goodrich for work
performed on the installation of the private sewer line running 220
feet, more or less, from the Liortherly line of the Goodrloh property
to the city sewer on 6Jildwood Avenue. Receipt of the above sums is
hereby acknowledged.
NOW, THEREFORE, IT IS AGREED that both the Goodrich and Baker
parcels of real pro, erty are benefitted by this improvement, (the 6"
diameter common sewer line which runs along an existing deeded
easement) , and serves both properties.
The parties hereto , for themselves, their successors, assigns and
heirs , and all owners of the real property described in Exhibits "A"
and "Ii" promise and agree to share equally the costs of maintaining
the private common 6" diameter sewer line from the northwest corner of
the property described in Exhibit "A" running first easterly, 60 f )et
more or less , then running 220 feet more or less, in a northerly
direction to the connection of the City of Tigard' s 8" sewer bur.` ..d in
Wildwood Avenue, from the time of the connection of their property to
the private common 6" diameter sewer line.
In consideration of the mutual promises herein contained and the
payments already received from Walter C . and Irene Baker, husband and
wife, Robert L. ant' Claire B. Goodrich, husband and wife, (Grantor) ,
grrnt and convey ,o Walter C. and Irene R. Baker, husband and wife,
(Grantee) , their heirs, successors, and assigns, a perpetual non-
exclusive easement to use a strip of land four feet wide, the
northerly boundary line of which is located at the northvt-ist corner of
that property described in Exhibit "A" running in an easterly
direction for sixty feet more or less, until it connects with the
private 5" diameter sewer line running thence northerly 220 feet, more
of less , to the Tigard city sewer buried in Wildwood Avenue.
The terms and conditions of this easement and maintenance
agreement are as follows:
1 . Granteo, his agents, independent contractors and invitees,
shall use the easement strip for a buried underground sewer line only,
and only for access from Grantee ' s property to the city sewer on
Wildwood Avenue , and in conjunction with such use , may construct,
reconstruct, maintain and repair the easement herein granted.

2 . (it-antor reserves the right to use , construct, recons.ruct and
maintain t•he easement and sewer line buried therein and located upon
the easemorit strip .fcr purposes of maintenance of the improvements
located on the real property.
3 . Granter warrants and covenants that they are the owners of
the property described in Exhibit "A" and have the authority to bind
a]-1 the property granted and conveyed for purposes of this easement.
4 . The parties shall cooperate during periods of joint use so
that each party ' s use shall cause a minimum of interference to the
other' s , however, each party shall have the right of contribution , up
to fifty per cent (50%) of cost actually expended in maintaining the
buried sewer line during periods of joint usage.
5 . This easement shall be perpetual .
6. Exhibit "B" is a description of Grantee ' s property, to which
this easement is &.pp>>rtenant. Exhibit "A" is a description of Grantor ' s
property .
