Dear Mr. Beck, This letter is in regards to our telephone conversation today about the storm and sanitary sewer fees for the above ritferenced property. Apparently, your company has been sent a monthly storm/sanitary sewer service bill for the above property which it owns , and the adjacent property which is not owned by your company. The billing records will be changed so that your company will be b1lled for only that portion it owns (the monthly service bills to be sent directly to the above referenced property) . Secondly as I. had stated in my letter of May 30, 1991, the sanitary sewer connection credits for the adjacent property were incorrectly transferred to the above property, on which your company constructed a convenience store/service station. This means that your company will need to pay those connection fees. Please remit payment as described in the attached bill. Unfortunately there .is to be an increase in the fees effective July 1 , 1991, which will require the bill tc be paid prior to that date, or the fee will increase $1600.00. Dear Sir or Madam, There is some information that you made not be aware of,, regarding sanitary sewer connection -yes for your above referenced properties. During the review of plan;A Lor the development of your convenience store/service station, previously paid sanitary sewer fees for the pxi.sting building were credited to the new project. I believe it was t'iought that the existing structure was to be demolished, and as i_ typically done, previously paid sanitary sewer permitfees are credited to re-development of a property. At this point, it means that the existing building does not have any sanitary sewer, fees paid for its connection, and sewer fees will need to be paid for this property. Since the Existing building is vacant, and the sewer fees are based on the number and type of plumbing fixtures used, these fees can be deferred until the building is re-occupied, and the number of fixtures to be utilized is known. I do want to point out that the sewer fees have a tendency to increase on a yearly basis, and will in fact will be increasing July 1, 1991. If you knew what the building is to be used for, you may wish to consider paying for some or all of the fees prior to July 1, 1991. 1 regret any inconvenience that this may cause. The City has reviewed the proposed solutions and presents the following interpretation of the Community Development Code. 1) Section 18. 114. 130 (C) ( 1) (a) (ii..i.) ( 1) states: The sign area may be increased one square foot for each lineal foot the sign is moved back from the property line to which the sign is adjacent. 2) Section 18. 114 . 130 (C) (1) (a) (ii.i) ( 1) states: The sign area may be increased one square foot for each lineal foot the sign is moved back from the front property line to which the sign is adjacent. If the street is curbed and paved, the measurement may be taken from a point which is 15 feet from the pavement. This increase in sign area is limited to a maximum of 90 square feet per sign face or a total of 180 square feet for all faces. With reference to item ( 1) above, the proposed freestanding sign may be constructed to a height of 2.2 feet provided there ie a 20 foot minimum setback from the property lines which abut both SW Bull. Mountain Road and SW Pacific Highway; as demonstrated on the site plan submitted on December 13, 1990. With reference to item (2) , the Planning Department defines "pavement" as an approved imnerm(*abl.e surface properly located in 13125 SW Hall Blvd.,P.O.Box 23397,Tigard,Oregon 97223 (503)639-4171 -- the public right-of-way (this includes sidewalks) . The City allows the applicant to choose the method of measurement between the two options provided. However, since SW Pacific Highway is not curbed, this option of beginning the measurement from a point 15 feet xrom the p )vement is not applicable. Therefore, in order for the sign area to be increased an additional 17 square feet per sign face (from 70 square feet to 87 square feet.) the sign shall be placed a minimum of 17 lineal feet from the two adjacent property lines. Thus, the 20 foot setback from both the SW Pacific Highway and SW Buil Mountain property lines, whi--h will be provided to meet the height increase setbacks, shall be applied here. This measurement shall be sufficient to meet the requirements of the portion of the Code which addresses the process for obtaining a net increase in sign face area. in sum, a sign permit shall be issued for a freestanding sign which shall be 22 feet in height and 87 square feet per sign face ( 174 total square feet for all .sign faces) . We have reviewed the decision with Texaco and while we cannot agree with the decision, we do feel that we have a solution to the impasse. The City of Tigard Code (Section 18 . 114 . 130) (C) (1) (a) (iii) (1) anct (Section 18 . 114 . 130) (C) (1) (a) (iv) (1) states : The !�.ign area may be increased one square foot for each lineal tout the sign is moved back from the front property line to which the sign is adjacent . If the street is curbed and paved, the measurement may be taken from a point which is 15 feet from the pavement . This increase in sign area is limited to a maximum of 90 square feet per face or a total of 1.80 square feet for all faces . and Freestanding signs located nest to the public right- of-way shall not exceed 20 feet in height . Height may be increased one foot in height for each 10 feet of setback from the property line or a point 1.5 feet from the pavement , whichever is less , to a maximum of 22 feet in height . In the permit application that was submitted, the applicant felt that SW Bull Mt . Road was the street that the ;-service .staticn fronted . However the City indicated that the code applies to both SW Bull Mt . Road and SW Pacific Highway. Although we do not I I i t agree with this assertion, we are willing to work witn it to expedite this applicati(7:i . It should be pointed out C-at neither SO Bull Mt . Road or. SW Pacific Highway is curbed and paved at this time. However, as a condition of this improvement Froject SW Bull Mt . Road will be curbed and paved upon the projection's completi •.n. Presuming that this is the case, accordinj to the code previously cited, Texaco has the option of ear%cti:ig a freestanding sign up to 90 square feet in area by ) ocating thl sign 20 feet back from the property line. The Code states that "the measurement may be taker, (emphasis added) from a point which is 15 feet from the pavement . " The term "may be taken" indicates an option of where tv measure from. Zt does not indicate that it "must (emF:-.asis added) �)e taken" from that location. To interpret that it "must be taken" t•iould imply that the sign must also be erected 22 feet in height because it is setback from the property line by 2C feet (i . e. the i "Height may be increased one foot . . . ") . n Because it is an option, Texaco has elected to set the sign back 20 lineal feet from bot.o the SW Bull Mt . Road and SW Pacific Highway property lines to comply with the City's interpretation that the service station fronts each road. Therefore we do not aqree with the City that the sign must be a minimum of 32 lineal feet from SW Bull Mt . Road and SW Pacific Highway . This stance is tarther justified as SW Pacific Highway is not curbed and paved. Si-ilarl,y, the section of the code that reters to height limits indicate that "Height may be increased cne foot in height for. each 10 feet of sei.back from the property line or ("mpliasis added) a point : 5 feet, from the edge of pavement , whichever is less . . . " As 10 feet of setback is less than 15 feet from "edge of pavement , " it is felt that the code clearly indicates that the measurement is to be taken from the property line. Ne also believe that the intent of the code is to measure the payerrent from the street pavement (i . e. curb) and not the closest impermeable sl+rface, the sidewalk . As you will see from the material enclosed, the five canopy signs have been approved. The City has a concern with issuing the sign permit for the freestanding sign as submitted. Through the initial review at the front counter all of the signs seemed to be in conformance with all City codas. However upon a more detailed review of the application materials prior to permit approval, it is clear that the sign face area of the freestanding sf.gn is too lr-..yc. Additionally, the increase in the height of this sign is not accelptable as proposed. The 20 foot setback which allows for an increased sign height of 22 feet applies to the property line abutting SW Pacific Highway as well as SW Bull Mountain Road. Therefore, to obtain the additional two feet in height, the freestanding sign shall be setback 20 feet from both SW Bull Mountain Road and SW Pacific Highway. Permit Consulting Service applied for a Sign Code Exception on behalf of Texaco Marketing in September 1990. The Final. Order from the Planning Commission (November 20, 1.990) states: "The Commission finds that additional sign area is appropriate in accordance with exception criteria three which allows for an additional 25% increase in sign size (87.5 square feet per sign face) . However, in order to retain consistency with the purpose of the code, the sixth criteria shall be employed to prohibit the use of signs or identification on the canopy. These signs would simply be redundant with a freestanding sign visible from both directions on Pacific Highway and inconsistent with the propose of the sign code to 'prevent proliferation of signs and sign clutter' . " 13125 SW Hal!Blvd.,P.O.Box 23197,Tigard,Oregon 97223 (503)X539-4171 Sign Permit application SGN 90-0122 requests a freestanding sign with a sign area of 87 square feet per sign face ( 174 square feet total) . This has been requested in combination with five canopy signs. This combination was prohib?.ted by Final Order 90-24-PC; a portion of which is quoted above. For the City to approve a sign permit for the freestanding sign, a sign drawing must be submitted which demonstrates a total combined sign area of 70 square feet per sign face ( 140 square feet total) . As an alternative, the City may approve the currently proposed height increase if the site plan demonstrates a 20 foot setback from both SW Bull Mountain Road and SW Pacific Highway. Additionally, the City may appru;e an area increase provided the sign meets the following standard: "The :zign area may be increased one square foot for each lineal foot the sign is moved back from the front property line to which the sign is adjacent. If the street is curbed and paved, the measurement may be taken from a point which is 15 feet from the pavement. This increase in sign area is limited to a maximum of 90 square feet per face or a total of 180 square feet for all faces. " (Section 18. 114 . 130) (C) ( 1) (a) (iii.) ( 1) Since the subject site fronts a major intersection and abuts both SW Bull Mountain Road and SW Pacific Highway the "front property line" which is referenced above shall be interpreted as both SW Bull Mountain Road and SW Pacific Highway. Therefore, to obtain approval of a freestanding sign with a sign face area car: 87 square feet, the setback from both SW Bull Mountain Road and SW Pacific Highway shall be a minimum of 32 lineal feet. The remaining alternative would be to exercise the option provided by the Planning Commission by installing a freestanding sign with a maximum sign face area of 87 .5 feet ( 175 square feet for all sign faces combined) and with a maximum sign height of 30 feet. This sign shall be located 22 back from the property lines which abut SW Bull Mountain Road and SW Pacific Highway. If the option provided by the Planning Commission is exercised, the approval for the five canopy signs shall be withdrawn prior to approval of the freestanding sign. Additionally, the fee amounts charged by the City of Tigard for the current sign permit applications were incorrect. "]Permit Consulting Service paid a total of $95.00 on November 26, 1990 for these permits as the City had requested. Hc,wever, the correct amount should have been $115.00. Sign permit fees are based upon the following assessment: Zero to 24 square feet - $10.00; 24 to 100 square feet - $25.00; 100 or more square feet - $35.00.
