Dear 1Ir. Rule:
It nas been brought to my attention by Ed Walden, Building, official,
that thero has ')een an error in the con�itruction of a house on Lot 183
of i:nglewood No. 3. This error is on the south portion of the lot
phare the corner of the house is 1.8 feet from the property line, where
20 fee&, is required. The Tigard Code requiros a front yard setback of
2U feat, this setback being; applicable to any portion of the yard ad-•
jac,3nt a public rig -lit -of -way.
While this error represents a small infraction of ti.e City's front
yard setback rule and in they light that you were confused as to the
correct location of the street right-of-way line, the house as con-
structed, may be considered acceptable by the City's zoning setback
standards.
I have chosen to find in your favor in this matter because in no in-
stance does the public health, safety, and welfare appear to be in
Jeopardy, and the remedy (moving the house) appe2rs inappropriate for
the negligible benefit which would be derived.
