Leach, Robert Gray Partners FROM: Jim Duckett, Development Services DATE: December 21, 1995 SUBJECT: 8900 SW Commercial Dear Russell, I am in receipt of your memo which was telefaxed over on December 20, 1995 afternoon referencing the building located at 8900 SW Commercial. Your memo indicated there were more plumbing fixtures in the building than my research indicated. Since my research primarily involved investigating building department files, I was able to verify the existence of the toilets and lavatory sinks but was unable to verify the existence of the other fixtures you indicated. Since the building department files did not contain information to support your claim, I have contacted the water department to request they research the sewer EDU billing history on the building. I believe the water department can help resolve this matter for several reasons. Since the water department receives information from the building department permits, we can find out whether the other fixtures you indicated ever affected the sewer EDU count. If the water department indicates the EDU count was set at two prior to the fire and one subsequent to the fire, I could easily justify granting you the credits for the new plumbing fixtures. Since all buildings are at least credited with one EDU, it would stand to reason the water department "zeroed" out the account due to the fire and you Would definitely deserve the two EDU credits. If the wPter department indicates the EDU count was set at one prior to the fire and one subsequent to the fire, it would support the building dopartment's information and leave you with only one EDU credit. The water department personnel I spoke with a few moments ago indicated she will contact the city records personnel to request a historical research into the billing records for the building. The initial estimate for a definitive finding is I-1ter this afternoon or early tomorrow morning. As soon as I receive an answer from the water department as to the historical billing, I will provide you with a decision as to whether the building has one or two EDU credits. A copy of the structural analysis done by Nicoli Engineering and a copy of any forensic testing done by Carlson Testing, Inc. , which substantiate the bracing currently in place (I have not seen, nor do we have a record of this . Also I am hesitant to use the recent moderate earthquake as a "load test" to establish t:ie integrity of the existing walls . ) . 2 . Further securing of the building from unauthorized entry. Commercial St. Dear Mr. Scott: I am responding to your request of Dean Brown to update our progress or in this case lack of progress, in repairing fire damage and renovating the property as outlined in our drawings prepared in 1992. As you know we had a pre-application conference on Oetob,,r 17, 1991. Following that meeting we prepared the above mentioned plane, in preparation for a design review application. As a result of Mr. Brown's Level 1 survey for hazardous materials, further testing was required by the DELI. Because of the long test & report timetable of the DEB. Mr. Brown had Robert Gray Partners, Inc. remove the fire damaged portioi. of the building b withheld the design review application. The building department subsequently questioned the stability of the cement masonry unit wall on Commercial Street. As a result Mr. Brown employed Carlson Testing, Itic. and Nicoli Engineering to analyze and recommend a reasonable temporary shoring solution. As a result (3) braces were installed. The wall and bracing were subjected to lateral forces of a 5. 4 intensity earthquake without damage or failure. It is reasonable to conclude that the shoring is sound. It is my understanding that in spite of the circumstances causing delay and in spite of the proven stability of the braced wall - the City would like to indu=e some progress toward full structt:.ral integrity. The remaining portions of the building appear to be structurally safe to exterior exposures. As lung as the building is not occupied, no apparent hazard exists. The Building code as adopted in Title 14, TMC, does not apply to existing buildings. Title 14, Chapter 14.16, Abatement of Dangerous Buildings, may contain the only language which may be usable in this instance. Section (2) (R) of the Chapter states "Whenever the building or structure has been so damaged by fire, wind, earthquake or flood, or has become so dilapidated or deteriorated as to become !i) an attractive nuisance to children; (ii) a harbor for vagrants, criminals or immoral persons; or an to (iii) enable persons to resort thereto for the purpose of committing unlawful or immoral acts;". We might, under this section and other sections, be able to declare that the building must be repaired or removed. That process would have to start with a Civil Infraction notice. The procedure for the action is stated in section 14.16.070. Section (2) (L) may also apply, but would no doubt entail considerable legal action. George and I have dot,:rmined, after considerable review, that the most we can do is require the building be secured against entry and be posted as unsafe to occupy In accordance with Section 14.16.050. Such action would at lerst inform the building owners that a serious problem exists, and may motivs'ce them to take more positive action. Thanks. -41 a-b k 14.16.010--14.16.020 1, verify design assumptions and then to take appropriate action to provide for public safety, is the EOR. E. Duties and responsibilities . The general inspection report procedures of these administrative rules, are also required of the EOR. At the conclusion of the work the EOR shall submit a letter indicating that the work was observed to have been performed in general compliance with the ap- proved permit documents and design assumptions. The specific scope of the site observations are outlined in the permit documents as required by the city and are re- viewed at the preconstruction conferences. Monitoring of construction does not necessarily have to be "continuous" but should be performed on a regular basis so that close interac- tion and coordination exists between the EOR, the contractor, the inspection/testing agency (where applicable) and the city. The city q city may reuire the EOR to submit a proposal for the anticipated frequency of observations . The EOR shall monitor the inspection/testing agency's special inspections . This should not be construed to relieve the inspection/testing agency of its obligations according to Title 24, but is intended to assist the city in the monitor- ing of the quality control provisions for the project. The EOR and special inspector should meet on a regular basis to review the progress of the work and the quality con- trol provisions of the project and to discuss the pending inspections. The EOR should be available, as required, for prof-ssional consultation. The EOR shall review and evaluate the special inspector's inspection and thbir test reports. (2) Dangerous Building. A "dangerous building or structure" is one which has any or all of the following conditions or defects provided that the condition or defect exists to the extent that the life, health, property or safety of the public or the occupants of the building are endangered: (A) Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient width or size, or is not so arranged as to provide safe and adequate means of exit in case of fire or panic; (B) Whenever the stress i:1 any materials, member or portion thereof, due to all dead and live loads, is more than one and one-half times the working stress or stresses allowed in the State Building Code for new buildinya of similar structure, purpose or location; (C) Whenever arty portion thereof has been damaged by fire, earthquake, wind, flood, or by any other cause, to Duch an extent that the structural strength or stability !reof is materially less than it was before such catas- trophe and is less than the minimum requirements of the building code ordinance (Chapter 1.4.04 of this code) for new buildings of similar structure, purpose or location; (D) Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached or dis- lodged, or to collapse and thereby injure persons or damage property; (E) Whenever any portion of a building, or any member, appurtenance or ornamentation on the exterior there- of is not of sufficient strength or stability, or is not so anchored, attached or fastened in place so as to be capable of resisting a wind pressure of one-half of that specified in the building code ordinance (Chapter 14 .04 of this code) , for new buildings of similar structure, purpose or location without exceeding the working stresses permitted in the building code ordinance for such buildings; (F) Whenever any portion thereof has cra •ked, buckled or settled to such an extent that walls or other structural portions have materially less resistance to winds or earthquakes than is required in the case of similar new construction; (G) Whenever the building or structure, or any portion thereof, because of (i) dilapidation, deterioration, or decay; (ii) faulty construction; (iii) the removal, move- ment or instability of any portion of the ground necessary for the purpose of supporting such building; (iv) the deterioration, decay or inadequacy of its founda- tion; or (v) any other cause, is likely to partially or com- pletely collapse; t 176 (Tigard 11/15/86) 14.16.020 (H) Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe for the purpose for which it is being used; (I) Whenever the exterior walls or other vertical structural members list, lean or buckle to such an extent that a plumb line passing through the center of grav ty does not fall inside the middle one-third of the base; (J) Whenever the building or structure, exclusive of the foundation, shows thirty-three percent or more damage or deterioration of its supporting member or members, or fifty percent damage or deterioration of its nonsupporting members, enclosing or outside aaylu or coverings; (K) Whenever the build4ag or structure has been so damaged by fire, wind, earthqu;ke or flood, or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort thereto for the purpose of committing unlawful or immoral acts; (L) Whenever any building or structure has been constructed, exists or is maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by the building regulations of this city, as specified in the building code ordinance (Chapter 14 .04 of this code) , or of any law or ordinance of this state or city relating to the condition, location, or structure of buildings; (M) Whenever any building or structure which, whether or not erected in accordance with all applicable law_ and ordinances, has in any nonsupporting part, member or portion, less than fifty percent, or in any supporting part, member or portion less than sixty-six percent of the (i) strength, (ii) fire-resis:..ing qualities or character- istics, or (iii) weather-r-sisting qualities or ^haracter- istics required by law in the case of a newly constructed building of like area, height and occupancy in the same .location; (N) Whenever a building or structure, used or in- tended to be used for dwelling purposes, because of inade- quate maintenance, dilapidated condition, decay, damage, faulty construction or arrangement, inadequate light, air or san;.tation facilities, or otherwise, is determined by the building official to be unsanitary, unfit for human habit- ation or in such a condition that is likely to cause sick- ness or disease; (0) Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration, damage, inadequate exits, lack of sufficient fire-resistive con- struction, faulty electric wiring, gas connections or heat- ing apparatus, or other cause, is determined by the fire marshal to be a fire hazard; 177 (Tigard 11/15/86; 14. 16.030--14. 16.040 (P) Whene-✓er any portion of a building or structure 1 remains on a site after the demolition or destruction of the building or structure or whe Iver any building or structure is abandoned for a period in excess of six months so as to constitute such building or portion thereof an attractive nuisance or hazard to the public; (Q) A building or structure that, for the want of proper repairs, or by reason of age and dilapidated condi- tion, by reason of poorly installed electrical wiring or equipment, defective chimney, defective gas connection, de- fective heating apparatus, or for any other cause or reason, is especially liable to cause a fire; (R) A building or structure containing combustible or explosive material, rubbish, rags, waste, oils, gasoline or flammable substance of any kind, especially liable to cause a fire or danger to the safety of she building, prem- ises, or to human life. (3) Fire Marshal. "Fire marshal" means the chief of the fire district designated to administer the Uniform Fire Code in the area where the dangerous building is located. (4) Owner. "Owner" means record holder of legal title or where real property is being purchased through a lender or by a recorded land sale contract, the purchaser who holds equitable title. (Ord. 86-53 S5 (Exhibit D 52) , 1986) 14. 16.030 Responsibility. For the purposes of this chapter, the owner shall be the "person responsible" for purposes of enforcement. (Ord. 86-53 S5 (Exhibit D S4) , 1986) f14 16.040 Statement of actions required. (a) In sit- uations where there are both a legal title holder and an equitable title holder, a copy of the notice shall be mailed by certified mail, return receipt requested, to the legal l title holder. (b) A statement of the action required to cure or remedy the condition shall include the following: (1) If the building official has determined that the building or structure must be repaired, the order shall require that all required permits be secured and the work physically commenced within such time from the date of the order and completed within such time as the building offi- cial shall determine is reasonable under all of the circum- stances. (2) If the building official has d%.termined that the building or structure must be vacated, the order shall require that the building or structure shall, be vacated within a time certain froo the date of the order as deter- mined by the building official to be reasonable . (3) If the building official has determined that (a) the building or structure is vacant, (b) that building 178 (Tigard 7;15/87) 14. 16.050 or struo+-ure is structurally sound and does not present a fire hazard, and (c) the building or structure has presented or is likely to present a danger to individuals who may en- ter the building or structure even though they are unauthor- ized to do so, the order shall require that the building or structure be secured against unauthorized entry by means which may include but are not limited to the boarding up of doors and windows. (4) If, after a building or structure is secured pursuant to Section 14.16.040 (b) (3) , the building official determines that such security measures are rendered inef- fective by repeated vandalism or otherwise, and if the building official has thereby determined that the building or structure must be demolished, the order shall be in ac- cordnace with Sections 14. 16.040 (b) (5) and 14. 16.040 (b) (6) . (5) If the building official has determined that the building or structure must be demolished, the order shall require that the building be vacated within such time as the building official shall determine is reasonable from the date of the order; that all required permits be secured from the date of the order, and that the demolition be com- pleted within such time as the building official shall de- termine is reasonable. (6) Statements advising that if any required repair or demolition work (without vacation also being required) is not commenced within the time specified, the building offi- cial will :order the building vacated and posted to prevent further occupancy until the work is completed, and may pro- ceed to cause the work to be done and charge the costs there- of aVAinst the property or its owners.
