Attached to this memo you will find a copy of the April 3, 1992
letter which authorized release of a portion of the perfomance
assurance bond held by Key Bank for Suphap T. Dibbayawan. As you
recall, we held a portion of the funds as assurance that the
landscaping would be completed.
The: purpose of this memo is to let you know that the landscaping
has been completed to the City's satisfaction and the $4,406 .00 may I
be released.
Thanks for your help in coordinating this project and its
completion.

held by Key Bank of Oregon, A/C No . 006041329559 . .4owever, I
would also like you to transfer a portion of the fund from the
said account to be held by the City of Tigard as security for
landscaping improvements .
Enclosed please find a cost estimate of required landscaping
improvements for the amount of $4, 406 . ( Sprinkler system is not
part of the requirement . )

Per out meeting last week, the City of Tigard will install the new
storm sewer line within the easement between commercial street and
the outfall . Th.e City will perform the following work :
1 . Dig the trench, install the pe, and backfill the
trench.
2 . T.V. section from manhole to outfall .
T-Scandia will be responsible for the following:
1 . Furnish the pipe .
2 . Furnish the backfill material .
3 . Removal of any excess material from the site .
4 . Provide a minimum two weeks notice for the City Crews to
perform the work.
5 . Final surfacing (provide materials and perform
i.nstailation) .

SUBJECT: SDR 91-0004 (Dibbayawan/Scandia Motors)
On November 1 , 1991 , I spoke with Regina Dibbayawan about the 24"
storm drain line required at the subject project . She was
concerned about the cost of the line, alleging that the City had
previously indicated that they could hook to an existing 24" line
in a differant location but that the line turned out not to exist .
Some time after they began work on the site, they learned of the
additional expense required to bring the storm drain system to
standards .
I discussed the situation with Chris Davies and read the SDR
Decision and report . it appears that the information provided to
the applicant at the time of. the SDR decision was very misleading.
First , th^ as-built drawings for thin location have proven to be
extraordinarily inaccurate. Second, the SDR report provided
inaccurate information, wherein comments from Operations indicate
that a 24" line existed at the east end of the property and
recommending that the applicant connect to the line to avoid work
in Commercial Street ; subsequent investigation indicates that the +
24" line does not exist .
Due to the unusual situation in which incorrect City records and
incorrect interpretation of records by staff have caused the
applicant to proceed with a project without knowledge of the full
costs of the project , we (Chris , Cliff Scott and I) have agreed
that it is appropriate for the City to share a portion of the cost
of replacing an existing non-standard 10" line .
Therefore , today I called Ms . Dibbayawan and offered to assist in
two ways :
1 . If Scandia supplies the materials (pipe and gravel) , the City
will install the portion of the new storm drain pipe crossing their
property (the portion between the street and the railroad --
approximately 160 feet) . Installation of the storm drain within
Commercial Street would still b the responsibility of Scandia .
2. Upon completion of the project: when all costs are known, she
could apply for creation of a .reimbursement district , requiring the
adjoining property owner to repay a share of the cost at the time
of future development . d=
She is going to explore this offer with her engineer and her
contractor. She will coordinate any shared work with Chris Davies .

institution) , a loan commitment in the amount of $18, 021.00 to finance
public street and sewer improvements located in the City of Tigard,
Oregon, said improvements being located at 8830 & 60 S.W. Commercial
Street . This loan commitment is specifically for construction purposes
and the improvements are to be completed in conformity with City approved
construction plans and the street opening permit thereinregard.
I have agreed that disbursements of. the $18, 021.00 will be made in accord
with the following schedule upon completion of each, or all, item(s) ; but
not including the hold-back described below.

SUBJECT: T. Scandia Motors
You know how the saying goes about working for the City that people
view you as "the City" no matter what your job is. . . . . . .
Background
Monday, September 9 , 1991 I called T. Scandia Motors to make an
appointment to have my car serviced. After making the appointment,
Toni in the office said, "we've been meaning to ask you wha , you do
for the City to see if you could help us?" I told them what I do
and asked what the problem was.
Toni proceeded to tell me about their frustrations dealing with the
City on their new building. Specifically, that they couldn't get
any time commitments out of Jim Jaqua and Chris Davies and in
general were feeling as though Jim and Chris had been unresponsive.
They have been hoping to get the foundation poured before the bad
weather hits but have not been able to get approval to proceed.
Needless to say the tone of the conversation was frustration and
skepticism in dealing with what Toni termed "the epitomy of
government bureaucrats. " I told them I would let Chris and Jim
know their concerns and that they would get back to them.
I sent Chris a note since he was here but held Jim's until he
returned from his conference.
September 10, 1991•
I talked with Chris who responded to my E-Mail and he told me he
needed to call their engineering firm. He said he would call and
get back to T. Scandia.
Regina from T. Scandia called me later in the morning. I turned
the message over to Vi who said she was aware of their plans and
had talked with Regina in the past. I told Vi I really wasn't the
right person to handle this and asked if she would follow-up. She
said she needed to call them anyway and tell them the concrete
permit was ready.

I dropped my car off. While in the office, Regina gave me a copy
of her notes regarding the timeline on their project. I told her
I would pass them on to the Department Heads in Building and
Engineering.
So, here's their memo outlining the process to date. I will pick
my car up this evening and tell them that I passed the memo along
to the four of you.

70/91 Denali Engineering submitted a plan , for public
utilities improvement to Chris Davies .
8/?/91 Chris Davies requested street profile showing 300 feet
of S.W. Commercial St. Revised was submitted about a
week later . A question regarding a storm line that
runs through the property came up . Engineer sent out.

8/ 19/91 A letter from Jim Jaqua to J .E . Krause requesting
detail information . After a week had passed , J .E.
Krause still was not able to get. a held of Jim Jaqua to
clarify his letter .

8/23/91 Talked to Denali Engr . City of Tigard was still
looking for the storm ! ine in question .
8/29/91 J .F. Krause sent in his revision to Jim Jaqua . Talked
to Denali Engr. They found the storm line but, there
was a problem to the line . It was not constructed per
plan and the connection was done incorrectly . City of
Tigard must do the correction . According to Denali ,
Chris Davies was supposed to find out what should be
done . Denali asked if we can have foundation permit
before the utilities correction is completed . Chris
said tie will checked into it .
9/3/91 Talked to Jim Jaqua to see hoc- things were going . Did
not received any confirmation . Submitted electrical
calculation and mechanical plpn to Jim Jaqua . I was
told that a foundation permit may be issued at the ens'
of the week .

The subject site was included as part of they original
City of Tigard incorForation which was recorded
September 11, 1961. This land was originally divided
as pfirt of the Morin's Addition Subdivision ofor ayt27,

Thee subject parcel is bordered on all sides by
praperties which are zoned Central Business District
(CBD) . Magno FIumphries .liras directly to the southeast
of the subject site. Immediately to the northwest of
the site is an office/warehouse building which was last
occupied by Pacific Red Lion. Directly to the
sc�uthwest lies the southern The property Pacific railroad to the

3. Site Information and Proposal Description
Tho site is presently undeve)oped. There are currently
seven near mature deciduous trees located along the

back of the property. The site is covered with a
variety of low lying natural. grasses.
The applicant requests Site Development Review approval
to allow the construction of an approximately 9,250
square foot automobile repair facility with an office.
This development is proposed to provide 24 parking
spaces located along the northwest and southeast
portions of the site. The applicant proposes 15. 18
percent landscaping coverage with four Flowering
Dogwoods to be located along the street frontage of the
site. Ten Mugo Pines will also be located on the
interior portion of the site.
4. Agency and NPO Comments
The Engineering Division has reviewed tho request and
provides the following comments:
1. Streets: The site fronts S.W. Commercial Street
which is classified as a minor collector and is
within the Central Business District which
requires a 60 foot right-of-way, with a pavement
width of 40 feet and 5 foot sidewalks. This site
currently has no improvements and bhould be
required to install standard half-street
improvements.
2. Sanitary Sewer: The site currently has a 10 inch
sanitary sewer line .located in SW Commercial
Street along the frontage of the property. This
line is adequate to serve the site. In addition,
there is an existing 12 inch sanitary sewer lin-
that .runs along the westerly property line within
a 20 foot easement which is also adequate to
serve the site.
3. Storm Sewer: The site has a existing 10 inch
storm drainage line that runs along the front of
the site and then crosses along the westerly,
portion of the property. Based on the
information in the Engineering Department's "as•-
built" file there is a 60 foot wide easement for
the storm drainage system which appears to start
from the westerly edge of T.L. 1202 . In
addition, based on the plan that was submitted by
the, applicant, it appears that the proposed
building does not encroach upon this easement.
The Unified Sewerage Agency has established and
the City has agreed to enforce, (resolution No.
90-43) Surface Water Management Regulations

maintenance burden to the City. Furthermore, the
applicant has not proposed any such facilities
and there are no natural depressions or other
areas of this site that are particularly
suitable for water quality such facilities.
Regional facilities, funded by fees-in-lieu of
construction of these facilities, would provide
the required treatment with improved reliability
and less maintenance. Consequently a fee-in-lieu
of the construction of on-site water quality
facilities should be assessed.
4. Traffic Impact Fee (TIF) : Washington County has
established, and the City has agreed to enforce,
(Resolution No. 90-65) Traffic Impact. Fees . The
purpose of the fee ; s to ensure that new
development contribut(!s to extra-capacity
transportation impro.amer.ts needed to accommodate
additional traffic generated by .such L velopment.
The applicant shall be ia,;uired to pay the fee.
Based on the applicants submittal, there
currently iR no identified use for trip
determination as outlined in the Traffic Impact
Fee Procedures Manual. Therefore, the fee shall
be based on either actual trip generation of a
same or similar use verified by a registered
engineer or on a use most similar in traffic
generation as determined in Appendix "A" of the
Traffic Impact Fee Procedures Manual.
The City of Tigard Building Department has reviewed
this proposal and has offered the following comments:
The shop area will be constructed as an H-4
occupancy (as per State Building Code) and should
be designed as such.
The Tualatin Valley Fire and Rescue District has
reviewed the proposal and has the following comments:
This structure will exceed the allowable fire
flow of 3,000 GPM. The structure will either
require upgrading, subdividing or protection with
automatic sprinklers. Hydrant location approval
will be coordinated with Tigard Water District.

The City of Tigard Field Operations Division has
reviewed this proposal aad offers the following
comment:
The site plan indicates a proposed connection to
the storm sewer located in the front of the site
and crossing SW Commercial Street. Operations
proposes connecting to the 24 inch storm sewer
line which runs along the east side of the site,
thereby eliminating the need to cross SW
Commercial.
The City of Tigard Parks Maintenance Division, Tigard
Water District, General Telephone, and Portland General
Electric have reviewed the proposal and have issued no
comments or objections.
No other comments have been received.
B. ANALYSIS AND CONCLUSION
Code Section 12 .66 .050(A) (4) (Central Business District) of.
the Community oevelopment Code (CDC) allows a maximum
building height of 80 feet. The height of the automotive
repair facility and office is proposed to be approximately
27 feet and therefore is within the building height allowed
in this zoning district.
The CBD zoning district requires a 30 foot minimum setback
where a commercial use abuts a residential zoning district.
This development does not abut a residential zoning district
on any side and therefore no setback requirements apply to
this site.
The applicant has indicated that approximately 7, 150 square
feet of the building will be used for the repair of
automobiles. The balance of the building (approximately
2, 100 square feet) will be available for office, lunchroom,
parts storage, and customer service uses. These uses are
classified in Cade Section 13.42 (Use Classifications) as
Automotive and Equipment: Repairs, Light Equipment) . Under
this classification the parking requirement of Automotive
Repair requires one parking space for every 500 square feet
of gross floor area. The proposed building's size of
approximately 9,250 square feet necessitates a minimum of 19
vehicular parking spaces . The site plan proposes 24 parking
spaces and therefore provides an adequate number of parking
spaces which satisfies the code requirements for this
proposed use.

State of Oregon House Bill 2084, which became effective
September 1, iy90, requires two disabled persoi, parking
spaces if 26 to 50 parking spaces are provided. The
proposed plan provides for one disabled person parking
space. Therefore, this code requirement is satisfied.
The site plan does not indicate an allocation of space for
the provision of bicycle parking. Code Section 18. 106 (P)
requires one bicycle parking space for each 15 vehicular
parking spaces in any development. Therefore, space for two
bicycles shall be provided. Therefore, this code standard
has not been satisfied. Subsequently , the site plan should
be .revised to provide for the requir A two bicycle parking
spaces.
The site meets the minimum access standards through the
provision of one 30 foot wide a(-,cess driveway from SW 72nd
1►venue. Code Section 18. 108.080(A) requires that commercial
u.se parking areas with less than 100 parking spaces be
provided with one access drive with a minimum access width
of 30 feet. The accessway must be paved to a minimum width
of 24 feet. The applicant is proposing d 40 foot wide
accessway and therefore surpasses this access requirement.
Code Section 18. 108 .050 requires that a walkway extend from
-the ground floor entrances or from the ground floor landing
of stairs of all commercial ar.d industrial uses, to the
istreets which provide the required access and egress. The
proposed site plan does not indicate that a walkway has been
provided. Therefore, the si.te plan should be revised to
provide the required pedestrian v-alkway.
Code Section 18 . 100. 110 (Screening: Special Provisions)
states that trees shall be planted in landscaped islands in
all parking areas, and shall be equally distributed and on
the basis on one tree for each seven parl.ing spaces in order
to provide a canopy effect. The proposed landb�•;aping plan i
has approximated this placement by providing .five interior
parking lot trees whereas the Code only requires four
parkinci lot trees for a parking lot of this capacity.
Developments within the CBD zoning district are required to i
provide a minimum of 15% landscaping on the site. Of the
approximately 25, 110 square foot site, the applicant has
proposed to landscape 3,812 square feet. This surpasses the
minimum landscaping requirement by providing approximately
15,. 18 percent landscaping whereas the Code requires only
3, 767 square feet for this site.
Section 18. 102 (Visual Clearance Areas) requires that a
clear vision area shall be maintained on the corners of all
property adjacent to intersecting right-of-ways or the

intersection of a public street and a private driveway. A
clear vision area shall contain no vehicle, hedge, planting,
fence, wall structure, or temporary or permanei,�t obstruction
exceeding 3 feet in height; except that obstructions which
may be located in this area shall be visually clear between
3 and 8 feet in height (trees may be placed within this area
provided all branches below 8 feet are removed) . Visual
clearance areas shall be that triangular area formed by
measuring a 30 foot distance along each of the right-of-way
or property lines and then connecting these two 30 foot
distance points with a straight line. The proposed
landscaping plan identifies Flowering Dogwood trees as the
suggested street trees. Although this tree is a good
aesthetic choice for this site, the relatively short stature
of these trees does provide some conc:-?rn with the compliance
of the vision clearance area. Therefore, alternative trees
should be proposed to replace the dogwoods which are within
the vision clearance area.
In addition to being zoned CBD, this site is also within the
City-Is Action Area overlay zone. Code Section 10.86 .030
st*.ates that outdoor storage of materials, products, or
supplies is prohibited for new development within the
overlay zone area. TLerefore, there shall be no outdoor
storage of these items, incI.uding the long-term storage of
op:ttable or inoperable vehicles, on the premises .
C. DECISION
Based upon the above findings and conclusions, the Planning
Director's designee hereby APPROVES Site Development Review
SDR 91-0004 subject to the following conditions:

3. Standard street improvements, including concrete
sidewalk, driveway apron, curb, asphaltic concrete
pavement, sanitary sewer, storm drainage, streetlights,
and underground utilities shall be installed along the
S.W. Commercial Street frontage. Improvements shall be
designed and constructed to minor collector street
standards and shall conform to the alignment of
existing adjacent improvements or to an alignment
approved by the Engineering Department. The
Engineering Department shall make a final determ,tnation
an to what alignment, based on information provided by
the applicant and City Standards, the improvements
shall be built to.

5. As part of the improvement plans the applicant shall
submit: details and calculations that show the change in
the amount of impervious surface area created by this
development. In addition, the fee-in-lieu for water
quality shall be paid.
6 . The applicant shall pay the Traffic Impact Fees (TIF)
prior to the issuance of a Building Permit. The actual
TIF will be based on either actual trip generation of
a same or similar use verified by a registered engineer
or by a use listed in Appendix 'A' of the Traffic
Impact Fee Procedures Manual most similar in traffic
generation.
7. An erosion control plan shall be provided as part of
the improvement drawings . The plan shall conform to
",Erosion Control Plans - Technical Guidance Handbcok,
November 1989 . "
8. The applicant shall submit evidence that the proposed
building does riot encroach upon the sanitary sewer
easement or the storm sewer easement that crosses the f
parcel. Alternately, a request shall be submitted to J
the City of Tigard Engineering Department for a

vacation/quit claim to that portion of the easement
whereupon the building encroaches . As part of the
vacation/quit claim request, the applicant shall submit
the following information: existing property lines,
outline of proposed building(s) , existing easement
lines, location of sanitary and storm lines both
vertical and horizontal, and offset lines from proposed
building(s) to the sanitary/storm line(s) . If it is
determined from all the supporting evidence that a
portion of the easement needs to be vacated/quit
claimed, and that by doing so it would not have a
negative impact on the serviceability of the
sanitary/storm line(s) , then the Engineering Department
shall process the request. Conversely, if :_t is
determined that the full 60 foot easement is needef .
then the applicant shall be required to submit a
revised site plan which shows that there would be no
encroachment upon the easement.
9 . Driveway cuts shall not be permitted within thirty feet
of intersecting right-of-wary lines nor within five feet
of property lines .
10. A profile of S.W. Commercial Street shall. be required,
extending 3U0 feet either side of the BUbject site
showing the existing grade and proposed future grade.
13. . Two (2) sets of detailed public improvement plans and
profile construction drawings shall be submitted for
preliminary review to the Engineering Depart,nent.
Seven (7) sets of approved drawings and one ( 1)
itemized construction cost estimate, all prepared. by a
Professional Engineer, shall be submitted for final
review and approval (NOTE: these plans are in addit.ion
to any drawings required by the Building Division and
should only include sheets .relevant to public
improvements.
12 . Building permits will not be issued and construction of
proposed public improvements shall not begin until
after the Engineering Department has reviewed and
approved the public improvement plans and a street
opening permit or construction compliance agreement has
been executed. A 100 percent performance assurance or
letter of commitment, a developer-engineer agreement,
the payment of a permit fee and a sign installation /
streetlivht fee are required.
