SECTION Ili. BACKGROUND INFOPMATION
Site Histo :
The subject property is developed with a detached single-family residence. The house
was built with a cantilevered kitchen nook that was never reviewed by the City Building
Division. It appears that the nook wa:: poorly constructed and is now significantly
slanting. In order to rectify the problem, the applicant has proposed constructing a
stem wall to support the structure. The location of the nook, however, is extending
three (3) feet into the rear yard setback. The applicant has requested this variance in
order to make the existing setback violatir- ',,,gal arid in order to construct the stem wall
in an effort to correct G,e sloping of the ,a, Revered nook. Upon receiving approval for
this variance, the applicant will apply f; - the necessary building permits to construct the
stem wall.
Proposal Description:
The property owner has proposed a flexible setback variance to encroa:h into the rear
yard setback for three (3) feet of the 15-foot rear ya:d setback minimum requirement.
This flexible setback variance permits an encroachment of up to 20 of the minimurn
setback requirement.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNIT" DLVELOPMENT CODE SECTION&

Section 18.146.050 allows the Director to approve, of approve with conditions, a request
for a Flexible Setback Variance in order to reduce required setbacks by up to 2090 within
the front yard, side yard, corner side yard and rear yard based on the following findings:
The reduction of the setback area established by the applicable zoning district
shall be necessary to allow for the enlargement or remodeling of an existing
building.
The reduction is needed to allow the applicant to construct a stem wall to add support to
the cantilevered nock and to make the existing encroachment lec,al so as to avoid
potential re-sale problems in the future.
The garage setback to the front property line satisfies the requirements of the
.applicable zoning district.
The variance involves the rear yard setback, therefore, this standard does not apply.
The standards of Chapter 18.102, Visual Clearance, shall be satisfied.
The variance does not involve portions of the property that are either within, or adjoining.
a Visual Clearance area as defined by the Community Development Code. Therefore,
this standard does not apply.
The resulting lot coverage shall not exceed the maximum lot coverage of the base
zone.
The R-4.5 Zoning District does not have a maximum lot coverage req-airemcnt, therefore,
this standard does not apply.
The proposed building or addition shall not encroach upon any existing
easements.
Staff consulted the Benchview Subdivision plat to determine if the proposal would
encroach into any platted public utility easements and finds that the proposed variance
will not. There may be private easements that staff is unaware of, however, it is the
owner's responsibility to identify and maintain private easements as thiF can riot be
enforced by the City.
When tic proposed building or addition is within the rezjr yard, the setback
adjacent to the rear property line shall be landscaped with sight obscuring
plantings in accordloce with the standards set forth in Section 18.100.080,
Landscaping and Screening.
The area where the addition was constructed dons not presently include the screening
and buffering measures required by Section 18.100.080. The applicant must provide a
screening plan which includes either a hedge which will form a four (4)-foot continuous
screen within two (2) years, an earthen berm planted with evergreen shrubs which will

form a six (F) foot continuous screen within two (2) years, or a five (5)-foot high or taller
fence. The applicant had indicated that the house to the rear was at a mach higher grade
than the subject site. Section 18.100.080.G states that when grades are so steep as to
make the installation of screening to the required height impractical, a detailed
landscaping and screening plan shall be submitted for approval. Therefore, alternatively,
the plan may provide another combination of screening elements that provide the same
level of screening. The applicant must construct or plant the required screenirly prior to
issuance of building permits.
Setback, buffering and screening requirements that apply when commercial and
industrial zones abu' a residential zone shall be satisfied.
The site involves residential property which abuts residential property, therefore, this
standard does not apply.

communicating with Mr. Tibbetts regarding the problem.
Since this time, I have been trying to reach you by letter(s) ,
dated January 29, 1997 with a 7279 SW Ascot, Portland, Oregon
address and again on February 11, 1997 at 2211 SW 1st Ave. 0402,
Portland, Oregon. Both times, we did not receive a response from
you.
I am submitting along with this letter, a copy of my latest
correspondence regarding the issues. I urge you to take this
matter under consideration and respond as quickly as possible. I

structural problem at the residence of Bruce A. Tibbetts, 13541
Clearview Place Tigard, Oregon. This was at the request of George
Steele, Senior Building Inspector, who had been communicating with
Mr. Tibbetts regarding the problem.
Mr. Tibbetts provided a set of plans for my inspection, which I
used to view the structural members identifiable under the floor in
the crawl space. The plans show the cantilever sitting over 6X
beams approximately 7-1/2 -inches down with double 2X81s secured
with hangers at the opposite end of ' the cantilever and
approximately 9-feet inward. The plans also do not show a beam
above the main floor to support the tipper floor. The cantilever
extends outward for approximately 4-feet and is 24-feet 6-inches in
length.
All aspects of the area in question are as per plans. Although
this be true, the plans are somewhat suspicious with the inverted
printing and the cantilever dimensions are right side up. This
appears to state that this was an after thought and may have been
drawn in at a later date. Whether this is true or not, I really
don't know, because we no longer have the original set of plans.
The problem developing at present is a sloping of the floor at this
cantilever location. Whether this has been an ongoing or recent
development is unknown, but by viewing the trim work of the
cabinet, it appears to have been fnr the life of the construction.
The exterior cantilever is at present being supported with three
(3) 12-inch cinder block pier pads (not adequately spaced e=
supported along the perimeter) with a 4X laid on top of the piers.
The 4X is shimmed, but not adequately. The piers are suppressed
into the earth, as to have sustained the burden of the entire
loading of the two-story cantilever. Without a beam spanned across
the length of the kitchen and nook, which is 24-feet 6-inches and
highly unlikely, it would suggest that these three piers aod 4X are

the only support that the cantilever is under-taking at this
present time.
The cantilever probably would have wcrked, if, a beam had been
placed length-wise to transfer the loading, spanning from
foundation-to-foundation and wall-to-wall. OR, if an exterior
foundation wall was erected at the perimeter of the cantilever, but
this is not the case, as the plans appear to have indicated.
Therefore, it is my opinion t:at the contractor of this
construction take this information and provide in full depth, an
engineering fix for the problem the cantilever is experiencing. It
is also advised to work with Mr. Tibbetts on rectifying this
problem and keep the City of Tigard informed of the progress.
