1. have reviewed the development code, state law and other documents related to
"mobile homes", "manufactured homes" and other factory built homes, and have
also driven .by the home in question on Cook Lane, Following are my comments:
The some, is clearly a "manufactured home", Usually, the term "manufactured
hcxrw-' refers to a factory built home, built to BUD standards. A manufactured
home is by usual definition (and by state law definition) a -mobile home".
Nothing in state last requires cities to allow siting of in.'s- :dual manufactured
homes on lots o' record, outside of manufactured home parks and subdivisions.
The City's development code is quite unclear on the matter. The code tries to
make a distinction betTo-en a "mobile home" and a "manufactured home", and in
the e'.efinition refers to :+ "manufactured home" as meeting UBC standards. The
code further allows "manufa, tured homes" on individual lots of rec.-ord, but not
"mobile homes", which it allows only in Parks or Subdivisions.
Because c>f the lack of clarity In the code on this issue, I have chosen to have
the city attorney review the case with me. Further, I may want zo discuss it
with the City Council in executive session prior to making a final Jec:sion.
In the meantime, I do nm,3t want an occupancy perwit issued to the Johnsoue, and
I would .like Jim Jacpia to notify them of that ASAP.
I believe that we }seed orae week to review this. Therefore, I will make a final
determination next Tuesday, August 8th,
In the meantime, Jim will notify the Johnsons by phone, with a follow-up letter
to be written by ,Tim but signed by me. I will notify the neigabors by
