On December 7, 1987, the State of Oregon, by and
through its Department of Transportation, Highway Division, in
behalf of the City of Tigard, filed a letter application with
the Commission seeking authority, pursuant to ORS 763.030, to
alter the existing railroad - highway grade crossing of SW North
Dakota Avenue, a road under the jurisdiction of the City of
Tigard, and the main track and right -of -way of Southern Pacific
Transportation Company, Tillamook Branch, in Tigard (Greton),
Washington County, Oregon.
By letter dated April 5, 1988, PUC staff served a
Staff Proposed Order in this matter. By letter dated April 6, _
1988, applicant amended its application. By letter dated
May 2, 1988, PUC staff made comments on the amendment.
Copies of the application, amendments, Staff Proposed
Order, and responses thereto were served upon Southern Pacific
Transportation Company; Burlington Northern Railroad Company;
Washington County; City of Tigard; and applicant. No objec-
tion by any party has been made to the granting of the amended
application.
SW North Dakota Avenue is a paved roadway, 26 feet in
width, consisting of two 13 -foot travel lanes. The roadway
lies east and west and intersects the main track at an angle

of approximately 70 degrees. The crossing is equipped with
flashing light and automatic gate signals. Seven -inch verti-
cal face curbing was installed adjacent to the automatic
protective devices located in the northeast and southwest
quadrants of the crossing. The automatic protective devices
and protective curbing were authorized by Order No. 81 -157 in
Docket SXF 1226, entered March 10, 1981, as modified by Serial
Letter No. 95, dated April 29, 1983. Washington County was
the road jurisdiction for SW North Dakota Avenue at the time
of Order No. 81 -157. and Serial Letter No. 95. Subsequently,
SW North Dakota Avenue was transferred to the jurisdiction of
the City of Tigard.
The curbing broke up and did not provide adequate
separation between motor vehicle traffic and the automatic
protective devices. Standard highway -type guardrail was
substituted for the authorized curbing. The purpose of this
order is to authorize the installation of a guardrail.
The Commission finds that the change from curbing to
guardrail is required for the public safety and welfare.
Due consideration has been given to all representa-
tions in the application, amendments, Staff Proposed Order,
and responses thereto. No matters within the scope of ORS
Chapter 763 are in issue, and no hearing will be required.
The Commission finds that the guardrail proposed •
herein is required by the public safety, convenience, and
general welfare, and that it is appropriate to authorize
expenditure of funds from the Grade Crossing Protection
Account, as provided by ORS 763.290, in the amount agreed upon
by the parties.
Based upon the amended application, Staff Proposed
Order, and files of the staff, the Commission finds that the
application should be granted upon the following terms and
conditions.
IT IS THEREFORE ORDERED that:
1. The authority to alter the existing grade
crossing as requested is granted.
2. Washington County shall:
a. Bear all the cost of furnishing, installing,
and removing the 7 -inch vertical face curbing
adjacent to the automatic protective devices
located in the northeast and southwest
quadrants of the crossing;

b. Subject to reimbursement as provided herein,
furnish and install standard highway -type
guardrail adjacent to the existing set of
automatic protective devices located in the
northeast and southwest quadrants of the
crossing, in accordance with
OAR 860 -42- 070(13); and
c. Notify the Commission upon completion of the
project.
3. City of Tigard shall maintain the guardrail
ordered herein, and bear all the cost thereof.
4. Oregon Department of Transportation, Highway
Division, utilizing Title II federal funding,
shall bear 90 percent of the cost of furnishing
and installing the guardrail as ordered herein.
5. Pursuant to ORS 763.290, the Grade Crossing
Protection Account shall bear 10 percent of the
cost of furnishing and installing the guardrail
ordered in paragraph 2.b. above.
6. Upon completion of the work ordered in
paragraph 2.b. above, Washington County shall
present its claim for reimbursement for the
Commission's approval.
All previous orders and serial letters of the
Commission, and the provisions thereof, which pertain to
the construction, maintenance, protective devices, or the
operation of trains over the SW North Dakota Avenue crossing,
shall continue in full force and effect, with the exception of
any terms therein which conflict with the terms of this order.

Proposed Order in the subject matter. We propose,to treat your response
as an amendment to your application.
Staff will recommend that the Grade Crossing Protection Acount (GCPA)
bear 10 percent of the cost of furnishing and installing the guardrail,
and recommend that the order reflect this change. We will also recommend
that the order specify that Washington County bear the cost of furnish-
ing, installing, and removing the curbing.

I have reviewed the Staff Proposed Order and find it to be
generally acceptable with one exception. I understand that
Randy Lapo, of Washington County, and Larry Christianson, of
the Highway Division have agreed that 90/10 funds would not be
requested for the original curb installation. We will, then,
reimburse Washington County for 90% of the cost of the new
guardrail. Possibly PUC will want to make the same
arrangements with Washington County regarding their 10% of the
curb and guardrail work.

RE: Crossing No. 3E - 31.4, S.W. Tiedeman Avenue, at Greton
(near Tigard)
PUC Order No. 81 -658, entered September 24, 1981, in
Docket SXF 1262, authorized widening of the Tiedeman
Avenue crossings of Southern Pacific Transportation
Company and Burlington Northern Railroad Company,
crossing Nos.. FD- 751.80 and 3E- 31.40, respectively, from
a width of 20 feet to 28 feet. The order authorized two
Standard No. 2 flashing light signals and two Standard
No. 4 automatic gate signals to be installed at the
Southern Pacific crossing, and one reverse (left -hand)
Standard No. 2B cantilevered flashing light signal at the
Burlington Northern crossing. The cantilevered flashing
light signal was to be located approximately 45 feet
westerly of the centerline of Burlington Northern's ,
track, along the centerline of the proposed roadway, and
not less than 20 feet from the centerline of the roadway.
By letter dated April 24, 1987, Burlington Northern
requested.authority to install the Standard No. 2B
cantilevered flashing light signal approximately 80 feet
westerly from the centerline of its track and 21 feet
from the centerline of the roadway. The requested change
in the location of the.cantilevered flashing light signal
is needed due to modifications made (subsequent to the •
order) to the roadway and an adjacent intersecting
driveway. The location of the cantilevered flahing light
signal, as authorized in the order, would place the
cantilever arm in the intersection formed by
S.W. Tiedeman Avenue and the aforementioned driveway.

Please accept this letter as your authority to install
the Standard No. 2B cantilevered flashing light signal at
crossing No. 3E -31.4, approximately 80 feet westerly of
the centerline of track, as measured along the centerline
of the roadway, then perpendicular to and northerly of
the centerline of the roadway to a distance not less than
20 feet. All other provisions of Order No. 81 -658 shall
remain in full effect.

Dear Mr. Riley,
The crossing signal at S.W. Tiedeman Avenue, Greton, Oregon, APE F84 =5
was placed in service April 23, 1987.
The left hand cantilever was placed 80 feet southwest of centerline of
track measured along centerline of roadway and 21 feet from centerline
of roadway.
The roadway and driveway have been changed between the time of original
proposal and installation. Placing the left hand cantilever at the
original position, with the wider roadway would have allowed close
clearance between trains and vehicles stopped for the crossing. Also
considerable fill would have been required for the cantilever. This
fill would have extended onto private property. In discussion between
Les Walling and myself we agreed the new location afforded both ease of
installation and better warning to the motoring public.

By copy of this letter, we acknowledge receipt of your
letter dated May 8, 1984, which requested authority to .
install constant warning time activation devices at the
crossing in lieu of island track circuits and railroad
STOP signs. The request is based upon a contemplated .
change in BNO train operations over the crossing result-
ing from the recent replacement of a hand -throw switch at
Greton with a CTC- controlled power switch. Installation
of the power switch has eliminated the need for BNO trains
to stop at the railroad junction switch before proceeding
to operate on the Tillamook Branch between Beburg and
Greton.
Order No. 81 -658 was a compromise by all parties involved.
Topographical; train speed and operation; and visibility
considerations led to the design of a less than standard
crossing protection package.
Installation of a standard flashing light and automatic
gate signal in the southwest quadrant of the BNO crossing
would (and still does) require construction of a retaining
wall.
A major factor in the decision to forego automatic gate
protection and utilize only a reverse cantilever flashing
light signal was that all northbound BNO trains had to
stop and line the interchange switch, which is located
approximately 400 feet northerly of the Tiedeman Avenue
crossing. Similarly, a southbound BNO train would be
moving slowly over the crossing to allow a trainman to

line the switch back to its normal position before board-
ing the caboose. With a CTC- controlled switch, BNO trains
could pass over the crossing at a higher rate of speed
than previously discussed.
Motorists' visibility of an approaching train is
extremely restricted in the southwest quadrant of the
crossing. The roadway alignment is curved and has a
considerable amount of slope upward toward the crossing.
A motorist must watch the roadway in order to negotiate
the curves in advance and at the crossing. Even if a
motorist looked to his right (southerly) he could not
see an approaching train due to the embankment.
After having reviewed your proposal, the present pro-
tective package, and train operating characteristics, we
present the following as staff position in this matter:
Option No. 1:
The existing BNO track could be relocated adjacent to the
Southern Pacific Tillamook Branch track by construction
of a new track along the westerly side of the SP track
(see attached sketch No. 1). This would locate both the
BNO and SP tracks within 15 feet of each other and allow
for both tracks to be protected with a single set of
flashing light and automatic gate signals.
If option No. 1 is not acceptable, one of the following
proposals should be considered:
Option No. 2:

— Comply with provisions of PUC Order No. 81 -658 and stop
all northbound trains at the crossing.
Option No. 3:
Install signal activation devices with the automatic pro-
tective devices specified in Order 81 -658, with a maximum
permissible train speed set by order at 5 mph for all BNO
trains over the crossing, such that the signals would
operate in compliance with OAR 860 -42- 090(1).
Option No. 4:
Install a flashing light and automatic gate signal in
the southeast quadrant of the crossing, along with
constant warning time activation devices, and operate
trains at normal speed over the crossing (see attached
sketch No. 2).

It is disappointing the railroads have not yet volun-
tarily extended their joint trackage through the Tigard
area. The current level of rail service in this area
does not warrant retention of two separate parallel
tracks through Tigard. The public has spent millions
of dollars to provide a CTC system and relocated track-
age for a handful of trains a day. The joint track
extension would have cost practically nothing and the
new switch could have been installed at Bonita instead
of Greton.
Please review the =various options and respond
accordingly. Call us if you have any questions or
comments. A response within 20 days is requested.
