ZONING
DESIGNATIONS: I-P: Industrial Park District.The I-P zoning district provides appropriate
locations for combining light manufacturing,office and small-scale commercial
uses,e.g.,restaurants,personal services and fitness centers,in a campus-like
setting. Only those light industrial uses with no off-site impacts,e.g.,noise,
glare,odor,vibration,are permitted in the I-P zone. In addition to mandatory
site development review,design and development standards in the I-P zone
have been adopted to insure that developments will be well-integrated,
attractively landscaped,and pedestrian-friendly.
C-P: Professional/Administrative Commercial District. The C-P zoning district
is designed to accommodate civic and business/professional services and
compatible support services,e.g.,convenience retail and personal services,

restaurants,in close proximity to residential areas and major transportation
facilities. Within the Tigard Triangle and Bull Mountain Road District,
residential uses at a minimum density of 32 units/net acre,i.e., equivalent to the
R-40 zoning district,are permitted in conjunction with a commercial
development. Heliports,medical centers,religious institutions and utilities are
permitted conditionally. Developments in the C-P zoning district are intended
to serve as a buffer between residential areas and more-intensive commercial
and industrial areas.

CRITERIA: Community Development Code Chapter 18.410.040.
SECTION II. DECISION
Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request subject to a condition of approval. The findings and conclusions on
which the decision is based are noted in Section IV.
CONDITION OF APPROVAL
THE FOLLOWING CONDITIONS SHALL BE SATISFIED:
1. The applicant shall record the lot line adjustments with Washington County, and submit a copy of
the recorded survey map to the city within 15 days of recording to be incorporated into the record.
THIS APPROVAL SHALL BE VALID FOR 18 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION.
SECTION III. BACKGROUND INFORMATION
Site Information:
The subject parcels are located north of the TriMet \VES Commuter Rail Service tracks; south of SW
Hunziker Street; west of Highway 217; and east of SW Wall Street. The lots are currently vacant and
undeveloped. Parcels 1 and 2 are located in the Industrial Park zone (I-P); Parcel 3 is located in the
Professional/Administrative Commercial (C-P) zone. Adjacent properties to the north arc zoned Light
Industrial (I-L); to the south are zoned Parks and Recreation (PR); to the west are zoned I-L and PR;
and to the east are zoned C-P,I-P,and Low-Density Residential (R-3.5).
There are sensitive lands present on all three parcels. Parcel 1 contains steep slopes of 25% or greater,
and lower value habitat areas. Parcel 2 contains Clean Water Services' vegetated corridor, and lower
value habitat areas. Parcel 3 contains lower value habitat areas.
Proposal Description:
The applicant is proposing two lot line adjustments affecting three properties at SW Hunziker Street
and SW Wall Street: WCTM 2S101,Tax Lot 1100 (Parcel 1);WCTM 2S101CA,Tax Lot 100 (Parcel 2);
and WCTM 2S101DB, Tax Lot 300 (Parcel 3). The resulting lot line adjustments will increase Parcel 1
from 13.21 to 26.64 acres, reduce Parcel 2 from 24.15 to,6.35 acres, and increase Parcel 3 from 3.07 to
7.44 acres.
This proposal is the first in a series of two applications for lot line adjustments. The applicant ultimately
proposes to reconfigure Parcels 1, 2, 3, and an adjacent property (WCTM 2S101DB, Tax Lot 400), and
subsequently apply for a Comprehensive Plan Amendment and a Zoning Map Amendment.

SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Section 18.410.040 contains the
following criteria for approval of a Lot Line Adjustment request:
Section 18.410.040
A. Approval Criteria states that the Director shall approve or deny a request for a lot line
adjustment in writing based on findings that the following criteria are satisfied:
1. An additional parcel is not created by the lot line adjustment, and the existing parcel
reduced in size by the adjustments is not reduced below the minimum lot size
established by the zoning district;
This proposal will not create any additional parcels. As a result of the proposed lot line adjustments,
Parcels 1 and 3 will be increased in size, and Parcel 2 will be reduced in size. Therefore, this criterion
only applies to Parcel 2, which is located in the I-P zone. Per TDC Table 18.530.2, there is no
minimum lot size requirement in the I-P zone. Accordingly, staff finds that Parcel 2 will not be reduced
below the minimum lot size established by the I-P zone. This criterion is met.
2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the
site development or zoning district regulations for that district;
As a result of the proposed lot line adjustments, Parcels 1 and 3 will be increased in size, and Parcel 2
will be reduced in size. Therefore, this criterion only applies to Parcel 2, which is located in the I-P
zone. Staff reviewed the applicant's submitted site plan and narrative to determine that Parcel 2 will not
be in violation of the site development or zoning district regulations for the I-P zone, as outlined in
1'DC 18.530. This criterion is met.
3. The resulting parcels are in conformity with the dimensional standards of the zoning
district, including:
a. The minimum width of the building envelope area shall meet the lot
requirement of the applicable zoning district;
The minimum lot width for both the C-P and I-P zones is 50 feet (TDC Tables 18.520.2 and 18.530.2).
Staff reviewed the applicant's submitted site plan to determine the lot widths for all three parcels
exceed 50 feet. Therefore,this criterion is met.
b. The lot area shall be as required by the applicable zoning district. In the case of
a flag lot, the access way may not be included in the lot area calculation;
There is no minimum lot size requirement for the I-P zone (TDC Table 18.530.2). The minimum lot
size requirement for the C-P zone is 6,000 square feet (TDC Table 18.520.2). As a result of the
proposed lot line adjustments, Parcel 1 will be 26.64 acres, or approximately 1,160,438 square feet;
Parcel 2 will be 6.35 acres, or approximately 276,606 square feet; and Parcel 3 will be 7.44 acres, or
approximately 324,086 square feet. Accordingly, the resulting lot areas for all three parcels exceed the
minimum lot size requirements for both the I-P and C-P zones. In addition, this proposal will not
create any flag lots. This criterion is met.
c. Each lot created through the partition process shall front a public right-of-way
by at least 15 feet or have a legally recorded minimum 15-foot wide access
easement; and
Parcel 1 will front SW Wall Street by approximately 546 feet. Parcel 2 will front SW Wall Street by
approximately 629 feet. Parcel 3 will abut SW Wall Street by approximately 427 feet, and SW Hunziker
Street by approximately 602 feet. This criterion is met.

d. Setbacks shall be as required by the applicable zoning district.
A setback is defined as, "the minimum allowable horizontal distance from a given point or line of
reference, which shall be the property line unless otherwise stated to the nearest vertical wall of a
building or structure, fence or other elements as defined by this title," (1'UC 18.120.030.A.153). All
parcels are currently vacant, and the applicant is not proposing any development at this time.
Therefore, future compliance with setbacks for the I-P and C-P zones will be ensured through site plan
review,prior to building permit issuance. This criterion is met.
4. With regard to flag lots:
a. When the partitioned lot is a flag lot, the developer may determine the location
of the front yard, provided that no side yard is less than 10 feet. Structures shall
generally be located so as to maximize separation from existing structures.
b. A screen shall be provided along the property line of a lot of record where the
paved drive in an access way is located within ten feet of an abutting lot in
accordance with Section 18.745.040. Screening may also be required to maintain
privacy for abutting lots and to provide usable outdoor recreation areas for
proposed development.
The proposed lot line adjustments will not create any flag lots. This criterion does not apply.
5. The fire district may require the installation of a fire hydrant where the length of an
accessway would have a detrimental effect on fire-fighting capabilities.
All resulting parcels will have direct access to either SW Wall Street or SW Hunziker Street. In addition,
no accessways are involved or being created with this application.This criterion is met.
6. Where a common drive is to be provided to serve more than one lot, a reciprocal
easement which will ensure access and maintenance rights shall be recorded with the
approved partition map.
No common drives currently exist or are being proposed with this application. This criterion does not
apply.
7. Any access way shall comply with the standards set forth in Chapter 18.705: Access,
Egress, and Circulation.
No accessways are involved or being created with this application.This criterion does not apply.
B. Exemptions from dedications. A lot line adjustment is not considered a development
action for purposes of determining whether floodplain, greenway, or right-of-way
dedication is required.
Floodplain, greenway, or right-of-way dedication is not required as part of this application. This criterion
does not apply.
C. Variances to development standards. An application for a variance to the standards
prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and
Adjustments.
The applicant has not applied for a variance to development standards with this application. This
criterion does not apply.
FINDING: Based on the analysis above, staff finds the criteria for Lot Line Adjustments are either
satisfied or do not apply. The proposal is in compliance with the requirements of this
Title.

Dear Staff:
The Fred Fields Revocable Living Trust is the owner of four parcels of land located along SW Hunziker Street. The trust
would like to reconfigure the four parcels through two separate property line adjustment applications. The adjustments are
being done in conjunction with a zoning change for the property. The final configuration will have three parcels that will
be zoned I-P and one parcel zoned MUE.
The properties involved in the first adjustment will be Tax Lot 1100 on Assessor's Map 2S-1-01 (Tract 1),Tax Lot 100 on
Assessor's Map 2S-1-01CA(Tract 2)and Tax Lot 300 on Assessor's Map 2S-1-01DB(Tract 3). The adjustment will
transfer 13.429 acres from Tax Lot 100 to Tax Lot 1100. It will also transfer 4.373 acres from Tax Lot 100 to Tax Lot
300.
The properties involved in the second adjustment will be the adjusted Tax Lot 1100 on Assessor's Map 2S-1-01 (Tract 1),
the adjusted Tax Lot 300 on Assessor's Map 2S-1-01DB(Tract 2)and Tax Lot 400 on Assessor's Map 2S-1-01DB(Tract
4). The adjustment will transfer 19.433 acres from Tax Lot 1100 to Tax Lot 400. It will also transfer 2.695 acres from
Tax Lot 300 to Tax Lot 400.
The adjustments are depicted on two separate maps,which are attached. After the second adjustment Tract 1,Tract 3 and
Tract 4 will have frontage along SW Hunziker Street. Tract 2 will have access to SW Hunziker Street through and existing
shared access easement recorded as Document Number 2007-019322, Washington County Deed Records.
The only structure located on any of the properties is an existing house on Tax Lot 400. The property lines will be moving
away from the house, so there will be no setback violations created by the adjustments. No new easements will be
required as a result of the adjustments.
In summary,the adjusted properties will meet all zoning and setback requirements,and all provisions of Chapter 18.410 of
the City of Tigard Development Code.
