("Section 6409(a)"). Pursuant to 47 C.F.R. § 1.400001(c)(4), if a local government fails to issue a decision within 60 days on an application submitted pursuant to Section 6409(a), the application is deemed granted. The deemed grant becomes effective once the applicant notifies the reviewing authority in writing after the review period has expired. The City is in receipt of your letter, dated April 4, 2016, in which you state that the application has been deemed granted. The application was submitted on January 28, 2016. All submittal requirements were received and the application was deemed complete on that same date. The City acknowledges that more than 60 days has passed since the application was submitted and the City has not approved or denied the application.
