The I-L zoning district provides appropriate locations for general industrial uses including industrial service, manufacturing and production, research and development,warehousing and freight movement, and wholesale sales activities with few,if any, nuisance characteristics such as noise,glare, odor, and vibration. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360, 18.390, 18.530,and 18.765. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the aboverequest. The findings and conclusions on which the decision is based are noted in Section IV. MMD2016-00015 PDX European Auto Care Page 1 of 3 SECTION III. BACKGROUND INFORMATION Site Information and Site History: The project is located at 7225 SW Bonita Road; north of SW Bonita Road, and west of SW 72nd Avenue. The 0.57-acre development site is made up of one (1) parcel, and contains one (1) industrial building (10,120 square feet in size), landscaping, and associated parking. The site is zoned Light Industrial (I-L). The existing use is a contractor's office classified as Industrial Services. A minor modification (MMD2015-00025) was approved for the site in 2015 to modify on-site parking and landscaping. Changes included the addition of six (6) new parking spaces, planting of five (5) new parking lot trees, and installation of screening for the existing parking lot. No other land use approvals have been granted. Vicinity Information: Surrounding properties are zoned Light Industrial (I-L) and Heavy Industrial (I-H). Uses in the area include a mix of office, auto care, manufacturing, and warehouse/distribution. Description of the Request: The applicant is requesting minor modification approval to add an auto repair business (Auto Sales and Servicing) to site. The contracting business will remain. An unused warehouse area of the building will be used for the auto repair business. The warehouse is 5,320 square feet (76' x 70') according to the site plan originally submitted. The business will utilize an existing access from SW 72"`' Avenue. Parking is proposed inside the building and in a paved area between the building and the right-of-way. No other site modifications are proposed. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Site Development Review—Chapter 18.360.020.0 Minor Modification of Approved or Existing Conditional Use: Any modification which is not within the description of a major modification as provided in Subsection B shall be considered a minor modification. An applicant may request approval of a minor modification by means of a Type I procedure, as regulated by Section 18.390.030, using approval criteria in Subsection C.3. Section 18.330.020.C.3 states that a minor modification shall be approved, approved with conditions or denied following the Director's review on findings that: The proposed development is in compliance with all applicable requirements of this title; and FINDING: As described in the applicant's narrative and plan set, and as provided in the findings for the applicable standards below, staff finds that all applicable requirements of this title are satisfied and the proposed use may be approved. The modification is not a major modification. FINDING: Staff finds that based on the applicant's narrative and plan set, the threshold changes to determine a major modification, listed in TDC 18.360.050.B(1-11), have not been exceeded or do not apply. Industrial Zoning Districts (18.530) Light Industrial (I-L): The I-L zoning district provides appropriate locations for general industrial uses including industrial service, manufacturing and production, research and development,warehousing and freight movement, and wholesale sales activities with few, if any, nuisance characteristics such as noise, glare, odor, and vibration. Use Table: Industrial Zones,Table 18.530.1 The proposed auto repair use is classified as motor vehicle servicing/repair,which is a use permitted in the I-L zone. MMD2016-00015 PDX European Auto Care Page 2 of 3 FINDING: Based on the analysis above,the proposed use is permitted in the I-L zone. Off-Street Parking and Loading (18.765): Minimum Off-Street Parking: Section 18.765.070.H states that the minimum and maximum parking shall be as required in Table 18.765.2. FINDING: The minimum parking for the proposed Motor Vehicle Servicing and Repair Use is two (2) spaces per 1,000 gross square feet with a minimum of four (4) spaces. For the total square footage (5,320), eleven (11) spaces are required. The original site plan showed eight (8) spaces based on a 4,000 square foot space. However, the plan dimensions showed a 5,320 square foot space. The applicant submitted a revised plan with the required eleven (11) spaces. Four of the eleven spaces are compact, which is less than 50°/0 of the proposed spaces. The minimum off-street parking standards are met. SECTION V. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant,whichever occurs first. Suite 100 Tigard, Or 97224 PDX European Minor Modification(s) —Type 1 Application PDX European is a high end automotive repair and service center with high standards for professionalism, service and conduct. This is an owner operated business with an existing clientele base with working systems and procedures. A very clean, efficient business, only serving clients through appointments and pre-scheduled services. Servicing vehicles such as BMW, Mercedes, Audi, Maserati, the standard is extremely high as the shop is run like a lab rather than a greasy repair shop. By that standard, the existing warehouse space will not need any major modifications as it suits the purpose of PDX European to conduct their business. Aside from a deep cleaning and painting of the interior of the shop space (warehouse) this business will need very little work to get up and running. Evaluation Criteria: 1. An increase in dwelling unit density, or lot coverage for residential development; This is an automotive repair business taking over an already existing portion of a building in Tigard and will not be involved in any residential development. 2. A change in the ratio or number of different types of dwelling units; There will not be any additional dwelling units on this property as it is a commercial property with an existing business. 3. A change that requires additional on-site parking in accordance with Chapter 18.765; The nature of PDX European is different from other repair/service centers as it is by appointment only, in so doing, there is a relief on the need for parking as there is never an overflow of vehicles at the business and all vehicles are serviced and removed from the property before the next vehicle arrives, eliminating the need to stack vehicles waiting to be serviced. This is a 4000 square foot space. In accordance with TABLE 18.765.2 Motor Vehicle Servicing/Repair: 2.0/1,000 but no less than 4.0 There are 4 existing spaces outside of the building with direct access from 72nd Ave and directly in front of the main entrance to the building. There will be an additional 4 spaces provided inside of the building intended for overflow parking if ever needed. Accounting for a total of 8 available parking spaces for the business needs. There is also access to 18 more parking spaces of the shared business that are not used to capacity at any point in the day and remain more than 60% vacant at regular business hours. SEE EXHIBIT A 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; There will be no major change to the structures in the development of this business. The warehouse space is an existing part of the Landlord's business and is fit for PDX European's immediate move-in. 5. An increase in the height of the building(s) by more than 20%; There will be no change to the height of the existing building as the warehouse space is fit for PDX's business conduct. 6. A change in the type and location of access ways and parking areas where off-site traffic would be affected; There is no change in access ways for PDX European as the parking lot entrance, parking spaces and business entrance are already existing and do not need any modification for the conduct of business off of 72nd Ave. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; This is a small operation with one owner and 1-2 technicians at any given time. Having an appointment only based system and so few technicians will not raise the load factor for traffic in the area by more than a fraction. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; The approximate square footage for the space is 4,000 square feet and it will not be expanded on or will have the floor plan changed. 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space are below the minimum required by this code or reduces the open space area by more than 10%; There will be no reduction in common space as PDX European will be moving into an existing space and will not be altering anything outside of the agreed upon space. 10. A reduction of project amenities below the minimum established by this code or by more than 10% where specified in the site plan: a. Recreational facilities; There will be no reduction in facility space as this is a vehicle repair shop and will not expand outside of the scope of the warehouse space. b. Screening; There will be no reduction in screening space as this is a vehicle repair shop and will not expand outside of the scope of the warehouse space. c. Landscaping provisions; There will be no reduction or change to the landscaping in the immediate area as PDX European will not be changing anything outside of the scope of the warehouse.
