APPLICATION SUMMARY FILE NAME: ROYAL OAKS DEVELOPMENT CO. LOT LINE ADJUSTMENT CASE NO.: Lot Line Adjustment(LLA) LLA2015-00005 PROPOSAL: The applicant is proposing a lot line adjustment affecting two properties,9799 SW Frewing Street(Parcel 1) and 9795 SW Frewing Street(Parcel 2).As a result of this lot line adjustment,Parcel 1 will be 8,700 square feet in size,and Parcel 2 will be a flag lot that is 10,080 square feet in size (exclusive of the flag pole area). The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally APPLICABLE REVIEW CRITERIA: Tigard Community Development Code Chapter 18.410.040. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLA2015-00005 Royal Oaks Development Company Lot Line Adjustment 1 CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED: 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. 2. The applicant shall record a reciprocal easement, which will ensure access and maintenance rights for both Parcels 1 and 2,on the final plat. 3. The applicant shall provide adequate screening between the proposed flag accessway and the abutting lot,in accordance with TDC 18.745.050. 4. The applicant shall comply with Tualatin Valley Fire and Rescue standards. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the east side of SW Frewing Street, north of SW Ash Avenue and south of Highway 99W. The lots are currently vacant and undeveloped, and both are located in the R- 4.5 (Low-Density Residential) zone.Adjacent properties to the north are zoned R-12 (Medium-Density Residential); adjacent properties to the south, west, and east are zoned R-4.5. There are sensitive lands present on both parcels. Parcel 1 contains Clean Water Services' vegetated corridor, and high to medium value habitats. Parcel 2 contains medium to low value habitats. Proposal Description: The applicant is proposing a lot line adjustment affecting two properties, 9799 SW Frewing Street (Parcel 1) and 9795 SW Frewing Street(Parcel 2). As a result of this lot line adjustment,Parcel 1 will be 8,700 square feet in size,and Parcel 2 will be a flag lot that is 10,080 square feet in size (exclusive of the flag pole area). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; This proposal will not create any additional parcels. As a result of this lot line adjustment, Parcel 1 will be 8,700 square feet in size, and Parcel 2 will be a flag lot that is 10,080 square feet in size (exclusive of the flag pole area). Accordingly, both lots exceed the minimum lot size for the R-4.5 zone (7,500 square feet for detached, single-family units).This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the LLA2015-00005 Royal Oaks Development Company Lot Line Adjustment 2 R-4.5 zone. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district,including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Both parcels are currently vacant and undeveloped. In addition, staff reviewed the submitted site plan to confirm both parcels exceed the average minimum lot width for the R-4.5 zone (50 feet for detached,single-family units). This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the access way may not be included in the lot area calculation; As a result of this lot line adjustment, Parcel 1 will be 8,700 square feet in size, and Parcel 2 will be a flag lot that is 10,080 square feet in size (exclusive of the flag pole area). Accordingly, both lots exceed the minimum lot size for the R-4.5 zone (7,500 square feet for detached, single-family units). This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and Parcel 1 will front SW Frewing Street by approximately 97 feet. Parcel 2 will connect to SW Frewing Street by a minimum 15-foot wide access easement(flag pole). This criterion is met. d. Setbacks shall be as required by the applicable zoning district. The applicant is not proposing any development at this time. However, prior to building permit submittal, compliance with setbacks for the R-4.5 zone (1UC Table 18.510.2) and setbacks for flag lots ([DC 18.730.050.F) will be ensured through site plan review. This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. The applicant is not proposing any development at this time. However, the proposed flag lot is large enough to accommodate a residence and still meet front and side yard setback requirements. Prior to building permit submittal, compliance with the standards outlined above will be ensured through site plan review.This criterion is met. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is proposing an approximately 70-foot long accessway (flag pole) that will serve both Parcels 1 and 2. The accessway is located within 10 feet of an abutting lot (9783 SW Frewing Street, WCTM 2S102CA, Tax Lot 1200). Therefore, this decision includes a condition that requires the applicant to provide adequate screening along the flag pole's south side, in accordance with TDC 18.745.040. As conditioned, this criterion is met. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. LLA2015-00005 Royal Oaks Development Company Lot Line Adjustment 3 The applicant is proposing an approximately 70-foot long accessway that will serve both Parcels 1 and 2. In addition, there is an existing fire hydrant located approximately 67 feet from the site. A condition of approval has been added that requires the applicant to comply with Tualatin Valley Fire and Rescue standards.As conditioned,this criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is proposing an approximately 70-foot long accessway that will serve both Parcels 1 and 2.Accordingly,a condition of approval has been added that requires the applicant to record a reciprocal easement which will ensure access and maintenance rights on the final plat. As conditioned, this criterion is met. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The minimum required access width for residential use is 15 feet (IDC Table 18.705.1). As indicated on the applicant's site plan,Parcels 1 and 2 will share a minimum 15-foot wide accessway. This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either satisfied or do not apply. The proposal is in compliance with the requirements of this Title. SECTION V. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: L An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. The proposed adjusted lot(Lots 1 and 2)sizes will be 8700 sf and 10,080 sf, respectively.The current zoning district is City of Tigard R4.5 requiring minimum lot sizes of 7500 sf. Both proposed Lots 1 and 2 will exceed the required minimum lot sizes. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. No structures exists on either Tax Lot 1000 and 1100,therefore,this code requirement is not applicable. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the accessway may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement;and d. Setbacks shall be as required by the applicable zoning district. The proposed Lots 1 and 2 will comply with all dimensional requirements of the City of Tigard R4.5 zoning district standards including building envelope areas,frontage requirements and setbacks. In addition,the proposed flag pole portion of Lot 2 is not included in the noted square footage on the attached Site Plan. Page 2 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within 10 feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The property owner/developer will comply will all standards and setbacks requirements. Structures will be designed to ensure privacy, both proposed houses will obtain access from the flag pole portion of Lot 2. Screening will be provided along the southerly property line along the common access driveway to ensure privacy to the property owner to the south. Screening will include wood fencing and landscaping. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The proposed common access serving Lots 1 and 2 is measured to be approximately 70 feet long,the property owner/developer will comply with all requirements imposed by the fire marshal. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A reciprocal easement will be recorded to ensure permanent access and a maintenance agreement will be recorded to ensure the common access and landscaping are adequately maintained. 7. Any accessway shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. No structures, development, construction activities, gardens, lawns, application of chemicals, uncontained areas of hazardous materials as defined by Oregon Department of Environmental Quality, pet wastes, dumping of materials of any kind, or other activities shall be permitted within the sensitive area or Vegetated Corridor which may negatively impact water quality, except those allowed in R&O 07-20, Chapter 3. 2. Prior to any site clearing, grading or construction the Vegetated Corridor and water quality sensitive areas shall be surveyed, staked, and temporarily fenced per approved plan. During construction the Vegetated Corridor shall remain fenced and undisturbed except as allowed by R&O 07-20, Section 3.06.1 and per approved plans. 3. If there is any activity within the sensitive area, the applicant shall gain authorization for the project from the Oregon Department of State Lands (DSL) and US Army Corps of Engineers (USACE). The applicant shall provide Clean Water Services or its designee (appropriate city)with copies of all DSL and USACE project authorization permits. 4. An approved Oregon Department of Forestry Notification is required for one or more trees harvested for sale, trade, or barter, on any non-federal lands within the State of Oregon. 5. Prior to disturbance, an erosion control permit is required. Appropriate Best Management Practices (BMP's)for Erosion Control, in accordance with Clean Water Services' Erosion Prevention and Sediment Control Planning and Design Manual, shall be used prior to, during, and following earth disturbing activities. 6. SPECIAL CONDITIONS 10. The Vegetated Corridor width for sensitive areas within the project site shall be a minimum of 50 feet wide, as measured horizontally from the delineated boundary of the sensitive area. 11. For Vegetated Corridors up to 50 feet wide,the applicant shall enhance the entire Vegetated Corridor to meet or exceed good corridor condition as defined in R&O 07-20, Section 3.14.2, Table 3-3. 12. Removal of invasive non-native species by hand is required in all Vegetated Corridors rated ""good."" Replanting is required in any cleared areas larger than 25 square feet using low impact methods. The applicant shall calculate all cleared areas larger than 25 square feet prior to the preparation of the required Vegetated Corridor enhancement/restoration plan. 13. Prior to any site clearing, grading or construction, the applicant shall provide Clean Water Services with a Vegetated Corridor enhancement/restoration plan. Enhancement/restoration of the Vegetated Corridor shall be provided in accordance with R&O 07-20, Appendix A. 14. Prior to installation of plant materials, all invasive vegetation within the Vegetated Corridor shall be removed per methods described in Clean Water Services' Integrated Pest Management Plan. During removal of invasive vegetation care shall be taken to minimize impacts to existing native tree and shrub species. 15. Clean Water Services shall be notified 72 hours prior to the start and completion of enhancement/restoration activities. Enhancement/restoration activities shall comply with the guidelines provided in Landscape Requirements (R&0 07-20, Appendix A). Page 2 of 5 CWS File Number 15-000507 16. Maintenance and monitoring requirements shall comply with R&O 07-20, Section 2.11.2. If at any time during the warranty period the landscaping falls below the 80% survival level, the owner shall reinstall all deficient planting at the next appropriate planting opportunity and the two-year maintenance period shall begin again from the date of replanting. 17. Performance assurances for the Vegetated Corridor shall comply with R&O 07-20, Section 2.06.2. 18. Clean Water Services shall require an easement over the Vegetated Corridor conveying storm and surface water management to Clean Water Services that would prevent the owner of the Vegetated Corridor from activities and uses inconsistent with the purpose of the corridor and any easements therein. FINAL PLANS 19. Final construction plans shall include landscape plans. In the details section of the plans, a description of the methods for removal and control of exotic species, location, distribution, condition and size of plantings, existing plants and trees to be preserved, and installation methods for plant materials is required. Plantings shall be tagged for dormant season identification and shall remain on plant material after planting for monitoring purposes. 20. A Maintenance Plan shall be included on final plans including methods, responsible party contact information, and dates (minimum two times per year, by June 1 and September 30). 21. Final construction plans shall clearly depict the location and dimensions of the sensitive area and the Vegetated Corridor(indicating good, marginal, or degraded condition). Sensitive area boundaries shall be marked in the field. 22. Protection of the Vegetated Corridors and associated sensitive areas shall be provided by the installation of permanent fencing and signage between the development and the outer limits of the Vegetated Corridors.
