APPLICATION SUMMARY FILE NAME: TRAN HOME OCCUPATION FILE NO.: Home Occupation Permit(HOP)Type II HOP2015-00040 PROPOSAL: The applicant is requesting a Type II Home Occupation at 12190 SW 69th Avenue. The home occupation is for a beauty salon with six (6) daily customers,and will occupy approximately 516 square feet of an existing 2,421-square-foot residence. No external changes are proposed as part of this application. The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle,a regional mixed-use employment district bounded by Pacific Highway (Hwy. 99),Highway 217 and 1-5. This zoning district permits a wide range of uses including major retail goods and services, business/professional offices,civic uses and housing;the latter includes multi- family housing at a maximum density of 25 units/acre,equivalent to the R-25 zoning district. A wide range of uses,including but not limited to community recreation facilities,medical centers,schools,utilities and transit-related park-and- ride lots,are permitted conditionally.Although it is recognized that the automobile will accommodate the vast majority of trips to and within the Triangle,it is still important to (1) support alternative modes of transportation to the greatest extent possible;and (2) encourage a mix of uses to facilitate intra-district pedestrian and transit trips even for those who drive.The zone may be applied elsewhere in the city through the legislative process. The findings and conclusions on which the decision is based are discussed in Section V. As outlined in TDC 18.742.040.A.2, there shall be no more than three (3) deliveries per week to the residence by suppliers. 2. The applicant shall obtain all necessary permits for any structural, mechanical, electrical, or plumbing work performed as part of the home occupation. BACKGROUND INFORMATION & PROJECT DESCRIPTION Site Information: The 0.2-acre site is located at the intersection of SW 69th Avenue and SW Elmhurst Street. The property is currently occupied by a 2,421-square-foot detached, single-family dwelling with attached garage, paved driveway, and associated landscaping. The site is zoned Mixed-Use Employment (MUE); surrounding properties are zoned MUE and General Commercial (C-G). The project is located in the Tigard Triangle Plan District. Proposal Description: The applicant is requesting a Type II Home Occupation at 12190 SW 69th Avenue. The home occupation is for a beauty salon with six (6) daily customers,and will occupy approximately 516 square feet of an existing 2,421-square-foot residence. No external changes are proposed as part of this application. SECTION IV. PUBLIC COMMENTS The Tigard Community Development Code requires that property owners within 500 feet of the subject site be notified of the proposal,and be given an opportunity for written comments and/or oral testimony prior to a decision being made. Staff mailed Notices of a Type II Proposal regarding this Home Occupation to affected parties on August 20,2015. No public comments were received. SECTION V. APPLICABLE REVIEW CRITERIA&FINDINGS As set forth in Table 18.520.1 of the Tigard Community Development Code, home occupations are an allowed land use in all commercial zones, subject to the approval standards and criteria contained in Chapter 18.742 Home Occupations. Relevant standards and approval criteria are addressed below. 18.742 Home Occupations 18.742.040 General Approval Criteria All home occupations except those that have proven nonconforming status shall observe the following criteria in addition to the standards established for Type I and Type II uses described in Section 18.742.050 of this chapter. A. Home occupations may be undertaken only by the principal occupant(s) of a residential property. 1IO1'2015-00040 IRAN I TOME OCCUPATION PAGE 2 OF 6 • • The applicant is the property owner and principal occupant of the residential property,in which the home occupation is proposed to take place. In addition, the applicant states there will be no outside paid employees or subcontractors related to this home occupation. This criterion is met. B. There shall be no more than three deliveries per week to the residence by suppliers. The applicant's narrative indicates that there will be fewer than three deliveries to the residence per week. A condition of approval will also be added to the decision that states there shall be no more than three deliveries per week to the residence by suppliers, to ensure compliance.This criterion is met. C. There shall be no offensive noise,vibration, smoke, dust, odors,heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of Chapter 18.725, Environmental Performance Standards. The home occupation application is for an in-home beauty salon. It is anticipated that none of the items listed above will be compromised beyond allowable levels as a result of this project. All activities will be conducted indoors between the hours of 10 a.m. and 7 p.m. This criterion is met. D. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25%of the combined residence and accessory structure gross floor area,but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet.The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes. This home occupation will be operated entirely within the primary residence (an existing detached,single- family dwelling). In addition, staff reviewed the applicant's narrative and submitted floor plan to determine 516 square feet of floor area (or approximately 21%of the existing 2,421-square-foot residence) will be utilized for the home occupation. Accordingly, this proposal does not exceed the floor area maximums stated above (528 square feet,or 25% of the combined residence and accessory structure gross floor area). This criterion is met. E. A home occupation shall not make necessary a change in the State Building Code use classification of a dwelling unit.Any accessory building that is used must meet State Building Code requirements. No changes are proposed to the dwelling unit,and the home occupation is not proposed within an accessory building. This criterion is met. F. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall apply for a separate home occupation permit,if required as per this chapter, and each shall also have separate Business Tax Certificates. Staff conducted a search of city records,and found there were no other home occupations at this property. This criterion is met. 110P2015-00040 TRAN HOME OCCUPATION PAGE 3 OF 6 • • G. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials which in the judgment of the Fire Marshal pose a dangerous risk to the residence, its occupants, and/or surrounding properties.Those individuals which are engaged in home occupations shall make available to the Fire Marshal for review the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use. This home occupation will not have any storage and/or distribution of toxic or flammable materials that pose a dangerous risk to the residence,its occupants,and/or surrounding properties. Tualatin Valley Fire and Rescue was sent a copy of the applicant's proposal to review,and had no objections. This criterion is met. H. No home occupation shall require any on or off-street parking other than that normally required for a residence. This home occupation will not require any on or off-street parking,other than that normally required for a residence. The existing detached,single-family dwelling includes an attached two-car garage and large,paved driveway that is available for use by the occupant and customers. This criterion is met. I. The following uses are not allowed as home occupations: a.Auto-body repair and painting; b. Ongoing mechanical repair conducted outside of an entirely-enclosed building; c.Junk and salvage operations; d. Storage and/or sale of fireworks The applicant's proposal for a home occupation does not involve any of the activities listed above. This criterion is met. J. There shall be no exterior storage of vehicles of any kind used for the business except that one commercially licensed vehicle of not more than three-quarters ton gross vehicle weight (GVW) may be parked outside of a structure or screened area. The applicant is not proposing any exterior storage of vehicles of any kind used for the business. In addition, the subject property includes an attached two-car garage that can accommodate any vehicles utilized by the applicant. This criterion is met. 18.742.050 Type I and Type II Home Occupations Defined A. Home occupations shall be administered as either Type I or Type II uses.A separate home occupation permit and/or fee is required for each property on which a Type II home occupation is undertaken. In addition to the general criteria outlined in Section 18.742.040, home occupations shall observe the following additional standards: 1. Type II home occupations. Property on which a Type II home occupation is located may show evidence that a business is being conducted from the premises.Therefore the following is allowed for Type II home occupations: a. One non-illuminated sign,not exceeding 1.5 square feet,which shall be attached to the residence or accessory structure or placed in a window; 1101'2015-00040 '1'RAN HOME OCCUPATION PAGE 4 OF 6 • • The applicant is proposing one non-illuminated sign,not exceeding 1.5 square feet,which shall be attached to the residence or placed in a window. This standard is met. b. No more than one outside volunteer or employee who is not a principal resident of the premises; The applicant states there will be no outside volunteers,paid employees,or subcontractors related to this home occupation.This standard is met. c. No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; The applicant states the business will not generate more than six (6) daily customers,between the hours of 10 a.m. and 7 p.m. In addition, the subject property includes an attached two-car garage and large,paved driveway that can provide off-street parking for the applicant and any customers. This standard is met. d. Storage of materials,goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five percent of the total lot area and shall not occur within the front yard or the required side yard setback. The applicant is not proposing any outdoor storage of materials,goods,or equipment.This standard does not apply. 18.742.060 Permit Procedures for Type I and Type II Home Occupations B. Type II home occupation permit.A Type II home occupation permit will be processed by means of a Type II procedure, as governed by Section 18.390.040, after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.2 and subject to the following approval criteria: 1. Is in conformance with the standards contained in this chapter; and As detailed in the findings above, this application is in conformance with the standards contained in this chapter, or will be consistent with the conditions of approval outlined in Section II. This standard is met. 2. Will be subordinate to the residential use of the property;and The business will be subordinate to the residential use of the property.This home occupation will occupy 516 square feet of floor area,or approximately 21% of the existing 2,421-square-foot residence.This standard is met. 3. Is undertaken in a manner that is not detrimental nor disruptive in terms of appearance or operation to neighboring properties and residents. The proposed business will be entirely contained within the existing detached,single-family dwelling, and will not be detrimental or disruptive in terms of appearance or operation to neighboring properties and residents. This standard is met. FINDING: The proposed Type II Home Occupation complies or can be made to comply with all statutory and ordinance requirements and regulations,as demonstrated by the analysis I I0P2015-00040 IRAN I IOMF.OCCUPATION PAGE 5 OF 6 III • contained within this administrative decision,and through the imposition of conditions of approval. SECTION VI. OTHER STAFF COMMENTS The City of Tigard Building and Engineering Divisions were sent copies of the applicant's proposal, and had no objections. SECTION VII. AGENCY COMMENTS Tualatin Valley Fire and Rescue was sent a copy of the applicant's proposal,and had no objections. SECTION VIII.
