Nicolas Capistrano III, as Trustee of the Nicolas Capistrano III Revocable Living Trust U/T/A dated January
14, 2003, as to an undivided one-half interest and Cristina Capistrano, as Trustee of the Cristina Capistrano
Revocable Living Trust U/T/A dated January 14, 2003, as to an undivided one-half interest, hereinafter called
the Grantors, grant and convey unto the City of Tigard a temporary easement for constructing, reconstructing,
operating, inspecting, and repairing of public improvements and appurtenances, together with the right to remove, as
necessary, vegetation, foliage, trees, and other obstructions on the parcel of land described in Exhibit "A", situated in
the City of Tigard, Washington County, State of Oregon.
THE TRUE CONSIDERATION for this conveyance is $ 3,220.00. However, the actual consideration consists of or
includes other property or value given or promised which is the whole consideration.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title, or interest except those
expressly stated in this easement; nor otherwise prevent Grantors from the full use and dominion there over;
provided, however, that such use shall not interfere with the uses and purposes of the intent of the easement.
Nicolas Capistrano III Revocable Living Trust:

The rights granted by this easement shall be for a two year period of use that begins 21 days after written notice
from the City to the owner(s). Rights will terminate upon City issuance of certificate of construction completion
or five years from the signing of this document, whichever is sooner.
