Val, it is our understanding at this point,that we are still running into complications between Miller
Engineering, and our vendor, Rowell Engineering that they are working through. As soon as we have
information, we will complete this item on the list.
FIRE-LIFE-SAFETY
**New Remark A...
--Val, we are bringing to our meeting today two separate proposals as alternatives to this issue. We will
go over them at our meeting on Thursday, October 5th at 2 PM at your office. Hopefully they will suffice
and we can complete this issue.
3. Required Wall Rating Assemblies
Owner Response—Rated Assembly information is being submitted with this letter to address all rated
walls, floor/ceiling, and roof issues.
6. Copy of STC 50 System and TJI designed floor system
Owner Response—STC 50 System rated assembly information provided via both printed material and
the gypsum manufacturer book showing the UL rating system for an STC 50 system. From numerous
printed materials,the STC 50 rating shall consist of: One layer of 5/8" gypsum wallboard on each side of
single studs,plus an additional resilient typical sound channel on one side of the wall. Pictures and
diagrams to follow. In addition, copy of the TJI floor system designed by BMC West showing layouts
and details of both second and third floor framing are enclosed.

Owner Response—Copy of previously submitted TVF&R report has been enclosed. In addition, during
the Thursday, October 5, 2006 meeting,the fire marshall is going to be present to address any other issues
that you feel are necessary as a result of this report.
16. Egress Pathway Issues for Porte Cochere
Owner Response—We will have a copy of the code book with us, and can discuss this issue in person to
determine the correct way to submit a response to this item.
23. Point of Safety—2' & 3rd Floors
Owner Response—Should be addressed with the re-drawing of plans submitted today due to issues
arising from Fire/Life Safety issue#A(New Remark from 8/9/06)
25. Roof Assembly information
Owner Repsonse—This item will also be addressed today,but roof is heavy timber construction which
should rate out to 1 hour construction without any problems. Again,the fire marshall will be in the
meeting today at 2 PM so we can discuss the use of heavy timbers versus standard construction and fire
burn times to ensure that we meet this requirement without any additional information since there are no
UL listings for straight heavy timber construction.

12353 SW Grant Street in Tigard.
As you recall,there were two major items that were discussed in the meeting that needed some sort of letter
to Val Henzel at the City of Tigard,or just a note to her stating that you were agreeing to the following

Ihose two items addressed were:
1.The Gate at the entrance to the property
—This gate will be allowed so long as there is a push buttonftutn-key entrance that releases the gate
automatically as the gate will be electrically controlled. In case of an electrical problem,the gate will be able
to be opened easily by a single person,as per code. In addition,we will attempt to put the gate far enough
back on the property to allow the fire truck to not sit in the street as per your request,although depending on
site engineering,we may not be able to get the truck 100%off the street
2. The Fire Hydrants to the property
--As this is a fully sprinklered building,you will allow Two fire hydrants to be placed on site,one on either
side of the driveway located directly behind the sidewalk in the public right of way.
In addition to these items,we discussed minor engineering issues that will be addressed and located on our
site plans. We will make all of those changes to the plans in order for the engineering to be signed off..

Ownership Response - These changes have now been made by Rowell

Per our counter meeting today,what you need to clear your part of the
Plan Check process for the Grant Street Elite Care Project is the following:
1) Two sets of complete Architectural and Engineering documents completely updated,
cross-referenced for consistent coordination,and wet signed by architect and engineer.
2) Engineering documents submitted by Rowell to Miller Engineering including all calculations
to be formatted on 24"x 36" sheets to match the remainder of the set of Permit Documents
and have those document included in the submission of the two updated sets.
You will then send the sets to Miller for their processing stamp and sign-off.
When that set is signed and returned to you from Miller,you will then be able to
issue your approval and sign-off.
That will clear your portion of the Plan Check Process.
You also mentioned that Emily Eng(Planner assigned to the project from Planning)
has not signed off on the Planning Portion of the Review. That needs to take
place before the permit is issued. I believe that Lilly from Bill Reed's office
is managing those issues at this point.
You also mentioned that Engineering has not issued their approval for issuance
of the Building Permit. Thank you for giving me the name of the Engineer now
assigned to the Project...Kim McMillan. I will contact them to see what it will
take to get their approval so as not to hold up the permit in that department.
Please let me know via email if this is your understanding as well.

RESPONSE RECEIVED 8/14/06 sent structural to Miller for review—**9/15/06 - Ray Miller spoke
with Todd Rowell on 8/16/06, on the requirements to meet the irregular building requirements and
not being able to use the simplified analysis approach per 1616.61, 1617.5 has to be designed per sec
1620.2.3 requirements. Therefore, they stated they will be submitting new structural calcs and design
complying with chapter 16.
FIRE LIFE-SAFETY- Please provide the following;
Revise stairway landing to comply with code requirement as stated below.
B. On sheet A2.2 the interior stair has been reduced 7" as was submitted from prior plan and now
has the issue of the door swinging over the landing and reducing landing past what is allowed per
1009.4 exception 2.
Stairway landings. There shall be a floor or landing at the top and bottom of each stairway. The width of
landings shall not be less than the width of stairways they serve. Every landing shall have a minimum
dimension measured in the direction of travel equal to the width of the stairway. Such dimension need not
exceed 48 inches where the stairway has a straight run.

I will be sending off a note to the fire marshal)this afternoon regarding the two items we discussed,which will
hopefully ensure that those items are signed off.
It appears that the two items that I need send a response are the following.
Item#6- Copy of STC 50 system.—our architect is getting us a copy of that, and I will be bringing a copy to your
office on Tuesday, October 10th.
Item#25—Roof assembly—we agreed that the one hour roof construction can be heavy timber construction
covered with 2x6 T&G 'Car Decking',then '/"Plywood then our foam insulation, and finally a metal roof.
I will be bringing a document to you on Tuesday, October 10th.
That leaves only one item, the stairwell exits which our architects are re-drawing and I will be submitting as soon
as possible.

When I got back to the office and checked our fire hydrant map it appears there is an existing hydrant on Grant
Street near your proposed development. If there is indeed a hydrant within 600 feet of the proposed building,you
can use it rather than installing a new one. If it works for you, please note it on any submitted site development
drawings and indicate the distance from the site.

Thank you for your email. We have been in touch with our Structural Engineers, Rowell Engineering
in regards to this potential change. We are looking at the structural impacts of both Scheme A and B for
this stair....as well as any code impacts. (both IBC and Oregon State)
It appears at this point that we will have the answers ready to submit later this week,but we need
to have our State meeting(scheduled later today) to confirm how quickly we can resolve this.
We also had a brief call Monday with Brian concerning the code impacts of an open stair
between floors 3 and 2...and we need to complete our code verification to make sure
we are fully in compliance with all applicable codes for the occupancy of this building.

Dear Dr.Massih:
I received your letter and have noted your concerns. We thank you for allowing us to
provide you with the design services for you commercial building. As you know the building
and site plans were approved over a year ago. You then worked with a contractor and had us
change from wood engineering to a composite wood and steel framing. That was in December
of 2005. Then a few weeks ago you requested that we change back to all wood. Miller
Engineering was asked to reevaluate the structural calculation by the City of Tigard and this
reevaluation is requiring us to reengineer the building from the 1997 Uniform Building Code to
the 2003 International Building Code. This is not our fault. However,it does require us to
completely redesign the building to a much higher level of analysis than under the previously
approved 1997 USC,and redraw the structural components.
I have talked to Harris aholrt the changes and resubmittal to the city and his lack of
commitment to a date certain to finish the design. The changes are significant and he needed to
evaluate the method of making the changes. There is a need to redraw all the shear walls and
address reentrant loading paths and hold downs. I have committed him the resources to make
the changes. This will be turned in to Miller Engineering by Friday,April 21,2006. Hiring
another engineer and even finding one who has the timc to look at this issue would takeweeks
longer than that. I know because I have had clients attempt to find engineers to no avail and
even if one says they will get to it.it just will not happen that wa
