I've told Matt Fricke and Bill that we cannot issue their permit MST2015-00229, even though it is a direct replacement
for the house previously on the same lot, because the infrastructure for the subdivision is not yet substantially complete
as required by Condition of Approval#25.
Bill has said that other jurisdictions allow the direct replacement of a previously existing home prior to completion of all
of a subdivision's infrastructure and points out that the lot in question is still served by the laterals that served the
previous house and that the paved street still exists in front of it. His argument is that the infrastructure serving this
house is substantially complete.
He asked whether it would help if he changed this application to be for a model home and he mentioned the example of
River Terrace where we are allowing model homes without prior completion of all the infrastructure. As I see it,the
case for allowing an exception to the rule and allowing a direct replacement is stronger than the case for allowing
construction of a model home: both are subject to the infrastructure restriction but the direct replacement can point to
the already existing infrastructure for the subject lot.

He has offered to not allow occupancy of the house until the subdivision infrastructure is complete but he requests that
we reconsider the situation and allow him to begin construction on this first house for the subdivision.
The plat is at the County waiting for the applicant to provide documents and fees.
Would you care to reconsider yesterday's decision?

Thanks for talking to me yesterday and your help on this.
Please let me know who I need to speak to,and/or what path the city would find easiest to allow us to start the one
home on lot 3.
I have an excavator,foundation crew, etc. now sitting that had blocked out these dates. I also have a buyer I may lose
over this.
I am confused what the concern is here. We are replacing one home on one tax lot that was demo'd. This should not
subject to the land use action. The house was placed to meet current'/existing tax lot setbacks, and future lot 3
setbacks.
I am also ok with a provision on the permit that no occupancy/final can happen until the plat is done and recorded, if
that would help.
The issue with infrastructure is also confusing. A)there is normally nothing that can be required on streets in a demo
and rebuild situation, b) there is an existing road with more than adequate wearing surface/width, etc., c) utilities, and
fire hyrant are there, etc.
If a model home permit is simpler, faster,and not too cost prohibitive, I am fine with that. Obviously that is an option as
we see/have seen Polygon and other builders starting multiple homes in unfinished sites.
Lastly, we were told in writing this permit was ready to pick up. I hope the city can find a way to help us start this
home. We expect to be done in about 30 days with the plat, but losing this month to start one home, my subs time, and
losing my buyer is a big deal for us.

building permits until the infrastructure is deemed to be substantially complete,consistent with Condition of Approval
#25 of SUB2015-00006,the underlying land use case. That condition reads: "Prior to issuance of building permits, all
elements of the proposed infrastructure ... shall be in place and operational ..."

Matt, I erred recently in approving 4 Hoggans Park permits for issuance. I missed the fact that your infrastructure is not
complete and that we do not yet have a copy of a recorded plat.
I believe you have been notified that these permits were ready to be issued but I have to cancel that. So this confirms
that the following permits are NOT yet ready to be issued: MST2015-00287, -00285, -00282, and -00229. I apologize for
the confusion.
Please let me know when you have submitted a copy of the recorded final plat and your infrastructure is complete so
