DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLA2015-00006 Thorpe Lot Line Adjustment 1 CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED: 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. 2. The applicant shall provide adequate screening between both proposed flag accessways and abutting lots,in accordance with TDC 18.745.050. 3. The applicant shall comply with Tualatin Valley Fire and Rescue standards. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the north side of SW Oak Street, west of SW 69'h Avenue, and east of SW 70'h Avenue. Parcel 1 (6917 SW Oak Street; WCTM 1S136AA, Tax Lot 600) is a flag lot that connects to SW 70'h Avenue via an approximately 75-foot-long accessway. Parcel 1 is also currently developed with a 1,460-square-foot single-family dwelling and 496-square-foot attached garage, multiple accessory structures, paved driveway, and associated landscaping. Parcel 2 is a separate tax lot (WCTM 1S136AA, Tax Lot 1200) that is currently utilized as an additional paved accessway for Parcel 1. Both parcels are zoned R-4.5 (Low-Density Residential),as are surrounding properties. Proposal Description: The applicant is proposing a lot line adjustment affecting two properties: 6917 SW Oak Street;WCTM 1S136AA,Tax Lot 600 (Parcel 1),and WCTM 1S136AA,Tax Lot 1200 (Parcel 2). APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; This proposal will not create any additional parcels. As a result of this lot line adjustment, both parcels will be flag lots: Parcel 1 will be 10,024 square feet in size,and Parcel 2 will be 15,532 square feet in size (exclusive of the flag pole areas).Accordingly,both lots exceed the minimum lot size for the R-4.5 zone (7,500 square feet for detached,single-family units).This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the R-4.5 zone. This criterion is met. LLA2015-00006 Thorpe Lot Line Adjustment 2 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; The average lot width for Parcel 1 is approximately 94 feet. The average lot width for Parcel 2 is approximately 110 feet. Accordingly, both parcels exceed the average minimum lot width for the R-4.5 zone (50 feet for detached,single-family units).This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the access way may not be included in the lot area calculation; As a result of this lot line adjustment,both parcels will be flag lots: Parcel 1 will be 10,024 square feet in size, and Parcel 2 will be 15,532 square feet in size (exclusive of the flag pole areas). Accordingly, both lots exceed the minimum lot size for the R-4.5 zone (7,500 square feet for detached, single-family units).This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and Parcel 1 will connect to SW 70`h Avenue by a minimum 15-foot wide accessway (flag pole). Parcel 2 will connect to SW Oak Street by a minimum 15-foot wide accessway (flag pole). This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Setbacks are addressed below,in Section 18.410.040.A.4.a. This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. The applicant is not proposing any development on the resulting Parcel 1 at this time. However, the proposed flag lot is large enough to accommodate a residence and still meet front and side yard setback requirements. Prior to building permit submittal, compliance with the standards outlined above will be ensured through site plan review. The resulting Parcel 2 will be a flag lot. Parcel 2 will also contain an existing 1,460-square-foot single- family dwelling with 496-square-foot attached garage, and existing accessory structures. Staff reviewed the applicant's submitted site plan to determine the existing dwelling and accessory structures do not meet the minimum 10-foot side yard setback for flag lots (MC 18.730.050.F. and 18.410.040.A.4.a). However, the existing parcel (1S136AA, Tax Lot 600) is also a flag lot. Additionally, staff reviewed the applicant's submitted title transfer instruments and deeds to determine Tax Lot 600 was lawfully created. Staff concludes that the single-family dwelling and accessory structures are legally nonconforming (18.760.040.C), as they previously existed on a lawfully created flag lot. Accordingly, existing buildings or structures located on Parcel 2 are not subject to the minimum 10-foot side yard setback for flag lots. However,new development will be subject the setback standards outlined in TDC 18.730.050.F. and 18.410.040.A.4.a. This criterion is met. LLA2015-00006 Thorpe Lot Line Adjustment 3 b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Parcel 1 will connect to SW 70th Avenue by an approximately 75-foot-long accessway (flag pole). Parcel 2 will connect to SW Oak Street by an approximately 220-foot-long accessway (flag pole). Both accessways are located within 10 feet of abutting lots. Therefore, this decision includes a condition that requires the applicant to provide adequate screening for both flag accessways,in accordance with TDC 18.745.050.As conditioned,this criterion is met. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. A condition of approval has been added that requires the applicant to comply with Tualatin Valley Fire and Rescue standards. As conditioned, this criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing a common drive to serve more than one lot. This criterion does not apply. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The minimum required access width for residential use is 15 feet (TDC Table 18.705.1). Parcel 1 will connect to SW 701h Avenue by a minimum 15-foot wide accessway (flag pole). Parcel 2 will connect to SW Oak Street by a minimum 15-foot wide accessway (flag pole). This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either satisfied or do not apply.The proposal is in compliance with the requirements of this Title. By doing so, this allows us to have a separate lot, accessible from SW 70th, and then our house on one lot. Instead of there being a lot for just the driveway, now it would include the house as well. The overall size of the 2 lots is over 28,000 square feet, the proposed lot line adjustment would make the 2 pieces of property more equal in size, one approximately 18,000 square feet, and one approximately 10,000 square feet.
