APPLICATION SUMMARY FILE NAME: Summerfield Civic Association CASE NO.: Minor Modification (MMD) MMD2016-00004 PROPOSAL: The applicant proposes to install a new above-ground fuel tank that is approximately 32 square feet in size. The tank will be located adjacent to an existing accessory building at 9690 SW Summerfield Drive. The applicant also proposes to construct a 6-foot-tall solid wood fence with an 8-foot-tall rolling gate to screen the tank from view by any neighboring residences, parking areas, or public streets. The R-7 zoning district is designed to accommodate attached single-family homes,detached single-family homes with or without accessory residential units,at a minimum lot size of 5,000 square feet, and duplexes,at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360.060.0 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. SECTION III. BACKGROUND INFORMATION Site Information: The project is located adjacent to an existing accessory building at 9690 SW Summerfield Drive; south of SW Summerfield Drive, and west of SW 98`h Avenue. The subject property is a 3.78-acre tax lot owned by the Summerfield Civic Association. The site is zoned Medium-Density Residential (R-7), as are surrounding properties. Proposal Description: The applicant proposes to install a new above-ground fuel tank that is approximately 32 square feet in size. The tank will be located adjacent to an existing accessory building at 9690 SW Summerfield Drive. The applicant also proposes to construct a 6-foot-tall solid wood fence with an 8-foot-tall rolling gate to screen the tank from view by any neighboring residences,parking areas,or public streets. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.060.0 states that a Minor Modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and The applicant proposes to install a new above-ground fuel tank that is approximately 32 square feet in size. The tank will be located adjacent to an existing accessory building at 9690 SW Summerfield Drive. The applicant also proposes to construct a 6-foot-tall solid wood fence with an 8-foot-tall rolling gate to screen the tank from view by any neighboring residences,parking areas,or public streets. Staff reviewed the applicant's narrative and site plan to determine the proposal complies with the special provisions for screening of service facilities,as outlined in TDC 18.745.050.E.2: "Screening of service facilities. Except for one-family and two-family dwellings, any refuse container or disposal area and service facilities such as gas meters and air conditioners which would otherwise be visible from a public street, customer or resident parking area, any public facility or any residential area shall be screened from view by placement of a solid wood fence or masonry wall between five and eight feet in height. All refuse materials shall be contained within the screened area." Accordingly, staff concludes the above-ground fuel tank will be adequately screened from view, and that the proposed solid wood fence and rolling gate meet the screening standards outlined above. Furthermore, compliance with state building code setback requirements will be ensured at the time of building permit submittal. Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met. This criterion is met. 2. The modification is not a major modification. Staff finds that the changes listed in TDC 18.360.050.B.1-11 are either satisfied or do not apply. Therefore,the proposed development is not a major modification.This criterion is met. The design will closely match the existing fence, we will use 6' x 6" x 1" cedar slats with 0 gap. A rolling, lockable gate of the same design will provide access and security on the driveway side. The building wall will complete the enclosure that will provide a minimum of 6' tall screening on all sides of the tank. Plant material, both existing and new on the outside of the fence will soften the visual impact.
