SECTION III. BACKGROUND INFORMATION
Site Information:
The subject property (15227 SW Seine Drive;\\QCT M 2S108DB,Tax Lot 7600) is a three-sided lot with
approximately 164 feet of direct frontage along SW Seine Drive. The 7,344-square-foot property is Lot
74 of the Polygon at Bull Mountain Subdivision (SUB2015-0002), which was approved by the City of
Tigard Planning Division in June 2015. This approval was for an 82-lot subdivision located in the River
Terrace Plan District. The property is zoned Low-Density Residential (R-4.5), as are surrounding
properties.
Proposal Description:
The applicant requests approval for one development adjustment to reduce the minimum front yard
setback requirement from 20 feet to 15 feet (25%). This proposed development adjustment will help
accommodate a new detached, single-family home at 15227 SW Seine Drive (\X/CTl\4 2S108DB, Tax
Lot 7600).
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.370 Variance and Adjustments
18.370.020 B. Development Adjustments.
1. The following development adjustments will be granted by means of a Type I procedure, as
governed by Section 18.390.030, using approval criteria contained in paragraph 2 of this
subsection B:
a. Front yard setbacks. Up to a 25% reduction of the dimensional standards for the front
yard setback required in the base zone. Setback of garages may not be reduced by this
provision.
b. Interior setbacks. Up to a 20% reduction of the dimensional standards for the side and
rear yard setbacks required in the base zone.
c. Lot coverage. Up to 5% increase of the maximum lot coverage required in the base zone.
The request is to reduce the minimum front yard setback requirement from 20 feet to 15 feet
(25%), which meets the description of TDC 18.370.020.B.1.a. This request is a development
adjustment and is being processed through a Type I procedure.
2. Approval criteria. A development adjustment shall be granted if there is a demonstration of
compliance with all of the applicable standards:
a. A demonstration that the adjustment requested is the least required to achieve the
desired effect;
The applicant requests to reduce the front yard setback requirement from 20 feet to 15 feet (25%),
in order to accommodate a new detached, single-family home of a particular design. The subject
property is a three-sided lot with approximately 164 feet of direct frontage along SW Seine Drive;
the property's buildable area is constrained by the lot's irregular shape. Staff evaluated the
applicant's subnutted site plan and narrative to determine that this adjustment is the least required
to achieve the desired effect, based on the factors discussed above. This criterion is met.
b. The adjustment will result in the preservation of trees, if trees are present in the
development area;
There are no trees present in the relevant development area. This criterion does not apply.

c. The adjustment will not impede adequate emergency access to the site;
Staff reviewed the applicant's submitted site plan to determine the proposed adjustment will not
impede adequate emergency access to the site. Furthermore,the subject property has approximately
164 feet of direct frontage along SW Seine Drive. This criterion is met.
d.There is not a reasonable alternative to the adjustment which achieves the desired effect.
The applicant requests this development adjustment in order to accommodate a new detached,
single-family home of a particular design. As discussed above, the subject property's buildable area
is constrained by the lot's irregular triangle shape. Accordingly, staff finds there is not a reasonable
alternative to the proposed adjustment which achieves the desired effect.This criterion is met.
CONCLUSION: This proposal is for a Development Adjustment, and is in compliance with the
applicable standards of this Tide.

B. Development adjustments.
1. The following development adjustments will be granted by means of
a Type I procedure, as governed by Section 18.390.030, using
approval criteria contained in paragraph 2 of this subsection B:
a. Front yard setbacks. Up to a 25% reduction of the dimensional
standards for the front yard setback required in the base
zone. Setback of garages may not be reduced by this
provision.
Response: Lot 74 of Polygon at Bull Mountain project proposes to reduce the
front yard setback by 25% from 20 feet to 15 feet due to an irregularly shaped lot.
The garage setback is not reduced by this request, as demonstrated on the attached
site plan.
b. Interior setbacks. Up to a 20% reduction of the dimensional
standards for the side and rear yard setbacks required in the
base zone.
Response: No interior setback adjustments are proposed.
c. Lot coverage. Up to 5%increase of the maximum lot coverage
required in the base zone.
Response: No lot coverage adjustments are proposed.

2. Approval criteria. A development adjustment shall be granted if
there is a demonstration of compliance with all of the applicable
standards:
a. A demonstration that the adjustment requested is the least
required to achieve the desired effect;
Response: The front yard setback is the only proposed adjustment. No other
setback adjustments are proposed. In order to meet the requirements of the other
setbacks, a reduction of the front yard setback to 15 feet is necessary. The garage
setback is not reduced and remains at 20 feet. The requested adjustment is the
least required to achieve the desired effect.
b. The adjustment will result in the preservation of trees, if
trees are present in the development area;
Response: There are no existing trees on site.
c. The adjustment will not impede adequate emergency access
to the site;
Response: The adjustment does not impede adequate emergency access.
d. There is not a reasonable alternative to the adjustment which
achieves the desired effect.
Response: The irregular shape of the lot precludes any reasonable alternatives
to the proposed reduction of the front yard setback to 15 feet.
