Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request subject to certain conditions of approval. The findings and conclusions
on which the decision is based are noted in Section IV.

CONDITIONS OF APPROVAL
THE FOLLOWING CONDITIONS SHALL BE SATISFIED:
1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of
the recorded survey map to the city within 15 days of recording to be incorporated into the record.
2. The applicant shall provide adequate screening along the flag accessway's east side, in
accordance with TDC 18.745.050.
3. The applicant shall comply with Tualatin Valley Fire and Rescue standards.
THIS APPROVAL SHALL BE VALID FOR 18 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION.
SECTION III. BACKGROUND INFORMATION
Site Information:
The subject parcels are located on the south side of SW Greenburg Road,west of SW 95```Avenue,and
east of SW 98th Avenue. Both Parcel 1 (11477 SW Greenburg Road,WCTM 1S135CD,Tax Lot 9200)
and Parcel 2 (11463 SW Greenburg Road; WCTM 1S135CD, Tax Lot 9100) are flag lots that connect
to SW Greenburg Road via a minimum 20-foot-wide access easement. Both parcels are currently vacant
and undeveloped.
In 1994, the City of Tigard Planning Division approved a three-lot Minor Land Partition (Drennan
Partition, Case No. MLP1994-00003) for Parcel 1, Parcel 2, and 11455 SW Greenburg Road (WCTM
1S135CD, Tax Lot 9000). The site was also approved for a variance to reduce the minimum rear yard
setback requirement from 15 feet to 131/2 feet. All three parcels are zoned Medium-Density Residential
(R-12), as are surrounding properties to the north,west, and east; adjacent properties to the south are
zoned Low-Density Residential (R-4.5).
Proposal Description:
The applicant is proposing a lot line adjustment affecting two properties: 11477 SW Greenburg Road,
WCTM 1S135CD, Tax Lot 9200 (Parcel 1); and 11463 SW Greenburg Road, WCTM 1S135CD, Tax
Lot 9100 (Parcel 2). As a result of this lot line adjustment,Parcel 1 will be 7,819 square feet in size,and
Parcel 2 will be 6,199 square feet in size. Both parcels are flag lots, and parcel sizes are calculated
exclusive of any accessway area.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC)
Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request:
Section 18.410.040
A. Approval Criteria states that the Director shall approve or deny a request for a lot line
adjustment in writing based on findings that the following criteria are satisfied:
1. An additional parcel is not created by the lot line adjustment, and the existing parcel
reduced in size by the adjustments is not reduced below the minimum lot size
established by the zoning district;
No additional parcels will be created as a result of this lot line adjustment. Both parcels are flag lots:
Parcel 1 will be 7,819 square feet in size, and Parcel 2 will be 6,199 square feet in size (exclusive of the
flag pole areas). Accordingly, both lots exceed the minimum lot size for the R-12 zone (3,050 square

feet for single-family or multi-family units). This criterion is met.
2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the
site development or zoning district regulations for that district;
Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line
adjustment will not result in any violations of the site development or zoning district regulations for the
R-12 zone.This criterion is met.
3. The resulting parcels are in conformity with the dimensional standards of the zoning
district, including:
a. The minimum width of the building envelope area shall meet the lot
requirement of the applicable zoning district;
There is no average minimum lot width requirement for the R-12 zone. This criterion does not apply.
b. The lot area shall be as required by the applicable zoning district. In the case of
a flag lot, the access way may not be included in the lot area calculation;
Both parcels involved in this lot line adjustment are flag lots: Parcel 1 will be 7,819 square feet in size,
and Parcel 2 will be 6,199 square feet in size (exclusive of the flag pole areas). Accordingly, both lots
exceed the minimum lot size for the R-12 zone (3,050 square feet for single-family or multi-family
units). This criterion is met.
c. Each lot created through the partition process shall front a public right-of-way
by at least 15 feet or have a legally recorded minimum 15-foot wide access
easement; and
Both Parcels 1 and 2 connect to SW Greenburg Road via a legally recorded 20-foot-wide access
easement. This criterion is met.
d. Setbacks shall be as required by the applicable zoning district.
Setbacks are usually addressed at the time of building permit application. However, the size and
configuration of the lots resulting from the lot line adjustment do not preclude a development meeting
the setbacks of the zone.This criterion is met.
4. With regard to flag lots:
a. When the partitioned lot is a flag lot, the developer may determine the location
of the front yard, provided that no side yard is less than 10 feet. Structures shall
generally be located so as to maximize separation from existing structures.
The applicant is not proposing any development on the resulting parcels at this time. However, the
proposed flag lots are each large enough to accommodate a residence and still meet front and side yard
setback requirements. Prior to building permit submittal, compliance with the standards outlined above
will be ensured through site plan review.This criterion is met.
b. A screen shall be provided along the property line of a lot of record where the
paved drive in an access way is located within ten feet of an abutting lot in
accordance with Section 18.745.050. Screening may also be required to maintain
privacy for abutting lots and to provide usable outdoor recreation areas for
proposed development.
Both Parcels 1 and 2 connect to SW Greenburg Road via a legally recorded 20-foot-wide access
easement. Part of this accessway is located within 10 feet of an abutting lot (11485 SW Greenburg
Road; WCTM 1S135CD, Tax Lot 300). Therefore, this decision includes a condition that requires the

applicant to provide adequate screening along the flag pole's east side, in accordance with TDC
18.745.050. As conditioned,this criterion is met.
5. The fire district may require the installation of a fire hydrant where the length of an
accessway would have a detrimental effect on fire-fighting capabilities.
A condition of approval has been added that requires the applicant to comply with Tualatin Valley Fire
and Rescue standards.As conditioned, this criterion is met.
6. Where a common drive is to be provided to serve more than one lot, a reciprocal
easement which will ensure access and maintenance rights shall be recorded with the
approved partition map.
The 20-foot-wide access easement was recorded in 1994 on the Drennan Partition final plat (MLP1994-
00003).This criterion is met.
7. Any access way shall comply with the standards set forth in Chapter 18.705: Access,
Egress, and Circulation.
The minimum required access width for three or more residential units is 20 feet (TDC Table 18.705.1).
Both Parcels 1 and 2 connect to SW Greenburg Road via a legally recorded 20-foot-wide access
easement. This criterion is met.
FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments
are either met, satisfied through conditions of approval, or do not apply. The proposal
is in compliance with the requirements of this Title.

A Lot Line Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is

The following is the owner's statement regarding Tigard Community Development Code
18.410.040. (The applicable Development is followed by European Classic Homes LLC's
comment)
18.410.040 Approval Criteria
A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing
based on findings that the following criteria are satisfied:
1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in
size by the adjustments is not reduced below the minimum lot size established by the zoning
district.
Comment: No new parcel is being created by this lot line adjustment, and the R-12 zoning of these
parcels require a minimum of 3050 Sq. Ft.. Both of this criterion is met with this lot line
ad justment.
2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site
development or zoning district regulations for that district.
Comment: the size of Parcel 2 is being increased with this lot line adjustment and the size of Parcel
1 is being decreased to 7,819 Sq. Ft. Both new sizes are within the requirements for the R-12
district. There are no structures on Parcel 2. There is a foundation that was poured on Parcel 1 on a
building permit that was issued in the 1990's. However, this building permit was voided and the
construction was abandoned in 1996. Even if the old permit was re-newed, the footprint of the
existing foundation meets the setback requirements of the adjusted lot line. Therefore, the criterion
is met with this lot line adjustment.
3. The resulting parcels are in conformity with the dimensional standards of the zoning district,
including:
a. The minimum width of the building envelope area shall meet the lot requirement of the
applicable zoning district;
Comment: The widths of both Parcels are not changed with the approval of this lot line adjustment.
Therefore,the criterion is met with this lot line adjustment.
b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the
accessway may not be included in the lot area calculation;
Comment: Both parcels meet the required 3050 SQ. Ft. with this lot line adjustment. Parcel 2 is a
flag lot and will have a total of 9698 Sq. Ft., of which 3499 sq. ft. is an accessway. Parcel 2 will
contain 6199 Sq. Ft. of buildable sq. ft. after the lot line adjustment. Therefore, the criterion is met
with this lot line adjustment.
