The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units, at a minunum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.410.040. LLA2014-00004/5 Phoenix Redevelopment Lot Line Adjustment 1 PFPP— SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section BT. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED The applicant shall record the lot lune adjustment with Washington County and submit a copy of the recorded curve), map to the Cit),within fifteen days of recording to be incorporated into the record. A reciprocal easement which will ensure access and maintenance rights for the benefit of Lot 2 and Lot 3 shall be recorded with the approved partition map. At the time of building permit application a minimum 10-foot side yard setbacks must be shown and screening must be provided where a paved drive is located within 10 feet of an abutting lot, pursuant to 18.745.040. The applicant shall provide a iniimum of 10 feet paved access way for Lot 2 and Lot 3. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the south side of SW Sattler Street between SW 98°i Avenue and SW 100' Avenue. Lot 1, fronting on Sattler, is developed with a single family home. The applicant wishes to adjust the lot lines to accommodate a larger central lot for development of a single-family dwelling. Both Lots 2 and 3 will be flag lots. Proposal Description: The applicant is proposing two lot line adjustments affecting three lots: The applicant is proposing to adjust two (2) lot lines, which will reconfigure three (3) different lots. Lot 1 is located at 9880 SW Sattler Street and Lot 2 and Lot 3 are adjacent lots to the south. Lot #1 (Tax Lot 700) of.44 acres will become .34 acres, Lot #2 (Tax Lot 600) of .14 acres will become .24 acres, and Lot #3 (Tax Lot 500) of.38 acres will become .24 acres. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size LLA2014-00004/5 Phoenix Redevelopment Lot Line Adjustment 2 established by the zoning district; No new lots will be created as part of this adjustment; the two lots comply with the minimum lot area requirements for the ]Z-7 zone, a minimum lot size of 5,000 square feet. This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Based on the plans submitted, the lot line adjustment does not create any, violations of the site development or zoning regulations. The existing shed is noted on the site plan to be removed. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. As shown in the Site Plan date Jul), 14, 2014 and the Record of Survey dated July 21, 2014, the three lots will satisfy, the minimum lot width for the R-7 zone, conform to setbacks requirements, and have a legall), recorded 20 foot access easement. Lot 1 (Tract 1) has 133 feet of frontage on SW Sattler Road; Lot 2 ("Tract 3) and Lot 3 (Tract 4) are flag lots that will be sei ved by the proposed 20-foot wide utility and access easement. This criterion is satisfied. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front.yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Existing Lots 2 and 3 are flag lots. "The applicant's submittal shows the flag lots fronting to the east, facing the accessway. Side yards are shown as 6 feet, which does not meet the tniniunum 10 foot side )-ard setback standard. Setbacks will be reviewed at the time of building permits. A paved access is shown within 10 feet of the property line, but no screening is shown. The flag lot criteria have not been nnet. At the time of building permit application a minimum 10-foot side yard setbacks nnust be shown and screening must be provided where a paved drive is located within 10 feet of an abutting lot, pursuant to 18.745.040. 5. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. Fire h),drant location is indicated on the site plan to be within 250 feet of the accesswa}, to Tract 2. -I-\jF&&R has approved the proposal as provided in the applicant's materials. This criterion is satisfied. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. LLA2014-00004/5 Phoenix Redevelopment Lot Line Adjustment 3 A common driveway is proposed with this lot line adjustment, therefore, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. As conditioned, this criterion is met. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. Pursuant to Chapter 18.705, the following standards apply' to an access way serving two lots, Lots 2 and 3. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. Floodplain, greenway, and right-of-way dedication is not required as part of this application. This criterion does not appl}. C. Variances to development standards. An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. "There are no applications for variance. Applicant proposes to adjust the parcel with the house at this address (Parcel 700) and the two parcels (500 & 600) immediately south of said house. This first LLA will adjust Parcels 600&700 by increasing Parcel 600 and reducing Parcel 700. The 2nd LLA will adjust Parcels 500&600 by further increasing Parcel 600 and reduce Parcel 500. The end result will be (3)Tracts. Tract 1 (with the existing house) will be 0.34 acres and TractsjZ&,X will each be 0.30 acres. See attached "Lot Line Adjustment Sequence" exhibit. LLA Approval Criteria (TDC 18.410.040) 1.) An additional parcel will not be created by this LLA and the existing parcel being reduced will not be reduced smaller than the 5,000 sqft minimum lot size required in the R7 zone. The reduced lot will be 14,740 sqft. 2.) The structures on the reduced parcel will not violate site development or zoning district regulations. In fact, the only lot line that is being moved is the rear lot line and after it is moved it will still be 26.97' from the rear wall of the structure, well in excess of the 15' required by the zoning district. The total area of all structures and impervious surfaces will also fall well below the 80% Maximum Lot Coverage requirement 3.) The resulting parcels are in conformity with all dimension standards of the zoning district, including: a.) The minimum width of the building envelope on both lots will be met b.) The lot areas of both lots are well in excess of the minimum requirement in the R7 zone c.) Parcel 600 will be configured as a flag lot and will have a legally recorded 15-foot wide access easement d.) Setbacks on the existing structure located on Parcel 700 will conform with the requirements of the R7 zone district 4.) Since Parcel 600 will be configured as a flag lot, the requirements will be met: a.) Given the size of the resulting parcels,there will be plenty of room to create and maximize separation between structures b.) a landscaped screen already exists between these two Parcels and the lots to the east. 5.) This will be met as required by the fire district. However, preliminary measurements have been shown to meet TVFD's requirements. 6.) Since this LLA is 1 of 2 and the 2"d LLA will configure Parcel 500 as another flag lot,there will be a common drive to serve the two lots south of the existing structure. As such,a reciprocal easement to ensure access and maintenance rights will be recorded with the approved partition map. 7.) The property consists of tax lots 500 and 600 of Map 2 south, range 1 west, section 11 CA. Currently a single family home is located on the lot to the north immediately adjacent to Sattler Road. The two tax lots are undeveloped with mostly grass and some small shrubs and trees located primarily around the perimeter, The project site runs downhill to the south from Sattler Road for approximately 300 lineal feet dropping from an elevation of 274 feet to 255 feet from the north to the south, The site is approximately 140 lineal feet from west to east and drops approximately 3 to 4 feet towards the east. Run off from the existing single family residence and the undeveloped portion of the site currently sheet flows to the south and infiltrates into the ground. The site is cut off from any public or private storm sewer system. According to the Soil Conservation Service's soil survey of Washington County the site consists of Aloha Silt Loams which are classified as 'C' type soils. Attached is a copy of the infiltration report prepared by Geotech Solutions, Inc. Proposed Improvements The project consists of a driveway off of Sattler Street providing access to two new single family residences (See attached preliminary site plan). It is assumed that the long driveway improvements off of Sattler Street will be collected at the south end of the driveway and discharge into the bio-cell on parcel 2. Water Qualit The project will meet Clean Water Services' standards for water quality using a bio-cell per Clean Water Services low impact development approaches (LIDA) manual. It is anticipated the proposed project will meet CWS' water quality standard of 65% removal of phosphorous for the treated areas. Water Quantit All storm water runoff for the proposed improvements will be retained on site and infiltrated. Attached are a copy of the bio-cell storage spread sheets and a copy of the infiltration testing report from Geotech Solutions, Inc. An infiltration rate of 0.8 inches per hour using a safety factor of 2.0 was used to size the infiltration facilities and determine the maximum storage volume for the 2, 5,10, and 25 CESNW,Inc. From our communications we understand the site is to be redeveloped for several lots with an access easement/drive to the east. Infiltration rates are needed to evaluate shallow on-site storm water system design by others. Our scope of work included the following: > Provide principal-level project management including client communications, management of field and subcontracted services, report writing, analyses, and invoicing. Review previous reports, geologic maps and vicinity geotechnical information as indicators of subsurface conditions. > Complete a site reconnaissance to observe surface features relevant to geotechnical issues, such as topography, vegetation, presence and condition of springs, exposed soils and rock, and evidence of previous grading. Explore subsurface conditions with two test pits advanced to a depth of up to 8 feet or refusal using a small track mounted excavator. Provide a water tank and casing for infiltration testing. Complete open hole or cased hole falling head infiltration testing in the explorations, and provide infiltration rates to the civil engineer for their system design, including related geotechnical material and embedment recommendations. Classify and sample materials encountered and maintain a detailed log of the explorations. Provide a written letter report summarizing the results of our geotechnical evaluation. Subsurface Conditions We completed our geotechnical explorations on May 28, 2014 using a small rubber-track mounted excavator by excavating two test pits to depths of up to 8 feet. Our test pits are approximately located on the attached Site Plan. Subsurface conditions consisted of soft to stiff silt with angular basalt fragments at depth in TP-2. Slow seepage was observed at a depth of 7 feet in TP-2. No caving was observed in our exploration, Infiltration Falling head infiltration testing was completed at depths of approximately 3.5 to 4 feet in each exploration, using a double ring standpipe configuration and falling head measurements after initial saturation and up to 2 feet of head. Raw results are listed in the Attached Test Pit Logs. Based on the results of our testing and analyses we recommend using a design infiltration rate of 0.8 cubic inches per hour per square inch (this includes a reduction factor of 2 applied to the average of the test results) applied to the sides of systems, with the base also used if the upstream collection system is protected from sedimentation. 112 1/12 7'Stree4 Oregon City, OR 9 7045 p503.657.3487 fS03.722.9946 May 2 9, 2014 phoenixredev-i 4-2-gi Trench systems must be protected from silt intrusion with the use of non-woven geosynthetics, such as a Propex Geotex 601 or equivalent. Rock for system fill must be open graded and contain no more than 2% fines. Field Testing As actual subsurface conditions and infiltration can vary widely, testing of infiltration systems is required to confirm this preliminary estimate. Flexibility for adaptation of infiltration systems should be planned into the design and construction, with contingencies built into the budgets and schedules. Infiltration systems need to be maintained free of debris and silt in order to function properly. Limitations We have prepared this report for use by Phoenix Redevelopment and members of the design and construction teams for this project only. The information herein could be used for bidding or estimating purposes but should not be construed as a warranty of subsurface conditions. We have made observations only at the aforementioned locations and only at the stated depths. These observations do not reflect soil types, strata thicknesses, water levels or seepage that may exist between observations. We should be consulted to observe all excavations for infiltration systems. We should be consulted to review final design and specifications in order to see that our recommendations are suitably followed. If any changes are made to the anticipated locations, configurations, or construction timing, our recommendations may not be applicable, and we should be consulted. The preceding recommendations should be considered preliminary, as actual soil conditions may vary. In order for o ur recommendations to be final, we must be retained to observe actual subsurface conditions encountered. Our observations will allow us to interpret actual conditions and adapt our recommendations if needed.
