Modifications include 1) construction of a drive aisle, 2) private storm drainage improvements,and 3) a private water line on the subject site. LOCATION: The property is located at 9925 SW Greenburg Road; Washington County Tax Assessor's Map 1S126CD,Tax Lot 100. ZONING: R-4.5: low-density residential district. The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.330, 18.510, 18.730. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to the Conditions of Approval listed below. The findings and conclusions on which the decision is based are noted in Section IV. CONDITIONS OF APPROVAL Submit to the Planning Division (Gary Pagenstecher, 503-718-2434, garyp@tigard-or.gov) for review and approval: 1. Prior to site work, the applicant shall submit revised plans showing the required 15-foot setback for grave sites for all yards. 2. Prior to site work, the applicant shall submit revised plans showing the applicable right of way for Greenburg Road and the 15-foot setback for grave sites, 64 feet from centerline. THIS APPROVAL SHALL BE VALID FOR EIGHTEEN (18) MONTHS FROM THE EFFECTIVE DATE OF THE DECISION. BACKGROUND INFORMATION Site Histo : Crescent Grove Cemetery is Tigard's only non-profit,non-denominational cemetery and one of the oldest historic pioneer cemeteries in the Portland Metro Area, with headstones dating back 1852. The Staff conducted a search of City records for the subject 21.12 acre property,annexed in 1987, and found that no prior land use permits had been obtained from the city since that date. The site is currently developed as a cemetery with rave plots, mausoleum, office building, maintenance buildings, and access roads throughout the site. Vicinity Information: The subject property is zoned R-4.5,low density residential,and is located west of SW Greenburg Road. The site is surrounded on the north, west, and south by Washington Square Mall zoned MUC, mixed use commercial. Properties located across Greenburg to the east are zoned MUE-1, mixed use employment and include commercial and residential uses. Proposal: The applicant requests a minor modification of an existing cemetery conditional use. Modifications include 1) construction of a drive aisle, 2) private storm drainage improvements, and 3) a private water line on the subject site in preparation for platting the remainder of the site pursuant to state statutes and administrative rules. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Conditional Use—Chapter 18.330.020 Minor Modification of Approved or Existing Conditional Use: Any modification which is not within the description of a major modification as provided in Subsection B shall be considered a minor modification. An applicant may request approval of a minor modification by means of a Type I procedure, as regulated by Section 18.390.030, using approval criteria in Subsection C.3. Section 18.330.020.C.3 states that a minor modification shall be approved, approved with conditions or denied following the Director's review on findings that: The proposed development is in compliance with all applicable requirements of this title; and FINDING: As described in the applicant's narrative and plan set, and as provided in the findings for the applicable standards below, staff finds that all applicable requirements of this title are either satisfied or may be satisfied with conditions of approval applied with this decision. Therefore,the proposed modification may be approved. The modification is not a major modification. FINDING: Staff finds that based on the applicant's narrative and plan set, the threshold changes to determine a major modification, listed in TDC 18.330.020.B.2 (a-h), have not been exceeded or do not apply. Therefore, the proposed improvement plan is a minor modification and not a major modification. 18.330.050 Additional Development Standards for Conditional Use Types Additional development standards. The additional dimensional requirements and approval standards for conditional use are as follows: 10. Cemeteries: a. The minimum lot size shall be five acres; The subject lot is 21.12 acres. No new lots are proposed. This standard is met. CRESCENT GROVE CENIETARY PAGE 2 OF 5 NL%fD2015-00026 MINOR MODIFICATION TO AN EXISTING CONDITIONAL USE b. Setbacks: i. For graves only: (A) The front yard setbacks shall be a minimum of 15 feet; (B) The side yard setbacks shall be a minimum of 15 feet; and (C) The rear yard setbacks shall be a minimum of 15 feet. As shown on Sheet 3.2, the applicant has applied a 12-foot setback for graves and structures. The setback for graves is 15 feet for all yards. Although the actual grave plots shown along the northern boundary appear to meet the 15-foot setback, proposed grave sites along the curve leading to the western boundary appear to be setback less than 15 feet. This standard is not met. Therefore, the applicant shall submit revised plans showing the required 15-foot setback for graves. ii. For structures only: (A)The front yard setbacks shall be a minimum of 25 feet; (B) On corner lots and through lots, the setbacks shall be a minimum of 25 feet on any side facing a street,plus meet visual clearance areas, Chapter 18.795; (C) The side yard setback shall be a minimum of 25 feet; and (D) The rear yard setback shall be a minimum of 25 feet. As shown in Sheet C4.0 the proposed storm water swale is setback approximately 11 feet. The Tigard Development Code defines "Structure" synonymously with `Building, - That which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some define manner." The required setback for structures is 25 feet for all yards. In this case, since the swale will be at grade or sunken,it is arguably not a structure, as defined as having an edifice or being built up.Therefore,in this case the setback does not apply. c. Adequate fencing shall be provided.A fence of at least four feet in height located at least 2- 1/2 feet from any right-of-way shall completely surround the area and shall meet visual clearance areas; and A six-foot high fence surrounds the property on the north,west and south. No fence exists on the eastern boundary adjacent to SW Greenburg Road. Since the existing fence has proved adequate, no additional fencing will be required. This standard is met. d. There are no off-street parking requirements No off-street parking is required with the proposed modification. FINDING: As show in the analysis above, not all of the Additional Development Standards for Conditional Use Types are met. With the following condition of approval these standards can be met. CONDITION: Prior to site work, the applicant shall submit revised plans showing the required 15-foot setback for graves. Residential Zoning Districts (Chapter 18.510) R-4.5: low-density residential district. The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. A list of permitted, restricted, conditional and prohibited uses in residential zones is presented in Table 18.510.1. Compliance required.All development must comply with: 1.All of the applicable development standards contained in the underlying zoning district, except where the applicant has obtained variances or adjustments in accordance with Chapters 18.370; 2.All other applicable standards and requirements contained in this title. B. Development standards. Development standards in residential zoning districts are contained in Table 18.510.2. FINDING: Applicable development standards for the R-4.5 zone are contained in Table 18.510.2. Setbacks identified in the Table are superseded by the more specific development standards for conditional uses. Proposed development must comply with the applicable conditional use standards, above, and any other applicable requirements contained in Title 18,identified below. Exceptions To Development Standards (Chapter 18.730) 18.730.040 Additional Setback Requirements A. Additional setback from roadways. The minimum yard requirement shall be increased in the event a yard abuts a street having a right-of-way width less than required by its functional classification on the city's transportation plan map and, in such case, the setback shall be not less than the setback required by the zone plus 1/2 of the projected road width as shown on the transportation map. FINDING: The subject site is bounded on the east by SW Greenburg Road. Greenburg is identified as a collector on the Roadway Functional Classifications map in the 2010 Tigard Transportation System Plan. The road is under Washington County jurisdiction. According to Naomi Vogel, Associate Planner with the Washington County's Land Use and Transportation Department, the ROW is 49' from centerline and the existing right-of-way (row) is 30 feet from centerline. Therefore, any structural improvements to the site shall be setback 74 feet from centerline (49 feet row + a 25 foot front yard setback for structures) and grave sites shall be setback 64 feet from centerline (49 feet row + a 15 foot front yard setback for graves). As shown on Sheet C5.1 of the application, a 15-foot setback for proposed grave sites is shown from the existing property line. However, this setback does not account for the designed row width for Greenburg Road, with a 49-foot '/z street width from centerline. This standard is not met. As a condition of approval the applicant shall submit revised plans showing the applicable row and the 15-foot setback for grave sites, 64 feet from centerline.
