ZONING
DESIGNATION: MUE-1 and MUE-2: Mixed Use Employment Districts. The MUE-1 and 2
zoning district is designed to apply to areas where employment uses such as
office, research and development and light manufacturing are concentrated.
Commercial and retail support uses are allowed but are limited, and residential
uses are permitted which are compatible with employment character of the area.
Lincoln Center is an example of an area designated MUE-1, the high density
mixed use employment district. The Nimbus area is an example of an area
designated MUE-2 requiring more moderate densities.

APPROVED the above request. The findings and conclusions on which the decision is based are noted
in Section IV.

FROM THE EFFECTIVE DATE OF THIS DECISION.

SECTION III, BACKGROUND INFORMATION
Site Information:
The project is located at 9495 and 9485 SW Locust Street; north of SW Locust Street, west of SW
Greenburg Road, and east of SW 92"d Avenue. The 0.76-acre development site is made up of two (2)
parcels, and contains one (1) commercial building(approximately 8,000 square feet in size), landscaping,
and associated parking. The site is zoned Mixed-Use Employment (MUE-1), and is located in the
Washington Square Regional Center Plan District.
Proposal Description:
The applicant is proposing a minor modification to on-site parking and landscaping at 9495 and 9485
SW Locust Street.Specifically,the applicant proposes to:
1. Remove one (1) 20-inch London Planetree, remove one (1) 4-inch Hawthorn tree, and plant
five(5) new parking lot trees
2. Remove approximately 1,000 square feet of on-site landscaping
3. Create seven(7) new parking spaces,and lengthen three (3) existing parking spaces
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW:
Section 18.360.060.0 states that a Minor Modification shall be approved, approved with
conditions or denied following the Director's review and as follows:
1. The proposed development is in compliance with all applicable requirements of this
title;and
The applicant is proposing a minor modification to on-site parking and landscaping at 9495 and 9485
SW Locust Street.Specifically,the applicant proposes to:
1. Remove one (1) 20-inch London Planetree, in order to accommodate seven (7) new parking
spaces, and remove one (1) 4-inch Hawthorn tree that is in an advanced state of decline. The
applicant also proposes to plant five (5) new parking lot trees: one (1) European Beech,one (1)
Southern Magnolia,one (1) Red Oak,one (1)Accolade Elm,and one (1) Zelkova.All proposed
trees are identified in the Urban Forestry Manual's Parking Lot Tree List. Staff reviewed the
applicant's narrative and site plan to determine the proposal meets L-2 General Landscaping
standards for the Washington Square Regional Center Plan District(FDC 18.630.090.B).
2. Remove on-site landscaping from the northeast corner of the site and adjacent to the site's
main entrance off SW Locust Street, in order to accommodate the construction of seven (7)
new parking spaces, and the lengthening of three (3) existing parking spaces. Approximately
1,000 square feet total of landscaping will be removed. The minimum landscape requirement
for the MUE-1 zone is 15% (TLC Table 18.520.2). Staff reviewed the applicant's narrative to
determine after the reduction in landscape area the minimum landscape requirement will still be
met,with approximately 21%provided.
3. Create seven (7) new parking spaces,and lengthen three (3) existing parking spaces. The subject
site contains an approximately 8,000-square-foot commercial building occupied by a
medical/dental office use. As required in TDC Table 18.765.2, the minimum off-street parking
requirement for this site is 31 spaces (3.9 spaces/1,000 square feet). Staff reviewed the
applicant's site plan to determine there is adequate on-site parking,with 58 spaces provided.
Upon review of the applicant's plans and narrative,staff finds that all other applicable requirements are
met.This criterion is met.

2. The modification is not a major modification.
FINDING: Staff finds that the changes listed in TDC 18.360.050.B.1-11 are either satisfied or do
not apply. Therefore,the proposed development is not a major modification. This criterion is met.
CONCLUSION: The proposal is a Minor Modification of existing site development and is in
compliance with the applicable requirements of this Title.

The proposed changes are to include the removal of 2 Trees, one of them is in heavy decline at the back
corner of the property over the parking lot posing a threat of property damage or worse injury to
people.The other is in the proposed new parking area and has a canopy score of 1256'sq.This will also
reduce the turf grass by 896'sq in that area and reduce the water use on the landscape. We propose to
add 5 Trees to the parking lot Tree canopy score totaling 10,461'sq. providing coverage where none
exist now.
The proposal will add 7 parking spaces and increasing the depth of 3 parking spaces up front by the
entrance removing the Photinia along the turf grass to improve the line of site for people leaving and
entering, and will result in the loss of 156'sq of turf grass and again reduce the water usage in the
landscape. Adding 2 Trees to the landscape and cover to the parking spots.The 6 new parking spots are
in the back area of the property where the existing London Plain tree is located. The other parking space
will be added up front at the entrance opposite the 3 spaces to be made deeper also reducing the turf
grass by 128'sq and again less water usage in the landscape. One small section of Photinia will also be
removed on the east side of the property to allow the planting of one of the S Trees proposed to be
added to the landscape.
