Except where non-conforming,residential uses are limited to single- family residences located on the same site as a permitted use. A wide range of uses,including but not limited to adult entertainment, automotive equipment repair and storage,mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. MMD2015-00024 ()RI?(,ON BEVERAGE RECYCLING COOPI?R.A I IV'E I of 4 CONDITIONS OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO ISSUANCE OF A BUILDING PERMIT Submit to the Planning Department (Tim Lehrbach,503-718-2440) for review and approval: 1. Prior to issuance of a building permit the applicant shall submit evidence demonstrating compliance with performance standards for noise required by TDC 18.725.030 and provided in TMC 6.02.430. Any noise mitigation measures installed to ensure compliance shall be described in a narrative and identified on a site plan submitted with construction documents submitted for building plan review. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information and History: The property is located at 14411 SW Pacific Hwy.in the Canterbury Square shopping center. The 6.63- acre site is fully developed as a commercial shopping center with 19 tenants. The property fronts SW Pacific Hwy. to the southeast. Properties across Pacific Hwy. and adjacent to the northeast corner of the property contain a variety of commercial uses. Adjacent properties to the west and north are occupied by multi-family dwellings. The subject suite was previously occupied by the Asabache Mexican Restaurant. Enforcement cases initiated by the City of Tigard and Tualatin Valley Fire & Rescue addressed the suite's unauthorized conversion from an indoor entertainment use (pool hall) to an eating and drinking establishment (restaurant and nightclub) and failure to comply with fire codes concerning emergency egress and fire protection systems. The change in use category was subsequently approved (MMD2015-00017) but the applicant did not abate the fire code violations and has since vacated the space. Proposal Description: The applicant requests a minor modification to change the approved use of the suite to personal services to be occupied by a beverage container redemption center. The applicant proposes renovation of the existing suite including the installation of new egress doors and self-service container receptacles (reverse vending machines) to the exterior walls. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Chapter 18.360 Site Development Review 18.360.060 Minor Modification(s) to Approved Plans or Existing Development C. Approval criteria. A minor modification shall be approved, approved with conditions or denied following the director's review based on finding that: 1.The proposed development is in compliance with all applicable requirements of this title; and FINDING: The applicant requests changing the approved use of an existing commercial suite from indoor entertainment to personal services in order to operate a beverage container recycling center. For purposes of evaluating this proposal the indoor entertainment use that preceded the approval to change to an eating and drinking establishment is considered the existing approved use because the proposed restaurant did not attain legal occupancy. The most relevant of the applicable requirements concern noise regulation and off-street parking. 18.725.030 Environmental Performance Standards —Performance Standards A. Noise. For the purposes of noise regulation, the provisions of Sections 6.02.410 through 6.02.470 of the Tigard Municipal Code shall apply. The nearest noise-sensitive units offsite are located approximately 60 feet from the MM1)2015-00024 OREGON BEVERAGE RECYCLING COOPERATIVE 2 of 4 nearest exterior corner of the suite. The residents of these units have reported noise in excess of the relevant provisions generated by previous uses of the subject suite. The proximity of these units to the suite makes noise impacts an ongoing concern. Customers to the proposed beverage container redemption facility will have three options for redeeming beverage containers: (1) hand count by onsite personnel, (2) self- service receptacle (reverse vending machine), and (3) bag drop service. The applicant projects 20-25 customers per day. The center's hours of operation are 9:00 a.m. to 7:00 p.m., seven days per week. Transporting large numbers of beverage containers from vehicles to the center and inserting them into the self-service receptacles will generate exterior noise. A condition of approval is warranted to ensure that the development complies with the applicable provisions and that noise impacts are mitigated as necessary. With the condition the proposed development is in compliance with this requirement. CONDITION: Prior to issuance of a building permit the applicant shall submit evidence demonstrating compliance with performance standards for noise required by TDC 18.725.030 and provided in TMC 6.02.430. With the applicant's request, the revised number of parking spaces required for the shopping center is 235 spaces. As shown on the applicant's site plan, 320 parking spaces are provided onsite, a surplus of 85 spaces over the minimum. Therefore,the proposed development is in compliance with this requirement. As provided in the applicant's narrative and site plan, staff finds that all applicable requirements of this title are satisfied subject to a condition of approval with this decision. Therefore,this criterion is met. 2.The modification is not a major modification. FINDING: The proposed modifications are not within the description of a major modification provided in 18.360.050.B.1-11 and are considered minor.Therefore,this criterion is met. SECTION V. Customer using the self-service reverse vending machines and hand count, unload their containers from their vehicles into provided rolling tubs and bring them inside our retail area for counting and reimbursement. Customers who have BottleDrop account, may at home fill our BottleDrop green bags with their containers and drop their bag off either in the retail space or through the drop door provided on the side of the building. Once this bag is dropped off, a BottleDrop employee will count and process all of their containers and credit the customer's account. All container processing and returns happen within the interior of the building,exterior activities that will be happening during BottleDrop operating hours are customers transporting cans and bottles from their vehicles into the center, and loading of the compacted material from our facility into a trailer.The compacted product is transported on pallets, large bags, and/or large bins and moved by pallet jack into a trailer. The loading of the trailer will only happen during BottleDrop business hours and at all other times,the back roll up door will remain closed. BottleDrop has been in operation since 2010 and currently has 13 sites operating across Oregon. Many of these sites are adjacent to residential housing. Historically, we have only had one complaint of noise from a neighbor with an adjoining property line in Medford,Oregon.The complaint was dealing with the hours of our truck pick-up. We were picking up early in the morning before 7am,after receiving the complaint OBRC quickly changed our route pick-ups to during redemption center operating hours.After making this change, we did not receive any additional noise complaints about our operations.The only other issues that we have worked through in terms of noise complaints has been with neighboring P.O. Box 4468, Portland, OR 97208 • 3900 NW Yeon Ave., Portland, OR 97210 • (503] 222-2266 • Tax (503) 222-2291 commercial tenants. Some of our locations share walls with another businesses and we have found a solution to make sure noise created by the processing of containers stays within our interior space.At all of our locations that share an adjoining wall with another tenant,we have installed quiet rock and additional insulation in the ceiling to minimize any sound travel.This has satisfied all neighboring tenants and they are able to successfully run their businesses without any noise nuisance. Examples of our current neighbors include administrative office spaces for a variety of businesses, pizza restaurant, and a greenhouse supply store.With the exception of truck delivery and pick-up,as you can expect at any commercial establishment,we are able to keep noise levels from equipment and processing within our occupied space and not create a nuisance to those around us.
