BACKGROUND INFORMATION Site Information: The project is located on the Tigard Public Library site at 13500 SW Hall Boulevard; north of Wall Street, east of S\X/ I-fall Boulevard, and west of Fanno Creek. Fanno Creek Park occupies the northern portion of the property. The approximately 13.5-acre site is composed of three tax lots, and is located in the Parks and Recreation (PR) zone. The main Tigard Public Library building is approximately 48,000 square feet in size. The associated parking lot includes pedestrian walkways, a landscaped median, and a book drop-off area. The library was approved for its current location in 2003 with the approval of a Conditional Use Permit (CUP2003-00001). That also included Sensitive Lands Review (SLR2003-00001), an adjustment for bicycle parking (V.AR2003-00009), and an adjustment for street spacing standards (VAR2003-00020). In addition to the original Conditional Use Permit, multiple land use approvals have subsequently been issued for this site. Proposal Description: The proposed minor modification to an approved conditional use would allow the construction of a new Automated Material I-landler (AMI-l) system at the Tigard Public Library. Site modifications include the addition of a 37-square-foot aluminum awning above the AMII system for weather protection,installation of a 6'-wide concrete walkway, and removal of one 7"-caliper tree. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS The proposed site improvements will modify the approved conditional use on the site. Therefore, compliance with applicable development standards must be demonstrated. MINOR MODIFICATION OF APPROVED OR EXISTING CONDITIONAL USE: Section 18.330.020.C.3 states a minor modification shall be approved, approved with conditions, or denied following the Director's review based on the following findings: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: The applicant proposes to install a new Automated Material Handler (AMII) system near the southeast corner of the existing Tigard Public Library building. The AMII is an electronic book return system with a conveyor; the system will be accessed by customers from inside and outside the library building. The applicant proposes to add an approximately 37-square-foot (8' by 4'8") aluminum awning above the AMId system for weather protection; the awning will be installed 8' high, on the south-facing wall of the library. Staff reviewed the applicant's submitted plans and elevations to determine the proposed awning meets all applicable requirements of this Title and of the original Conditional Use Permit (CUP2003-00001). The applicant also proposes to construct a new 6'-wide concrete walkway from the parking lot to access the AMH system. This modification will result in the removal of one 7"-caliper tree. Staff reviewed city maps and determined the tree is located in Sensitive Lands (Lower Value Habitat Area), and is subject to the standards outlined in Section 6 of the Urban Forestry Manual. Accordingly, staff added a condition of approval that requires the applicant to apply for a tree removal permit prior to issuance of site and building permits. MM 0 201 5-00020 'I IGARD PUBLIC LIBRARY 2 43 Staff reviewed the applicant's narrative and plans to determine the proposal meets all applicable requirements of this Title and of the original Conditional Use Permit (CUP2003-00001). This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in TDC 18.330.020.B.2 are either satisfied or do not apply. Therefore, the proposed development is not a major modification. This criterion is met. CONCLUSION: The proposal is in compliance with the applicable requirements of this title, and is a minor modification of an approved conditional use. SECTION V.
