Memorandum of Understanding
Walk+Bike Education Jump Start Program 2015-2016
This Memorandum of Understanding ("MOU") is made and entered into by and between the
Tigard-Tualatin School District (hereinafter referred to as "TTSD"), the City of Tigard (hereinafter
referred to as "City"), and the Bicycle Transportation Alliance (hereinafter referred to as "BTA").
The 2015-2016 Walk+Bike Education Jump Start Program is focused on the elementary and middle
schools in Tigard. Since the City co-wrote the grant with TTSD, the Jump Start Program will first
focus on delivering bike education to interested schools in Tigard,with the potential to expand the
program to schools in Tualatin if resources allow.
RECITALS
1. TTSD, BTA, and the City (hereinafter referred to as the "Parties") recognize that
there are several community partners in implementing the Walk+Bike Education
Jump Start program (hereinafter referred to as "Jump Start"),including the Schools
and other local resources.
2. The Parties recognize the vital importance of the Jump Start program to increase the
number of students who safely walk and bike to school. These efforts yield the
following benefits: decreased traffic congestion and improved traffic safety,
improved health and fitness,increased physical activity,increased independence,
building neighborhood livability,increased alertness and academic achievement, and
improved air quality.
3. BTA provides resources and services to promote safe walking and biking. In so
doing,BTA has a responsibility to deploy resources as effectively and efficiently as
possible to ensure that the activities supported are conducted in accordance with the
highest legal, ethical, and financial standards.
4. The Parties recognize the importance of collaboration that allows for the
development of robust education activities to increase the number of students who
safely walk and bike to school.
5. The Parties acknowledge that the program and administrative support systems
supported by the Parties impose facilities and administrative costs on both Parties.
6. The responsibilities in this MOU represent the basic requirements for obtaining and
maintaining School eligibility to participate in the Jump Start program for the 2015-
2016 school year.

THE PARTIES therefore agree as follows:
TTSD RESPONSIBILITIES
TTSD will:
1. Require each School principal to provide the specific information needed as outlined
below as time and educational demands allow and to sign this MOU statement as
recognition of the Jump Start services and resources they are scheduled to receive.
2. Provide or require each School principal to provide BTA with contact information of
School faculty to be trained in safe walking and biking curriculum as needed to allow for
involvement in and evaluation of the Jump Start program with the goal of increasing the
number of students who safely walk and bike to school. BTA recognizes that school
faculty as volunteering their time and as such may have restricted availability.
3. Require each School principal to provide indoor meeting space with tables and chairs
large enough to conduct Jump Start trainings as needed to accomplish education
programming.
4. Require each School principal to provide BTA access to the School's PTA, PTSA, Site
Council, Staff, Safety Committee,Booster Club,Fellness Committee, and/or other
relevant School groups as needed and as time allows to provide information about the
jump Start program.
5. Require each School principal to collaborate with the BTA to enable the delivery of
training services and evaluation.
6. Ensure or require each School principal to ensure basic maintenance of Jump Start
program equipment.
7. Provide vehicle transportation to move Jump Start program equipment and materials
from School to School as needed.
BTA RESPONSIBILITIES
BTA will:
1. Provide a Project Manager(s) to provide training, equipment and materials, and to
function as advisor for each School's participation in Jump Start program activities.
2. Provide each School with the name and contact information of the Project Manager(s) to
be involved in each School's program.

3. Provide equipment (see Appendix 2 for details) and materials, training, newsletter
announcements and articles that encourage and promote the education of students in
safe walking and biking. BTA provided equipment will be in good working order and
ready for use by District. BTA guarantees that all helmets supplied by BTA to District
have a current CPSC,ASTM or Snell sticker, are less than five (5) years old and have
never been in an accident.
4. Develop and maintain program records to track participation.
5. Assist in developing relationships between the school district and local partners to
ensure basic maintenance of Jump Start program materials.
6. Partner to ensure basic maintenance of Jump Start program materials.
CITY OF TIGARD RESPONSIBILITIES
With regard to the elementary schools: Alberta Rider, C.F. Tigard, Deer Creek, Durham,Mary
Woodward,Metzger, and Templeton; and middle schools: Fowler and Twality;Tigard, the City will:
1. Work with TTSD to recruit School faculty to be trained in the safe walking and biking
curriculum.
2. Assist in developing outreach and communication with parents about the Jump Start
Program.
3. Promote the Jump Start Program to schools,parents, and the community to ensure support
and encouragement of safe walking and biking behavior.
4. Provide additional capacity to training program events,with the goal to train more School
faculty in years to come.
5. Collaborate with TTSD and BTA to establish an ongoing safe walking and biking curriculum
in Tigard Schools.
6. Offer the services of the Safe Routes to School Program Coordinator to help in tasks related
to the Jump Start Program and the Coordinator will work to integrate the bike education
program into the broader Tigard Safe Routes to School Program.

GENERAL PROVISIONS
1. Financial Management
A. BTA will be responsible for program costs necessary for the program
training and staff advisory role identified as BTA responsibilities in this MOU. BTA
will also be responsible for costs associated with Basic Maintenance of Jump Start
equipment at the end of the school year.
B. TTSD will be responsible for facilities, administrative costs imposed by the
program activities identified as TTSD responsibilities in this MOU and any costs
resulting from Gross Negligence of Jump Start equipment during the school year.
C. TTSD will be responsible for all maintenance of school property utilized as
part of the Jump Start program.
D. The City will be responsible for providing the cost of a coordinator and the
provision of other city staff as necessary to fulfill the duties described above.
2. Jump Start Materials
No materials produced by BTA and distributed through the Jump Start program shall
require pre-approval from the TTSD Administrative Superintendent or designee before
being distributed to teachers. However, should the TTSD Administration or School
Principal find format or content objectionable in any way, the BTA will work with the TTSD
Administration and/or School Principal to resolve the concern before distributing the
material
3. Liability
The Parties understand that walking and biking involve certain risks and dangers, and that
accidents may occur despite all reasonable care and prevention. Parents/legal guardians shall
assume all risks arising out of the Jump Start program. Each Part- shall indemnify the other
Party and its contractors, officers, employees, and agents from any action brought by a third-
party against the Party for claims, actions, causes of action, or any charge of any kind
whatsoever that may or could arise as a result of student participation in the Jump Start
program,including claims for injury, death, or property damage,whether or not caused by
the fault or negligence of the other Party.
4. Amendments
This MOU may be amended only by a written agreement signed by the Parties.

5. Early Termination of NlOtT
A. The Parties, by mutual written agreement,may terminate this MOU or the
participation with any School at any time.
B. BTA, on thirty (30) days written notice to TTSD and the City, may terminate
this MOU or its participation with any School for any reason deemed
appropriate at its sole discretion.

APPENDIX 1 - Definitions
Administration—the School officials who provide administrative leadership and services for the
School's Jump Start program.
BTA—the Project Manager and staff at the Bicycle Transportation Alliance
DISTRICT—selected District in Oregon.
Parties—the School and the BTA named in the MOU.
Project Manager—the BTA staff member who provides Jump Start project leadership and
management services.
School—Each TTSD school participating in the Jump Start program.
Basic Maintenance- Ensuring that the bikes included in the equipment remain in a condition fit to
ride including inflated toes as well as functioning chain, crank arm, cassette,quick releases,brakes,
and handlebars.
Gross Ne hg_gence-Any conduct through which TTSD leaves the equipment unsecured or otherwise
allows damage to the equipment brought about by carelessness during use. The equipment is valued
at$13,000. Certain equipment may be used without replacement (indicated in Appendix 2 by an
asterisk*).

APPENDIX 2- Project Description and Equipment
Brief Project Description:
In the Walk+Bike Education Jump Start program, a school district has use of 36 bikes, a covered
trailer, 90 helmets and other equipment and materials for one school year. BTA will provide the
district with the above materials and a minimum 8-hour curriculum training at the beginning of the
school year. BTA will provide email and phone support as the district creates a schedule to move the
bike fleet from school to school while the teachers teach the Walk+Bike Education program. The
district will provide (recommended PE/Health) teachers to attend the training and completion of an
evaluation process after the year is over. The teachers will implement the bike safety and optional
pedestrian safety education programs during the school year using the equipment and materials
provided. BTA, district, and teachers will evaluate the program at the end of the school year. The
goal of the Jump Start program is to allow interested school districts to implement all aspects of a
bicycle and optional pedestrian program for one year w=ith no upfront cost.
