Newberg-Dundee Police ~ Computer Forensics Services 1 t tl Newberg-Dundee t�EBOFF/QFH Police Department P. 0.Box 970 i 401 E.Third Street f Newberg,OR 97132 PO L I G E 503-538-8321 ® Brian T.Casey s Chief of Police t 1 z i d F MEMORANDUM OF UNDERSTANDING p This MOU is entered into this '2 S day of 1�6 A O [H 2015, by and between the Newberg-Dundee Police Department and the City of Tigard Police Department. 1 WHEREAS, the Newberg-Dundee Police Department has staffing and expertise in the field of computer forensics; and WHEREAS,the City of Tigard Police Department has a need for computer forensics services in conjunction with investigations and prosecutions; and WHEREAS,the City of Newberg-Dundee Police Department has agreed to provide computer forensics services to the City of Tigard Police Department on a case by case fee for$65/hour. i, F i E NOW THEREFORE, the Newberg-Dundee Police Department and Tigard Police Department agree as follows: I 1. Upon request from the Tigard Police Department, the Newberg-Dundee Police Department will provide computer forensics services to the best of its abilities and subject to prior work assignments. it 2. The Newberg-Dundee Police Department will bill Tigard Police Department at a rate of $65/hr for work performed under this MOU. Billed time begins after the computer is imaged and when the detective/s begins to work on the imaged copy. For court testimony, billed time begins when the Newberg-Dundee Detective leaves the public safety building for court. 3. The Newberg-Dundee Police Department will account for hours worked on each case submitted by the Tigard Police Department. A monthly invoice will be sent to the Tigard Police d Department. The invoice will include hours worked for each case using a Tigard Police Department's case number. s 1 g 4. In return for the provision of computer forensics services,the Tigard Police Department will remit payment to the Newberg-Dundee Police Department within 60 days of receipt of the invoice. 1 � I i z a i k 5. This MOU may be amended at a later date should the parties determine that such amendment is necessary. Amendments must be in writing and agreed to by both parties 6. Any party to this MOU may opt out of the terms of the MOU upon 60 days written notice to the other party. The Newberg-Dundee Police Department and the City of Tigard Police Department agree to each maintain insurance or self-insurance consistent with the provisions of the Oregon Tort Claims Act, ORS 30.270 and customary for public agencies of the same size and type. 8. Both parties agree to indemnify, defend, and hold harmless the other party and its officers, agents, employees,and elected officials against all liability, loss, and costs arising from , e actions, suits, claims,or demands for its acts or omissions in performance of this MOU. 9. This MOU may be executed in counterparts, each of which shall be deemed to be an original and,taken together,shall constitute the same agreement.
