Contract# R � CITY OF TIGARD,OREGON AGREEMENT FOR SERVICES RELATED TO ASH AVENUE PUBLIC WORgS YARD DEMOLITION THIS AGREEMENT made and entered into this 15''day of July,2015 by and between the City of Tigard,a municipal corporation of the State of Oregon,hereinafter called"City',and LOI Environmental&Demolition Services,hereinafter called"Contractor",collectively known as the"Parties." RECITALS WHEREAS, the City's 2015-2016 fiscal year budget provides for demolition services related to the City's Ash Avenue Public Works Yard project; and WHEREAS, Contractor has submitted a bid or proposal to City to provide specific services;and WHEREAS, Contractor is in the business of providing specific services, and is aware of the purposes for which City requires the services;and WHEREAS, City and Contractor wish to enter into a contract under which City shall purchase the services described in Contractor's bid or proposal; THEREFORE,The Parties agree as follows: 1. SERVICES TO BE PROVIDED Contractor agrees to provide services related to demolition of structures located at 12800 SVG' Ash Avenue,Tigard,Oregon 97223 as detailed in Exhibit A—Scope of Services and by this reference made a part hereof. 2. EFFECTIVE DATE AND DURATION Contractor shall initiate services upon receipt of City's notice to proceed, together with an executed copy of this Agreement. This Agreement shall become effective upon the date of execution and shall expire, unless otherwise terminated or extended, on August 31, 2015. All services shall be completed prior to the expiration of this Agreement. 3. COMPENSATION City agrees to pay Contractor an amount not exceeding Sixty Three Thousand Six Hundred Thirteen and No/100 Dollars ($63,613.00) for performance of those services described herein, including the base project and both alternate items. Payment shall be based upon the following applicable terms: A. Payment will be made in installments based on Contractor's invoice, subject to the approval by the City, and not more frequently than monthly. Payment shall be made only for work actually completed as of the date of invoice. B. Payment by City shall release City from any further obligation for payment to Contractor, for services performed or expenses incurred as of the date of the invoice. Payment shall not be considered acceptance or approval of any work or waiver of any defects therein. C. Contractor shall make payments promptly, as due, to all persons supplying labor or materials for the prosecution of this work. D. Contractor shall not permit any lien or claim to be filed or prosecuted against the City on any account of any labor or material furnished. E. Contractor shall pay to the Department of Revenue all sums withheld from employees pursuant to ORS 316.167. F. If Contractor fails, neglects or refuses to make prompt payment of any claim for labor or services furnished to Contractor or a subcontractor by any person as such claim becomes due, City may pay such claim and charge the amount of the payment against funds due or to become due the Contractor. The payment of the claim in this manner shall not relieve Contractor or their surety from obligation with respect to any unpaid claims. G. Contractor shall pay employees at least time and a half pay for all overtime worked in excess of 40 hours in any one work week except for individuals under the contract who are excluded under ORS 653.010 to 653.261 or under 29 USC sections 201 to 209 from receiving overtime. H. Contractor shall promptly, as due, make payment to any person, co-partnership, association,or corporation, furnishing medical, surgical, hospital care or other needed care and attention incident to sickness or injury to the employees of Contractor or all sums which Contractor agrees to pay for such services and all moneys and sums which Contractor collected or deducted from the wages of employees pursuant to any law, contract or agreement for the purpose of providing or paying for such service. I. The City certifies that sufficient funds are available and authorized for expenditure to finance costs of this contract during the current fiscal year. Appropriations for future fiscal years shall be subject to budget approval by the City Council. 4. PREVAILING WAGE The provisions of ORS Chapters 279A and 279C and all other Oregon and Federal provisions pertaining to minimum salaries and wages shall be incorporated by reference as if fully set forth into any contract arising from this solicitation. Any successful contractor shall agree that the workmen in each trade or occupation required for the work to be done pursuant to the contract, employed in the performance of the Contract, either by the Contractor or Subcontractor or other person doing or contracting to do any part of the work contemplated by the Contractor shall be paid not less than the prevailing,minimum hourly rate of wage specified by the Commissioner of the Bureau of Labor, which shall be incorporated and in full effect during the contract. If this project is subject to both Federal Davis-Bacon Act requirement and State of Oregon Prevailing Wage Rate requirements, the successful contractor shall ensure that workers will be paid the higher of the applicable federal or state rate. If the successful contractor fails to pay for labor or services, the City may pay for those labor and services and withhold these amounts from payments that are due the Contractor in accordance with ORS 279C.515 The successful contractor shall be required to provide proof as requested to the City prior to the beginning of any of the work that the successful contractor has filed a public works bond with a corporate surety in the amount of $30,000 with the Construction Contractors Board as required 21 under Oregon PWR law. The successful contractor shall also require in every subcontract to the subsequent agreement that the subcontractor file a public works bond with the Construction Contractors Board in the amount of$30,000 prior to starting work on this project unless otherwise exempt. In the event the contract arising from this solicitation is in the amount of$50,000 or greater, the City shall pay a fee equal to one-tenth of one percent (.001) of the price of the contract to the Bureau of Labor and Industries. The fee shall be paid on or before the first progress payment or sixty (60) days from the date work first began,whichever comes first. ASSIGNMENT/DELEGATION Neither party shall assign or transfer any interest in or duty under this Agreement without the written consent of the other and any attempted assignment or transfer without the written consent of the other party shall be invalid. 6. SUBMITTING BILLS AND MAKING PAYMENTS All notices and bills shall be made in writing and may be given by personal delivery, mail or fax. TERMINATION The parties agree that any decision by either party to terminate this Agreement before the 31 st day of August, 2015 shall be accompanied by five (5) days written notice to the other parts-prior to the date termination would take effect. There shall be no penalty for earl; termination. If City terminates the contract pursuant to this paragraph, it shall pay Contractor for services rendered prorated to the date of termination. 8. ACCESS TO RECORDS City shall have access to such books, documents, papers and records of Contractor as are directly pertinent to this Agreement for the purpose of making audit,examination,excerpts and transcripts. 9. FORCE MAJEURE Neither City nor Contractor shall be considered in default because of any delays in completion and responsibilities hereunder due to causes beyond the control and without fault or negligence on the part of the parties so disenabled, including but not restricted to, natural disaster, war, civil unrest,volcano, earthquake, fire, flood, epidemic, quarantine restriction, area-wide strike, freight embargo, unusually 3 � severe weather or delay of subcontractor or supplies due to such cause; provided that the parties so disenabled shall within ten (10) days from the beginning of such delay,notify the other party in writing of the cause of delay and its probable extent Such notification shall not be the basis for a claim for additional compensation. Each party shall,however,make all reasonable efforts to remove or eliminate such a cause of delay or default and shall,upon cessation of the cause,diligently pursue performance of its obligation under the Agreement 10. NON-DISCRIMINATION Contractor agrees to comply with all applicable requirements of federal and state civil rights and rehabilitation statues, rules, and regulations. Contractor also shall comply with the Americans with Disabilities Act of 1990, ORS 659A.142, and all regulations and administrative rules established pursuant to those laws. 11. INDEMNITY Contractor agrees to and shall defend,indemnify and hold harmless City, City's officers, employees, agents and representatives from and against all liability, claims, costs, demands, judgments, penalties, and causes of action of any kind or character, or other costs or expenses incidental to the investigation and defense thereof, of whatever nature, resulting from or arising out of the activities of the Contractor or its subcontractors, agents, or employees in performance of this contract, except,however,that the foregoing shall not apply to liability that arises out of the City's,its officers, employees,agents and representatives sole negligence. If any aspect of this indemnity shall be found to be illegal or invalid for any reason whatsoever, such illegality or invalidity shall not affect the remainder of this indemnification. 12. INSURANCE Contractor shall maintain insurance acceptable to City in full force and effect throughout the term of this contract. Such insurance shall cover risks arising directly or indirectly out of Contractor's activities or work hereunder. The policy or policies of insurance maintained by the Contractor shall provide at least the following Emits and coverages: A. Commercial General Liability Insurance Contractor shall obtain, at contractor's expense, and keep in effect during the term of this contract, Comprehensive General Liability Insurance covering Bodily Injury and Property Damage on an "occurrence" form (CG 2010 1185 or equivalent). This coverage shall include Contractual Liability insurance for the indemnity provided under this contract. The following insurance will be carried: Coverage Limit General Aggregate 2,000,000 Products-Completed Operations Aggregate 1,000,000 Personal&Advertising Injury 1,000,000 Each Occurrence 1,000,000 Fire Damage (any one fire) 50,000 41 . B. Pollution Exposure Contractor shall obtain coverage for the duration of the contract for pollution legal liability, including investigation and legal defense costs, for bodily injury and property damage, including loss of use of damaged property or of property that has not been physically damaged or destroyed. Such coverage must provide coverage for both on-site and off-site clean-up costs and cover gradual and sudden pollution. Coverage shall be maintained in an amount of at least: 1. $2,000,000 each occurrence for Contractor's operations at the site;and 2. $2,000,000 each occurrence for all treatment, storage and disposal facilities, including transportation to such facilities 3. If the policy contains a general aggregate limit or policy limit,it shall beat least$1,000,000 C. Commercial Automobile Insurance Contractor shall also obtain, at contractor's expense, and keep in effect during the term of the contract, Commercial Automobile Liability coverage including coverage for all owned, hired, and non-owned vehicles on an"occurrence"form.The Combined Single Limit per occurrence shall not be less than$2,000,000. If Contractor uses a personally-owned vehicle for business use under this contract, the Contractor shall obtain, at Contractor's expense, and keep in effect during the term of the contract, business automobile liability coverage for all owned vehicles on an "occurrence" form. The Combined Single Limit per occurrence shall not be less than$2,000,000. D. Workers'Compensation Insurance The contractor, its Subcontractors, if any, and all employers providing work, labor, or materials under this Contract that are subject employers under the Oregon Workers' Compensation Law shall comply with ORS 656.017, which requires them to provide workers' compensation coverage that satisfies Oregon law for all their subject workers. Out-of-state employers must provide Oregon workers' compensation coverage for their workers who work at a single location within Oregon for more than 30 days in a calendar year. Contractors who perform work without the assistance or labor of any employee need not obtain workers' compensation coverage. All non-exempt employers shall provide Employer's Liability Insurance with coverage limits of not less than$1,000,000 each accident. E. Additional Insured Provision All policies aforementioned, other than Workers' Compensation and Professional Liability, shall include the City its officers, employees, agents and representatives as additional insureds with respect to this contract. F. Insurance Carrier Rating Coverages provided by the Contractor must be underwritten by an insurance company deemed acceptable by the City. All policies of insurance must be written by companies having an A.M. Best rating of"A-VII" or better, or equivalent. The City reserves the right to reject all or any insurance carrier(s)with an unacceptable financial rating. 5 G. Self-Insurance The City understands that some Contractors may self-insure for business risks and the City will consider whether such self-insurance is acceptable if it meets the minimum insurance requirements for the type of coverage required. If the Contractor is self-insured for commercial general liability or automobile liability insurance the Contractor must provide evidence of such self-insurance. The Contractor must provide a Certificate of Insurance showing evidence of the coverage amounts on a form acceptable to the City. The City reserves the right in its sole discretion to determine whether self-insurance is adequate. H. Certificates of Insurance As evidence of the insurance coverage required by the contract, the Contractor shall furnish a Certificate of Insurance to the City. No contract shall be effective until the required Certificates of Insurance have been received and approved by the City. The certificate will specify and document all provisions within this contract and include a copy of Additional Insured Endorsement. A renewal certificate will be sent to the below address prior to coverage expiration. I. Independent Contractor Status The service or services to be rendered under this contract are those of an independent contractor. Contractor is not an officer,employee or agent of the City as those terms are used in ORS 30.265. J. PrimM Coverage Clarification The parties agree that Contractor's coverage shall be primary to the extent permitted by law. The parties further agree that other insurance maintained by the City is excess and not contributory insurance v ith the insurance required in this section. K. Cross-Liability Clause A cross-liability clause or separation of insureds clause will be included in all general liability, professional liability,pollution and errors and omissions policies required by this contract. A certificate in form satisfactory to the City certifying to the issuance of such insurance will be forwarded to: City of Tigard Atm: Contracts and Purchasing Office 13125 SW Hall Blvd. Tigard,Oregon 97223 At the discretion of the City, a copy of each insurance policy, certified as a true copy by an authorized representative of the issuing insurance company may be required to be forwarded to the above address. Such policies or certificates must be delivered prior to commencement of the work. The procuring of such required insurance shall not be construed to limit contractor's liability hereunder. Notwithstanding said insurance, Contractor shall be obligated for the total amount of any damage, injury,or loss caused by negligence or neglect connected v-ith this contract. 6 ,. 12. ATTORNEY'S FEES In case suit or action is instituted to enforce the provisions of this contract, the parties agree that the losing party shall pay such sum as the court may adjudge reasonable attorney fees and court costs, including witness fees (expert and non-expert),attorney's fees and court costs on appeal. 13. COMPLIANCE WITH STATE AND FEDERAL LAWS/RULES Contractor shall comply with all applicable federal, state and local laws, rules and regulations, including, but not limited to, the requirements concerning working hours, overtime, medical care, workers compensation insurance, health care payments, payments to employees and subcontractors and income tax withholding contained in ORS Chapters 279A, 279B, and 279C, the provisions of which are hereby made a part of this agreement. 14. DMZ LICENSE In the event the Contractor encounters any suspect asbestos containing material (SACn and it is found to contain asbestos, the Contract certifies by signature below, that they or hired subcontractor with firm holding a current license,issued by the Department of Environmental Quality,under ORS 468A.720, to properly handle asbestos abatement projects. The Parties understand this will likely be addressed through a Change Order to this Agreement. 15. CITY OF TIGARD BUSINESS LICENSE Contractor shall obtain, prior to the execution of any performance under this Agreement, a City of Tigard Business License. The Tigard Business License is based on a calendar year with a December 31st expiration date. New businesses operating in Tigard after June 30th of the current year will pay a pro-rated fee though the end of the calendar year. 16. GOVERNING LAWS Contractor shall comply with all applicable federal, state and local laws;and rules and regulations on non-discrimination in employment because of race, color, ancestry, national origin, religion, sex, marital status, age, medical condition or disability. The provisions of this Agreement shall be construed in accordance with the provisions of the laws of the State of Oregon. All provisions required by ORS Chapter 279 to be included in a contract of this type are incorporated into this Agreement as though fully set forth herein. Any action or suits involving any question arising under this Agreement must be brought in the appropriate court of the State of Oregon. Contractor shall further comply vith all current federal, state, and local laws pertaining to any demolition, renovation, repair, construction or maintenance activity of any public or private facility that involves the repair, enclosure, encapsulation, removal, salvage, handling or disposal of any material with the potential of releasing asbestos fibers from asbestos-containing material into the air. 17. CONFLICT BETWEEN TERMS It is further expressly agreed by and between the parties hereto that should there be any conflict between the terms of this instrument in the proposal of the contract, this instrument shall control and nothing herein shall be considered as an acceptance of the terms of proposal conflicting herev ith. 7 1 . 18. SEVERABILITY In the event any provision or portion of this Agreement is held to be unenforceable or invalid by any court of competent jurisdiction,the validity of the remaining terms and provisions shall not be affected to the extent that it did not materially affect the intent of the parties when they entered into the agreement. 19. COMPLETE AGREEMENT This Agreement, including the exhibits, is intended both as a final expression of the Agreement between the Parties and as a complete and exclusive statement of the terms. In the event of an inconsistency between a provision in the main body of the Agreement and a provision in the Exhibits, the provision in the main body of the Agreement shall control. In the event of an inconsistency between Exhibit A and Exhibit B,Exhibit A shall control. No waiver, consent, modification, or change of terms of this Agreement shall bind either party unless in writing and signed by both parties. Such waiver, consent, modification, or change if made, shall be effective only in specific instances and for the specific purpose given. There are no understandings, agreements, or representations, oral or written, not specified herein regarding this Agreement. Contractor, by the signature of its authorized representative, hereby acknowledges that he/she has read this Agreement,understands it and agrees to be bound by its terms and conditions. Bac round The City of Tigard is participating in a public/private partnership to redevelop the site located at 12800 SW Ash Avenue,Tigard, Oregon 97223 from a public works maintenance yard into residential dwelling units. The City is responsible for the removal of buildings on the site. The Contractor shall provide the following work on this project: 2. Scope of Work • Call for and obtain utility locates. • Demolish and remove buildings down to concrete slab. Buildings to be removed are identified on Sht. 1 of 2. Remove all debris and deliver to proper disposal sites. • Install and maintain erosion control measures during demolition. See minimum requirements on Sht. 1 of 2. • Cap affected utilities per Building Code—storm drain/water/sanitary sewer. • Provide dust suppression during demolition. The existing water meter onsite can be used as a temporary construction meter. Contractor will be responsible to pay for water usage. • Contractor to load 6' diameter, 15'long sequoia tree onto city vehicle for haul-off • Hazardous Material During a pre-demolition building materials survey lead paint was identified and must be handled in compliance with Oregon OSHA and Federal OSHA 1926.62. While no asbestos material was identified during the survey and therefore no asbestos abatement required at the onset of work, suspect asbestos containing material (SACN� may be encountered during demolition in areas that were untested. Contractor must be diligent in watching for possible SACM during demolition and must have an Oregon certified asbestos abatement contractor (or have certification themselves) ready to abate any found SACM. If SACM is found the Contractor shall certify that they, or identified subcontractor, will maintain throughout the duration of this Agreement a current license, issued by the Department of Environmental Quality, under ORS 468A.720,to properly handle asbestos abatement projects. A copy of the pre-demolition building materials survey is attached to this RFQ as Attachment 1. 3. Alternate Items—Fully-Incorporated into Contractor's Work Responsibilities • ALT 1 - Remove approximately 100 concrete gravity blocks from the western side of the property. Block sizes vary, approximately 2.5'x2.5'x5'. • ALT 2 -Demolish and remove building slab. (.'assumed to be 6" thick). (AMEC) performed a regulated building materials(RBM) survey for the City of Tigard at the City of Tigard Work Yard facility at 12800 SW Ash Avenue Tigard, Oregon (Site). Included in this survey are the Operations Building, Fabrication/Street Shop, Sign Shop, and a small out building Maintenance Shop (Figure 1). The main purpose of the surrey was to identify asbestos-containing materials (ACM), and regulated building materials (RBM), particularly lead in the painted surfaces throughout the buildings prior to demolition of the buildings. Regulated building materials (such as suspect ACM, lead paint(LP), and other potentially hazardous materials often require special management, handling procedures, and environmental controls; and their presence on a building scheduled for remodeling affects project design, cost, and contractor execution (Appendix B, General Information of Hazardous Materials). These issues are best addressed during design development and incorporated into the contractor's scope of work. The survey was conducted by Ms. Sonia Kingdon of AMEC, on December 16, 2013. Ms. Kingdon is an accredited Building Inspector under the Asbestos Hazard Emergency Response Act (AHERA) and is also a United States Environmental Protection Agency(EPA)accredited Lead Risk Assessor. 2.0 PROJECT BACKGROUND AND GENERAL SITE INFORMATION The Site buildings include: • The Operations Building near the entrance to the Site is(approximately 1,980 square feet) built over a slab on grade, cement masonry unit(CMU) block foundation. The interior finishes are primarily sheetrock wall systems, paneling, carpet, sheet floor vinyl, and ceiling panels. • The Fabrication Street Shop building, adjacent to the Operations Building, (approximately 3,264 square feet) built over a slab on grade, CMU block foundation with aluminumlvinyl siding. Interior finishes are primarily sheetrock wall systems, aluminum/vinyl siding with fiberglass insulation and paper backing, ceiling tiles, carpeting, and sheet vinyl flooring materials. Project No.: 3-61 M-1258430 February 10,2014 K:1120001125001125841125843_RBM_Survey\RBM Survey\RBM City Of Tigard Rpt.Docx 1 9' amec City of Tigard Public Work Yard ` Pyre-Demolition Regulated Building Materials Survey • The Sign Shop building adjacent to the Fabrication Street Shop building, is primarily a large (approximately 2,992 square feet)segmented metal building,slab on grade,with associated rooms (some with CMU), a waste storage area, and several attached sheds and bunkers. • One small Maintenance outbuilding, located to the front of the Sign Shop in the parking lot, (approximately 702 square feet) primarily wood and some CMU block slab on grade and mostly wood framed structure. Ms. Kingdon walked around the exteriors and through the interiors of the buildings to record observations and obtain samples of representative materials. The recorded observations, materials sampled, and sample locations are described below. 3.0 ASBESTOS SURVEY 3.1 SAMPLING METHODOLOGY The asbestos survey conducted by AMEC endeavored to satisfy federal, state, and local regulations that require a survey to be performed prior to the renovation or demolition of existing buildings. The scope of this survey included the following: • Conducting an asbestos survey with a focus on identifying specified suspect ACM. The survey was targeted to include specific materials and spaces identified by AMEC personnel during the Site visit. • Collecting bulk samples of the suspect ACM in accordance with the EPA and EPA National Emissions Standards for Hazardous Air Pollutants (NESHAPS)guidelines for surveys of buildings related to renovation or demolition projects. • Submitting the bulk asbestos samples to a laboratory which is accredited by the National Voluntary Laboratory Accreditation Program (NVLAP)to conduct analysis of bulk asbestos samples. The samples were analyzed by polarized light microscopy(PLM)on a standard turnaround-time basis. • Recording the locations of suspect ACM related to the buildings at the Site. • Preparing a detailed report that summarizes our findings, conclusions, and recommendations. The AMEC survey involved a visual inspection of the interiors and exteriors of the Site structures to identify accessible suspect ACM. Bulk samples were collected from locations of representative suspect building materials to evaluate the type and concentration of asbestos (Figure 2). AMEC Environment&Infrastructure, Inc. Care was taken to prevent cross-contamination of samples. Relevant sample data were recorded in the field at the time and place the samples were collected. Bulk samples were sent to NVL Laboratories, Inc. (NVL)an accredited asbestos laboratory in Seattle,Washington for analysis. The samples were analyzed for the presence of identifiable asbestos fibers using PLM in accordance with EPA Method 600/R-93/116 as specified in 40 Code of Federal Regulations(CFR), Chapter 1, Part 763, Subpart F,Appendix A. 3.2 RESULTS OF LABORATORY ANALYSIS A summary of bulk asbestos fiber analysis is presented in Table 1. The table presents the sample number, date of collection, description,type, condition, and sample concentration. A copy of the laboratory analytical report and chain-of-custody documentation is provided in Appendix A. No suspect ACM was observed or sampled at the Maintenance Building. A total of 26 samples were collected from the buildings including ceiling tiles, wall materials, window putty, interior insulation, sheet vinyl flooring, and roofing material. Of the 26 samples, none have laboratory analytical results that indicate detectable levels of asbestos. 4.0 LEAD IN PAINT SURVEY AMEC performed a LP Survey and assessment of the buildings as part of the regulated materials survey. The identification of LP contained in this report is from building observations and x-ray fluorescence(XRF) investigation of the painted surfaces of the observed predominant colors. The condition of the painted surfaces was also observed. The intent of the LP survey was to identify the presence of lead as a precaution to construction workers during future demolition activities performed in the buildings. The LP survey performed for this project does not constitute a strict Department of Housing and Urban Development(HUD)style (federal)lead-containing materials (LCM)survey. Paint condition, evidence of layering,type of substrate, and location of painted areas and other materials were noted. Sample locations were chosen based on the experience of the AMEC inspector. The condition of the painted surfaces were visually noted by the inspector. Table 2 details the XRF readings for the painted surfaces requested for all of the buildings. At location X33,the XRF detected lead, and a paint chip sample was collected at location X33 for laboratory analysis (e.g., Lab sample number 4). The laboratory analysis indicated a lead concentration of 37,000 milligrams per kilogram (mg/kg) in sample number 4,taken from a wood panel painted yellow, which is located at the upper deck, above Mr. Vance Walker's office at the Fabrication Street Shop. The paint at the wood panel at X33/sample number 4 is intact and in good condition. The sample number 4 result exceeds the 5,000 mg/kg threshold for EPA regulation of lead paint, meaning that the affected component will need to be removed from the structure prior to demolition. Five other paint chip samples were taken based upon the inspectors experience and need for random interior and exterior samples to corroborate XRF performance. Of these five remaining samples, only sample number 6 contained a detectable level of lead, at 180 mg/kg, which is below the EPA threshold. Sample number 6 was collected at XRF sampling location number 25,the emergency exit exterior metal door at the south wall of the second floor of the Operations Building. Please refer to Figure 2, which illustrates the location of XRF and lead paint chip samples, and Table 2 which illustrates by location and component the XRF readings and laboratory results. Good,fair, and poor assessments of paint conditions are standard. In general, most coatings on the exterior and interiors of buildings were in wide ranges of conditions. 5.0 OTHER REGULATED BUILDING MATERIALS Polychlorinated Biphenyls(PCBs)and Mercury Components During the survey,AMEC observed a wide range of fluorescent light fixtures. Many of the ballasts observed do not have the "No PCBs" label on the ballast or were in inaccessible areas. Therefore, they are assumed to be PCB containing. A licensed electrician should dismantle these fixtures and "drum-up"the ballasts as regulated waste. There were no observable wall mounted thermostats with mercury capsules. 6.0 CONCLUSIONS AND RECOMMENDATIONS 6.1 CONCLUSIONS AMEC conducted targeted testing of building materials for the presence of ACM and Lead-in-Paint. Based upon our observations and the results of bulk material testing, AMEC concludes the following: • Of the observed materials,there is no ACM that must be removed prior to demolition. Use special procedures when disturbing these locations, as outlined in the EPA guidelines, otherwise keep maintained. • During the course of demolition or maintenance other environmental concerns could possibly become evident. 6.2 RECOMMENDATIONS 1. Provide copies of this report to contractors bidding on building projects and to employees performing duties during the maintenance or demolition of these buildings. 2. Ensure that employees, contractors/subcontractors, and their employees are given a comprehensive safety and health orientation to the project before they begin work on this Site. The safety orientation training should include general safety, health, and security procedures and policies, as well as the project specific rules and regulations. Asbestos is a recognized human carcinogen and has come under stringent regulatory action regarding its handling, application, and/or removal. Asbestos containing material (ACM) is defined as any material that contains more than/%of asbestos by volume. The highest level of exposure can generally occur to asbestos that is considered to be"friable." Friable ACM are materials that can release fibers when crumbled, pulverized, or reduced to powder by hand pressure. Inhalation of airborne asbestos fibers has been linked to lung cancer, asbestosis(a fibrogenic lung disease), and mesothelioma (a fatal cancer of the lung or abdominal lining). Asbestos content of suspect materials is determined by collecting bulk samples and submitting them to a qualified laboratory. AMEC utilizes laboratories that are accredited for the analysis of bulk asbestos samples by the National Voluntary Laboratory Accreditation Program (NVLAP), such as RJ Lee Group, Inc. (RJ Lee) in San Leandro, California. At the NVLAP-accredited laboratory the samples are analyzed by polarized light microscopy (PLM) in accordance with United States Environmental Protection Agency(EPA) Method 600/R-93/116 as specified in 40 Code of Federal Regulations(CFR), Chapter I, Part 763, Subpart F,Appendix A. The analytical process involves of first examining the sample under a stereoscopic microscope. Fibrous materials observed are then analyzed for content and morphology by immersing representative fibers in a fluid with a known refractive index. Asbestos fiber content percentage is estimated by visually comparing the quantity of non-asbestos material with the asbestos fibers. In some situations, a sample may be reanalyzed by California Air Resources Board (CARE) Method 435,which is based on EPA Method 600. This method is a 400-point count procedure to more accurately determine the quantity of asbestos in the material sampled. This is allowed under EPA regulations if the quantity of asbestos reported, utilizing the PLM method, is equal to or less than 10%. Another method that can be utilized to better determine asbestos content is transmission electron microscopy(TEM). OSHA considers building materials that contain less than I% asbestos to be a potential hazard during construction activities such as renovation or demolition. Employees performing certain tasks, where there is possible exposure to asbestos-containing dust, are required to take certain precautions. These include using wet methods, providing prompt and proper disposal of the materials and wearing respirators until air sample results document that the concentration of airborne fibers in work areas is below the permissible exposure limit(PEL)of 0.1 fibers per cubic centimeter of air(f/cc). Page 1 of 3 General Information on Hazardous Materials amecr1%',',L- Lead-Based Paint Lead-based paint(LBP) is a potential health hazard because it may contribute to lead- containing dust inside or outside a structure. Lead dust can be produced by abrasion of friction surfaces(opening and closing windows), peeling,flaking, or chalking as lead-based paint ages, or as a result of disturbance such as scraping or sanding of lead-based paint. Lead dust is of concern because the small particles can easily enter the body by ingestion and inhalation. In 1971,the federal government passed the Lead-Based Paint Poisoning Prevention Act (LBPPPA),which defined LBP for the first time as paint containing more than 1% lead by weight or 10,000 parts per million (ppm). In 1977,the LBPPPA was amended and the definition of LBP was changed to paint containing more than 0.06% lead by weight, or 600 ppm. In 1990, Housing Urban Development(HUD)published Lead-Based Paint: Interim Guidelines for Hazard Identification and Abatement in Public and Indian Housing. The HUD guidelines, which only apply to Public Housing Agencies and Indian Housing Authorities, represent the first national compilation of technical protocols, practices, and procedures on testing and abatement of LBP. In 1995, HUD published Guidelines for the Evaluation and Control of Lead-Based Paint Hazards in Housing, which replaces the 1990 HUD guidelines. The 1995 HUD guidelines consider a LBP hazard to exist and require abatement if paint contains lead of an amount greater than or equal to 0.5% by weight(5,000 ppm), or greater than or equal to 1.0 milligram per square centimeter(mg/cm). EPA defines LBP as equal to or greater than 0.5% by weight. Lead content of suspect LBP is determined by collecting bulk samples and submitting them to a qualified laboratory. Federal OSHA considers any detectable concentration of lead to be a potential hazard during construction activities such as renovation or demolition. Employees performing certain tasks, where there is possible exposure to lead dust, will be required to wear respirators until air sample results document that the concentration of airborne lead in work areas is below the permissible exposure limit(PEL)of 50 micrograms per cubic meter(Ng/m). Historical data from similar types of projects can be used to demonstrate that the PEL will not be exceeded. Polychlorinated Biphenyls At one time, polychlorinated biphenyls (PCBs)were widely used as insulators in electrical equipment such as capacitors, switches, and voltage regulators. Most fluorescent light ballasts manufactured before July 1979 commonly used capacitors containing PCBs. Sealed inside the capacitor was approximately a teaspoon of concentrated PCBs. Potting material surrounds the capacitor, which was encased in a ballast box. In 1979, the United States Environmental Protection Agency(EPA) banned the further manufacture of equipment containing PCBs. Most Page 2 of 3 General Information on Hazardous Materials ballasts manufactured after 1979 do not contain PCBs and are labeled "Non-PCB, No-PCBs, or PCB Free." Because PCB-containing electrical equipment was allowed to be installed after 1979,the best method to determine if a particular piece of equipment may contain PCBs is to look for the Non-PCB, No PCB, or PCB Free label on the equipment. If there is no label, assume the equipment contains PCBs. The EPA has classified all PCBs as probable carcinogens. Evidence suggests a possible association between PCB exposure and liver cancer. PCBs also have significant ecological and human health effects other than cancer. Long-term health effects can include effects on the nervous or reproductive systems, immune system suppression, hormone disruption, respiratory tract symptoms, gastrointestinal effects and effects on the skin and eyes, such as, chloracne, skin rashes, and eye irritation. EPA regulates PCBs through rules issued pursuant to the federal Toxic Substances Control Act (TSCA)of 1976. These regulations generally control the use, marking, storage, records, and disposal of PCBs. There are millions of pieces of equipment in current operation in the U.S.that were manufactured prior to these regulations and which contain PCBs. Precautions need to be taken by workers handling PCB-containing electrical equipment, especially those showing evidence of leaks, to prevent exposure primarily by skin contact. Where leaks are likely to exist,worker should use gloves, other appropriate personal protective equipment,engineering controls, or work practices to prevent exposure. Glove materials that prevent PCBs from breaking through in 24 hours should provide adequate skin protection. These materials include Neoprene (chloroprene latex), polyvinyl alcohol, FEP Teflon and Viton fluorocarbon rubber. Disposal of PCB-containing light ballasts or other similar equipment must be arranged through various EPA-authorized PCB transporters or PCB commercial storers. The ballasts must be disposed of at an EPA-approved chemical waste-processing site. Leaking ballasts are required to be handled and disposed of separately from non-leaking ballasts.
