VAR1995-00013 • • • CITY OF TIGARD NOTICE OF DECISION VARIANCE (VAR) 95-0013 HIEU PHAM-OWNER/APPLICANT .APPLICATION: A request by Hieu Pham for a five foot variance to the 15 foot corner side yard setback requirement. • ZONE: R-4.5 (Residential, 4.5 units per acre) LOCATION: 12550 SW Edgewater Court. (WCTM 1S1 34CB, Tax Lot 10100) DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE FINAL DECISION DATE NOTED BELOW. The findings and conclusions on which the decision was based are noted below: A. FINDINGS OF FACT , . 1. Site Information and Proposal Description The site is presently developed. The applicant proposes to add on to an • existing single-family residence at 12550 SW Edgewater Court. The applicant has requested a variance to allow approval to encroach five feet into the required 15 foot corner side yard setback in order to add a handicapped accessible bedroom and bathroom for to the home for a disabled relative. 2. Other Staff Comments • • The Engineering and Building Departments have reviewed the proposal and has offered no comments or objections. 3. Agency Comments Utility providers will be provided with a copy of this notice of decision and will be able to request that the decision be amended or set aside if the NOTICE OF DECISION . VAR 95-0013-PHAM ADDITION PAGE 1 • • requested setback variance would conflict with the provision of necessary services or with existing utilities. B. ANALYSIS AND CONCLUSION The Community Development Code Section 18.134.050 allows the Director to approve, or approve with conditions, a request for a variance based on the following findings: 1. The proposed variance will not be materially detrimental to the purposes of this title, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards, and to any other properties in the same zoning district or vicinity; The applicant has proposed to add a bedroom and bathroom to an existing residence. Due to the location of the home, a 15 foot sanitary sewer easement within the rear yard and existing accessory structures in the side and rear yard and the other setback requirements of the R-4.5 Zoning District, it is not possible to locate this addition on other portions of the site without requiring substantial remodeling of the residence. 2. There are special circumstances that exist which are peculiar to the lot size, shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other 'properties in the same zoning district; The site is constrained from developing the addition within the rear yard due to a 15 foot sewer easement and an existing deck. The floor plan of the home also would require extensive remodeling in order to develop a substantial size room addition within the rear yard area of this lot. The applicant is unable to develop the addition within the other sideyard due to an existing pool. 3. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting some economic use of the land; City setback standards are maintained to the extent possible because the applicant would still provide a 10 foot corner side yard setback to the S.W. Summercrest Drive. • 4. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely NOTICE OF DECISION VAR 95-0013-PHAM ADDITION PAGE 2 • • affected any more than would occur if the development were located as specified by this title; and This variance does not create a substantial impact to existing physical and natural systems. No impacts are expected to traffic, drainage, land forms or parks due to the limited nature of this variance and the site's existing topography. 5. The hardship is not self imposed and the variance requested is the minimum variance which would alleviate the hardship. A review of the recorded plat map revealed that there is an existing 15 foot 'easement within the rear yard of the property. This easement has been provided for the provision of sanitary sewer service to the area. Based on . the type and location of this utility it is not possible to extend the room addition towards the rear yard for a distance greater than 12 feet. An existing deck limits the amount of width possible with an addition to the home in this area. It is not possible to construct the addition without remodeling or rebuilding the existing deck. An existing pool within the interior sideyard precludes developing the room addition within the sideyard opposite the S.W. Summercrest Drive. • Based on the preceding findings staff finds that the variance meets the applicable Development Code criteria and therefore approves the variance. C. PROCEDURE 1.
