APPLICATION: A request by Larry Abell, on behalf of Robert
Mercer, for a variance approval to allow the construction of a 20
foot aisle width, for approximately 25 feet within a parking lot,
whereas the code requires a 24 foot aisle width.
LOCATION: 114-5 SW 1th Avenue (WCTM 1S1 36DD, tax lot 801) .
South of SW Atlanta Street, north of SW Baylor Street and west of
SW 67th Avenue. ZONE: C-P (Professional Commercial) .
DECISION: Notice is hereby given that the Planning Director' s
designee for the City of Tigard has APPROVED the above request
subject to certain conditions . The findings and conclusions on
which the decision was based are noted below:
A. BACKROUND INFORMATION
1 . Site Information and Proposal Description
The subject site is approximately 9; 583 square feet in
size, vacant, and contains a number of mature trees .
The site received a Site Development Review (SDR 95-
0011) approval to construct a 1, 931 square foot office
building utilizing a joint access drive onto SW 67th
Avenue. A condition of approval of that decision
required a revised site plan which provided for a 24
foot access. The applicant is presently requesting for
an Administrative Variance to allow the construction of
a 20 foot aisle width, for approximately 25 feet within
the parking lot, whereas the code requires a 24 foot
aisle width.
2 . Agency Comments
The City of Tigard Engineering Division and Tualatin
Valley Fire and Rescue have reviewed this application
and have offered no comments, or objections . No other
comments have been received.

B. ANALYSIS AND CONCLUSION
Community Development Code section 18 . 134 . 050 provides
standards for granting a variance :
1 . The proposed variance will not be materially
detrimental to the purposes of this title, be in
conflict with the policies of the Comprehensive Plan, to
any other applicable policies and standards, and to
other properties in the same zoning district or
vicinity;
2. There are special circumstances that exist which are
peculiar to the lot size or shape, topography or other
circumstances over which the applicant has no control,
and which are not applicable to other properties. in the
same zoning district;

3 . The use proposed will be the same as permitted under
this title and City standards will be maintained to the
greatest extent that is reasonably possible while
permitting some economic use of the land;
4. Exisiting physical and natural systems, such as but
not limited to traffic, drainage, dramatic land forms,
or parks will not be adversely affected any more than
would occur if the development were located as specified
in this title; and
5. The hardship is not self-imposed and the variance
requested is the minimum variance which would alleviate
the hardship.
Criteria 1 : The applicant is requesting a variance from
the minimum required 24 foot wide driveway, to allow a
20 foot aisle width, for approximately 25 feet within
the parking lot . Section 18 . 108 . 050 (C) states that
• aisles accomodating two direction traffic, or allowing
access from both ends shall be 24 feet in width. The
purpose of Section 18 . 108 (Off-street Parking , and
Loading Requirements) is to establish parking areas

having adequate capacity and which are appropriately
located and designed to minimize any hazardous
conditions on-site and at access points.
The applicant contends that a reduction of the width to
20 feet will not be contrary to the purposes of Section
18 . 108 . The reduction is for a small length of the
driveway which serves only eight parking spaces, as
indicated on the site plan. By serving a limited number
of parking stalls, the volume of traffic served is
minimal . There is sufficient room for two cars to pass
within the 20 feet . In addition, given the 25 foot
length of this reduction one car can wait for the other
to pass through. It should be noted that an eight lot
parking area will provide less traffic than a 6 lot
subdivision on a private street and that Section
18 . 108 . 070 (A) allows a 20 foot paved drive to serve six
lots. Therefore, the requested reduction will not be
detrimental to the purposes of this section.
Criteria 2 : The special circumstances which exist
include the lots shape, location of adjoining
development and location / grade differential to SW 68th
Avenue . Access to SW 68th Avenue is not a preferable
alternative given the topography and location on a
curve . The preferred access is to SW 67th as approved
in the site development review. However, given the
orientation of the existing development, the request for
the variance is necessary.
Criteria 3 : The requested variance will in no way
affect the permitted use status of the office building.
All other City standards will be maintained as discussed
and approved in the site development review (SDR 95-
0011) .
Criteria 4 : Existing physical and natural systems will
not be adversely affected any more than would occur if
the variance were not requested. Drainage will be
connected to an approved system thereby minimizing
adverse effects on the natural system. Traffic
generation will not be effected. The impact of this

variance will be limited to a slight reduction in the
width of a required access .
Criteria 5 : The hardship related to this variance is
not self-imposed as it is brought about through the
limited choice of obtaining access . The requested
variance is the minimum variance which would alleviate
the hardship while still meeting the intent of the code
standard.
C. DECISION
Based on the above findings and conclusions, the Planning
Director' s designee APPROVES Variance VAR 95-0012 .
THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF
THE FINAL DECISION DATE NOTED BELOW.

which provides that a written appeal must be filed with
the City Recorder within 10 days after notice is given
and sent . Appeal fee schedule and forms are available at
Tigard City Hall, 13125 SW Hall Blvd. , Tigard, Oregon.
The deadline for filing of an appeal is 3 :30 p.m. on
October 25, 1995.

Dear Mr. Abell:
This letter is in response to your request for a 2,246 square foot office addition at 6745
SW Hampton Street.
This property is zoned C-P (Professional Commercial). The present use of the site is
listed as a permitted use for this zoning district. The existing office building received Site
Development Review approval (SDR 4-84) in April, 1984. The Tigard Community
Development Code, Site Development Review Section, states; "if the requested
modification meets any of the major modification criteria, that this request shall be
reviewed as a new Site Development Review application."
Section 18.120.070(B) states that the Director shall determine that a major
modification(s) will result if one or more of the following changes are proposed. There
will be:
1. An increase in dwelling unit density, or lot coverage for residential
development. This criteria is not applicable as this request involves commercial
uses.
2. A change in the ratio or number of different types of dwelling units. This
criteria is not applicable as this request involves commercial uses.
3. A change that requires additional on-site parking in accordance with
Chapter 18.106. The total amount of parking required for the existing structure
and proposed expansion is 28 spaces. A revised plan shall be submitted which
indicates the provision of 28 spaces, after the modifications to the,driveway width
have been made.
4. A change in the type of commercial or industrial structures as defined by
the Uniform Building Code. The addition requires no change to the B-2
occupancy classification and the type of building construction.
5. An increase in the height of the building(s) by more than 20 percent. The
addition will be the same height as the existing building.

6. A change in the type and location of accessways and parking areas where
off-site traffic would be affected. This request does not require a change in
accessways or parking areas where off-site traffic would be effected.
7. An increase in vehicular traffic to and from the site and the increase can be
expected to exceed 20 vehicles per day. The addition is primarily to add
display and storage area for seasonal displays of product. The addition will also
be used to add two additional offices. The use of the expansion is not expected
to increase vehicular traffic by more than 20 vehicle trips per day.
8. An increase in the floor area proposed for a non-residential use by more
than 10 percent excluding expansions under 5,000 square feet. The
expansion is less than 5,000 square feet.
9. A reduction in the area reserved for common open space and/or usable
open space which reduces the open space area below the minimum
required by this code or reduces the open space area by more than 10
percent. Open space is not required as part of a commercial development.
10. A reduction of project amenities (Recreational facilities, Screening; and/or,
Landscaping provisions) below the minimum established by this code or
by more than 10 percent where specified in the site plan. Recreational
facilities are not required as part of a commercial development. The C-P zone
requires the provision of a minimum of 15% of the site for landscaping.
Landscaping / imperious surface calculations have not been provided. A revised
plan shall be submitted which indicates that the proposal will still provide a
minimum 15% landscaping.
11. A modification to the conditions imposed at the time of site development
review approval which are not the subject of B. 1 through 10 above of this
subsection. The proposed expansion would not require a modification to the
conditions imposed with the original Site Development Review (SDR 4-84)
application. However, the site plan shows that the existing conditions are not in
compliance with the original conditions. Condition #3 and #4 (SDR 4-84)
required that all two-way driveways be a minimum of 24-feet in width and that the
applicant provide a joint access and maintenance agreement allowing shared
use of the proposed driveway between this property and the property to the east.
The current plan shows that the existing driveway is only 15-feet in width and
that the shared access is occupied by parking stalls. In order to approve the
proposed expansion, the site must be brought into compliance with City
Development Code standards. Therefore, the plans shall be modified to provide
a 24-foot wide driveway as originally conditioned, and as required by today's
standards.

This request is determined to be a minor modification to an existing site. The
Director's designee has determined that the proposed minor modification of this
existing site will promote the general welfare of the City and will not be significantly
detrimental, nor injurious, to surrounding properties provided that development
which occurs after this decision complies with applicable local, state and federal
laws.
This request has been approved subject to the following conditions:
1.) Landscaping/imperious surface calculations. The C-P zone requires the
provision of a minimum of 15% of the site for landscaping.
2.) Provision of a 24-foot wide driveway. Provision of 28 parking spaces to
serve the existing and proposed expansion.
3.) A building permit shall be obtained from the Building Department.

Dear Larry:
Thank you for response to the outstanding conditions of approval related to SDR 95-
0011. I am able to sign-off on #7(a) and #7(b), however, condition #7(e) is still
outstanding.
In reviewing the case file for the existing building (SDR 18-86), I could not find any
discussion of a concession to allow the construction of nine (9) parking spaces where ten
(10) had been required. If you have some documentation concerning this, please submit it
for review. Since there are some alternatives with providing one (1) additional parking
space, the Planning Division will release its' hold on the issuance of a building permit
This will allow to begin construction while we resolve this last item. Subsequent permits
will be put on hold should revised plans providing this additional space not be submitted
in a timely manner.

Please accept this further narrative explanation as part of our application for a
variance to the access requirement for our proposed new office building. The
project meets all other requirements as submitted.
Approval Criteria Section 18.134.050
ARCHITECT*LA PC 1. Reducing the access width from 24' to 20' is not materially
detrimental to purposes and policies of the City of Tigard. In this instance the
access is not from a public street but simply connects two adjacent parking
areas and provides access to seven parking spaces.
2. The special circumstances in considering granting this variance is
that unless access is granted from SW 68th,the only access to this corner
lot is by an easement from the adjacent property owner. Discussions with
City staff suggest that access from SW 68th should not be considered as
an option.
3. The.use of this property is not affected by granting this variance
and complies with established uses in this zone.
4. The existing physical and natural systems will not be adversely
affected by granting this variance. In fact, they will be protected more by
granting it than not because of the existing building location related to the only
area access can be considered. The existing pavement will simply be extended
• 5'to point of access (see site plan).
5. This hardship is not self-imposed and is the minimum required to
alleviate the hardship. Maintaining the slope easement along SW 68th and not
accessing the public street directly from this parcel is not of the appicant's
making and granting this variance is the minimum that makes this property
usable.
Hopefully this will answer the required criteria in granting a variance. Please let
me know if any additional material is required at this time. Thank you for your
help in completing this application.

Dear Staff:
Please accept this application for a variance to the access requirement for
our proposed new office building. The project meets all other requirements as
submitted.
ARCHITECT•LA PC We are proposing 1,931 square foot office building on two levels. It i5 proposed
to be built on a separate tax lot adjacent to an existing office building located
at the 11535 SW 67th address. The building is proposed to be built as a
complementary structure to the existing brick & glass building using similar
materials and details.

Unless access is granted from SW 68th, the only access to this corner lot is
by an easement from the adjacent property owner. If a variance from the
required 24' wide access to 20' can be granted, then an easement can be
obtained eliminating the need for access from SW 68th Avenue. both
property owners accept any inconvenience from this reduction which provides a
private connection between two shared parking areas. All required parking
spaces for both lots will be provided.

for approximately 25 feet within the parking lot, whereas, the code requires a 24 foot aisle

(Professional Commercial) The Professional Commercial zone allows public agency and
administrative services, public support facilities, professional and administrative services,
financial, insurance, and real estate services, business support services multiple-family
residential units, among others. APPLICABLE REVIEW CRITERIA: Community
Development Code Sections 18.134.
