RE: Statement for Variance: Lot 23, Marion Estates
Under 18.134.050, section 2; Special Circumstances.
Although this lot is 12,985 square feet in total, due to it's irregular shape (see attached plot map)
over one third of this is unuasable for building, particularly in the northeast corner.
In regards th the topography, it ranges from 100 feet to 79 feet, a difference of 21 feet from the
high point to the low point of the lot.
In order to control the amount of soil errosion and damage to the environment, the house is best
to be built between the 90 and 97 foot levels. This would make for limited soil removal and
errosion problems.
Under 18.134.050, section 3; Economic use of Land.
This is the last remaining lot in Marion Estates to be developed. Presently, it is overgrown, a
dumping point for neighborhood debris, and generally an unattractive addition to the subdivision.
Much time has been spent trying to develop a house plan for this site without sucess, but now a
variance of five feet for the northeast corner of the proposed plan would make construction
possible.
Section 18.134.050, section 5; Minimum Variance.
The CCR's for Marion Estates, require a minimum home of 2500 square foot home to be placed
on this property. We have met the requirements by designing a home of 2520 square feet. I
purchased this lot with the good faith to be able to begin construction in the spring of 1995. In
order to do this I will need a five foot variance on the northeast front corner of said house.

APPLICATION: A request by Marjorie Johnson for a variance approval
to allow a portion of a proposed residence to project approximatley
5 feet into the required 20 foot front yard setback.
ZONE: R-3 . 5 (Residential, 3 . 5 units per acre) .
LOCATION: 10250 SW Lady Marion Drive (WCTM 2S1 11CB, Tax Lot ,
5000) .
DECISION: Notice is hereby given that the Planning Director' s
designee for the City of 'Tigard has APPROVED the above request
subject to certain conditions . The findings and conclusions on
which the decision was based are noted below:
A. FINDING OF FACT
•
1 . Site Information and Proposal Description
The 12, 985 square foot, vacant site is an irregular
shaped lot which has access onto SW SW Lady Marion Drive .
The lot slopes from an elevation of 100 feet in the
northwest corner to an elevation of 79 feet in the
southeast corner. The applicant requests approval to
allow a portion of a proposed residence to project
approximatley 5 feet into the required 20 foot front yard
setback.
2 . Agency Comments
The City of Tigard Building Division and Engineering
Department have reviewed the proposal and has offered no
comments or objections . Utility providers will be
provided with a copy of this notice of decision and will
• be able to request that the decision be amended or set
aside if the requested setback allowance would conflict
with the provision of necessary services or with existing
utilities .
B. ANALYSIS AND CONCLUSION
Community Development Code section 18 . 134 . 050 provides standard
for granting a. variance :
1 . The proposed , variance will not be materially
detrimental to the purposes of this title, be in conflict
with the policies of the Comprehensive Plan, to any other
applicable policies and standards, • and to other

properties in the same zoning district or vicinity;
2 . There are special circumstances that exist which are
peculiar to the lot size or shape, topography or other
circumstances over which the applicant has no control,
and which are not applicable to other properties in the
same zoning district;
3 . The use proposed will be the same as permitted under
this title and City standards will be maintained to the
greatest extent that is reasonably possible while
permitting some economic use' of the land;
4 . Exisiting physical and natural systems, such as but
not limited to traffic, drainage, dramatic land forms, or
parks will not be adversely affected any more than would
occur if the development were located as specified in
this title; and
5 . The hardship is not self-imposed and the variance
requested is the minimum variance which would alleviate
the hardship.
Criteria 1 : The applicant is requesting a variance from
the minimum required 20 foot front yard setback
requirement in the R-3 . 5 zone, to allow a front yard
setback of 15 feet for a portion of a proposed single
family home . The front lot line is defined as a property
line which abuts a street . The intent of the front yard
setback is in part to provide open space between the
street and the house and to provide a parking and backing
distance from the garage. The portion of the proposed
house which would project into the front yard would not
effect the garage or front of the house setback, thereby
satisfying the intent of the setback.
In addition, the Community Development Code Section
18 . 146 (Flexible Setback Variance) allows expansions of
existing homes to protrude into the front yard up to 20
percent, or 4 feet in the case of the front yard setback.
The applicant' s requested setback is only 1 foot further
than what the City would allow for an expansion of a home
and therefore is not in conflict with or will be
materially detrimental to City policies . Granting of the
variance will in no way impact the adjoining properties
as the projection is located adjacent to the street and
there is no abutting residence which would be impacted by
this reduced setback.
Criteria 2 : The special circumstances which exist
include the lot' s irregular shape and topography. The

topography on the property limits options for locating
the proposed house. The location, as shown on the
submitted plan, is the most reasonable location given
both the topography and curvature of the street .
Generally speaking, a regular shaped lot' s front lot line
and setback would be the property line to which the
garage opens to the street . In this case, however, the
lot line follows the entire length of the street . The
curved street therefore creates a curved front yard
setback the length of the street, which encroaches into
the buildable area of the property and further limits the
options for locating the home . The site plan provides
for the required front yard setback where the garage
faces the street but because of the curved street the
corner of the proposed house encroaches approximately 5
feet into the setback area.
Criteria 3 : The requested variance will in no way affect
the permitted use status of the proposed single family.
All other City standards will be maintained.
•
Criteria 4 : Existing physical and natural systems will
not be adversely affected any more than would occur if
the variance were not requested. Drainage will be
connected to an approved system thereby minimizing
adverse effects on the natural system. Traffic
generation will not be effected. The impact of this
variance will be limited to a slight encroachment into
the required setback and 1 foot beyond what would be
allowed through a flexible setback variance.
Criteria 5 : The hardship related to this variance is
brought about through the limited choice of locating the
house due to topography, the irregular lot shape and
definition of front lot line . The requested variance is
the minimum variance which would alleviate the hardship.
C. DECISION
Based on the above findings and conclusions, the Planning
Director' s designee APPROVES Variance VAR 95-0006 subject to
the following conditions :
1 . Building permits must be obtained prior to construction
of the residential addition.
THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF
THE FINAL DECISION DATE NOTED BELOW.

Tigard City Hall, 13125 SW Hall Blvd. , Tigard, Oregon.
The deadline for filing of an appeal is 3 :30 p.m. on
May 8, 1995.
